NO. 472\/80<br \/>\n     This appeal  by special  leave arises from the judgment<br \/>\nof the\tDivision Bench\tof the\tAllahabad High Court made on<br \/>\nNovember 8,  1979 in CMWP NO.13\/78. The admitted position is<br \/>\nthat all  the respondents  are transport operators using for<br \/>\ntheir stage carriages the bus stand set up by the appellant-<br \/>\nBoard in Hapur. When the appellant-Board demanded payment of<br \/>\nthe fee\t at the\t rate of  Rs. 0.75  per day, though they had<br \/>\nbeen paying  fee earlier  at the  rate of  Rs. 0.50 per day,<br \/>\nthey contended\tthat the  municipality was  devoid of power.<br \/>\nThe High Court in the impugned judgment relying upon Jagdish<br \/>\nPrasad Bindla  vs. Municipal  Board Atroli  &amp; Anr.  CMWP No.<br \/>\n3976 of 1973 decided on July 18, 1979 had allowed the appeal<br \/>\nand quashed  the demand\t without the  municipality  has\t the<br \/>\npower to  levy fee demand the payment thereof for use of the<br \/>\nbus stand ?\n<\/p>\n<p>     The Government  in their order dated June\t13, 1959 had<br \/>\ndirected the  appellant\t and  all  other  municipalities  as<br \/>\nunder:\n<\/p>\n<blockquote><p>     &#8220;I am therefore to request that you<br \/>\n     may kindly advise all the municipal<br \/>\n     bodies in\tyour districts\tto  take<br \/>\n     steps   to\t  establish   bus-stands<br \/>\n     within their  municipal  limits  in<br \/>\n     accordance\t with\tthe   Government<br \/>\n     Orders so that no inconvenience for<br \/>\n     parking motor vehicles.&#8221;<\/p><\/blockquote>\n<p>     The same  direction was  reiterated  in  their  further<br \/>\nletter\tdated\tAugust\t23,   1960   impressing\t  upon\t the<br \/>\nmunicipality   to  establish  the  bus\tstand  urgently\t and<br \/>\nreport the  action taken  in  that  behalf.  In\t furtherance<br \/>\nthereof, the  municipalities had  set  up  bus\tstand  at  a<br \/>\nconsiderable expenditure  and fee  was levied for the use of<br \/>\nthe bus at varied rates by the owners of the motor vehicles.<br \/>\nAs regards  the\t rates\tpayable\t in  respect  of  the  stage<br \/>\ncarriages, it  was resolved  that each stage carriage should<br \/>\npay at\tthe rate  of Re\t 0.75 per  day. The resolution dated<br \/>\nFebruary 25,  1961, Item No. 1 of the bye-laws says that all<br \/>\nmotor vehicles\twhich run  on fare  shall be  parked only at<br \/>\nplaces specified by Nagar Palika and not at any other place.<br \/>\nItem No. 4 envisages that no private stand shall be made for<br \/>\nany parking  of any motor vehicle within the limits of Nagar<br \/>\nPalika. In Schedule A to the said Resolution, Item No.3 levy<br \/>\nof fee\thas been  imposed for  parking vehicles. viz, public<br \/>\nprivate bus  carrying vehicles,\t viz, public and private bus<br \/>\ncarrying passenger at the rate of Re.0.75 per day or part of<br \/>\nthe day.  It would,  thus, be  seen  that  pursuant  to\t the<br \/>\ndirections issued  by the  Government, the  bus stands\thave<br \/>\nbeen set  up for the convenience of the travelling public at<br \/>\na great\t expenditure and  for use  of the parking places the<br \/>\nfee has been prescribed.\n<\/p>\n<p>     The question  is :\t whether the  municipality has\tsuch<br \/>\npower to  levy the  fee? Section 293 of the Act empowers the<br \/>\nBoard to  charge fee  to be  fixed by  bye-laws or by public<br \/>\nauction\t or  by\t agreement,  for  the  use    of  occupation<br \/>\n(otherwise than\t under a  lease) of  any immovable  property<br \/>\nvested in,  or entrusted  to the  management  of  the  Board<br \/>\nincluding any public street or place of\t which it allows the<br \/>\nuse or\toccupation whether  by allowing a projection thereon<br \/>\nor otherwise.  Such fee\t may either be levied along with the<br \/>\nfee charged under Section 294. Section 298 provides thus :\n<\/p>\n<blockquote><p>     &#8220;A Board  by special resolution may<br \/>\n     and where\trequired  by  the  State<br \/>\n     Government\t shall,\t  make\tbye-laws<br \/>\n     applicable to the whole or any part<br \/>\n     of\t  the  municipality,  consistent<br \/>\n     with this\tAct and\t with any  rule,<br \/>\n     for  the\tpurpose\t  promoting   or<br \/>\n     maintaining the  health safety  and<br \/>\n     convenience of  the inhabitants  of<br \/>\n     the  municipality\t and   for   the<br \/>\n     furtherance      of       municipal<br \/>\n     administration under this Act.&#8221;<\/p><\/blockquote>\n<p>     Sub-section (2)  thereof, provides\t that in particular,<br \/>\nand  without  prejudice\t to  the  generality  of  the  power<br \/>\nconferred by  sub-section (1),\tthe Board of a municipality,<br \/>\nwherever situated,  may, in  the exercise of the said power,<br \/>\nmake any  bye-law described  in list  I and   the Board of a<br \/>\nmunicipality wholly,  or in  part situated  in a hilly tract<br \/>\nmay further  make, in  the exercise  of the  said power, any<br \/>\nbye-law described in list II below.\n<\/p>\n<p>     Clause (b)\t thereof  provides  for\t the  regulation  or<br \/>\nprohibition   of any  description of  traffic in the streets<br \/>\nwhere such regulation or prohibition appears to the Board to<br \/>\nbe necessary.  It would,  thus, be  seen that  the Board has<br \/>\nbeen empowered\tstatutorily to\tprescribe the fee for use of<br \/>\nthe  public   property\tvesting\t  in  or  belonging  to\t the<br \/>\nmunicipality. Even under the recent amendment brought by the<br \/>\nConstitution [73rd  Amendment] Act,  1992  which  came\tinto<br \/>\nforce w.e.f.  April  20,  1993,\t it  imposes  the  statutory<br \/>\nresponsibilities on  the  municipalities. Article 243 &#8211; p(d)<br \/>\ndefines &#8220;municipal  area&#8221; to  mean the territorial area of a<br \/>\nMunicipality  as   is  notified\t by  the  Governor.  Article<br \/>\n243(a)(i) envisages  that subject  to the  provisions of the<br \/>\nConstitution, the  Legislature of a State may, by law, endow<br \/>\nthe municipalities  powers and authority as may be necessary<br \/>\nto  enable   them  to  function\t as  institutions  of  self-<br \/>\ngovernment and\tsuch law  may  contain\tprovisions  for\t the<br \/>\ndevolution   of\t   powers    and    responsibilities\tupon<br \/>\nmunicipalities, subject to such conditions, as may specified<br \/>\ntherein, with  respect\tto  the\t preparation  of  plans\t for<br \/>\neconomic development  and social  justice .Entry  17 of\t the<br \/>\n12th Schedule provides for public amenities including street<br \/>\nlighting, parking  lots,  bus stops and public conveniences.<br \/>\nThus, the  Constitution enjoins\t the appropriate Legislature<br \/>\nto provide  for preparation  of\t the  plans    for  economic<br \/>\ndevelopment and\t social justice\t including power  to provide<br \/>\npublic amenities  including street  lighting, parking  lots,<br \/>\nbus stops  and public conveniences. On such public amenities<br \/>\nincluding  bus\t stops\t having\t  been\t provided   by\t the<br \/>\nmunicipalities, as  a is  statutory duty,  it is the duty of<br \/>\nthe user  thereof to  pay fee  for service  rendered by\t the<br \/>\nmunicipality. The  municipality had  prescribed the  minimum<br \/>\nfee to\tthe user  at the  rate of  Re. 0.75  per day or part<br \/>\nthereof, for  use of  any transport  vehicle,  as  mentioned<br \/>\nhereinbefore. The High Court is clearly in error in striking<br \/>\ndown the  demand of fee power holding that it is ultra vires<br \/>\ntheir power.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed, the  order of\t the<br \/>\nDivision Bench\tof the\tHigh Court  is set aside but, in the<br \/>\ncircumstances, without costs.\n<\/p>\n<p>IN C.A.
