Justice P.R.RAMACHANDRA MENON\n\n Dated :11\/08\/2010\n\n O R D E R\n               P.R.RAMACHANDRA MENON, J.\n                  -------------------------------------\n                  W.P.(C) No.25114 OF 2010\n                  -------------------------------------\n           Dated this the 11th day of August, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>                         ~~~~~~~~~~~<\/p>\n<p>      The petitioner is stated as aggrieved by the course<\/p>\n<p>pursued by the assessing authority with regard to the fixation of<\/p>\n<p>liability under Section 5 of the Kerala Building Tax Act, inspite<\/p>\n<p>of the clear mandate given by the appellate authority as per<\/p>\n<p>Ext.P6.\n<\/p>\n<\/p>\n<p>      2.   The case of the petitioner is that the building was<\/p>\n<p>originally constructed by the petitioner much previous to<\/p>\n<p>10.2.1992, which is the &#8216;appointed date&#8217; and the petitioner<\/p>\n<p>effected some additional constructions thereafter. This being<\/p>\n<p>the position, the tax liability, if at all any can only be as provided<\/p>\n<p>under Section 5(3), that is, in respect of the additional portion<\/p>\n<p>alone and not taking the entire building as a whole as provided<\/p>\n<p>under Section 5(4).\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25114\/2010              2<\/span><\/p>\n<p>     3.     In fact, the assessment finalised by the 3rd respondent<\/p>\n<p>was challenged by the petitioner by filing statutory appeal and<\/p>\n<p>after considering the merits involved, Ext.P4 assessment order<\/p>\n<p>and Ext.P5 demand notice were set aside by the appellate<\/p>\n<p>authority (2nd respondent) as per Ext.P6 order and the matter<\/p>\n<p>was remanded to the assessing authority to complete the<\/p>\n<p>assessment as provided under Section 5(3) of the Act. Pursuant<\/p>\n<p>to the    remand, the matter was considered by the assessing<\/p>\n<p>authority, who passed Ext.P7 order dated 17.6.2010, simply<\/p>\n<p>stating that on perusing the relevant records and after hearing<\/p>\n<p>the petitioner and also on conducting a site             inspection,<\/p>\n<p>absolutely no change was warranted with regard to the order<\/p>\n<p>already passed.       Accordingly, the earlier order was simply<\/p>\n<p>sustained casting the      liability upon the petitioner as it was<\/p>\n<p>originally fixed, which forms the subject matter of challenge in<\/p>\n<p>this Writ Petition.\n<\/p>\n<\/p>\n<p>     4.     Heard the learned Government Pleader as well.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25114\/2010           3<\/span><\/p>\n<p>     5.     Going by the materials on record, there need not be<\/p>\n<p>any second thought for this Court to arrive at s finding that the<\/p>\n<p>course pursued by the 3rd respondent\/assessing authority in<\/p>\n<p>passing Ext.P7 order is not correct or sustainable. A specific<\/p>\n<p>direction was given by the appellate authority in Ext.P6, as to the<\/p>\n<p>manner of assessment, stipulating that it shall be done as<\/p>\n<p>provided under Section 5(3) of the Act. Absolutely, no reference<\/p>\n<p>has been made by the assessing authority to the above provision<\/p>\n<p>and no finding has been arrived at, holding that the averment<\/p>\n<p>raised by the petitioner that the original construction was<\/p>\n<p>effected prior to the &#8216;appointed date&#8217; is wrong or that the entire<\/p>\n<p>construction has been effected after the &#8216;appointed date&#8217;, so as<\/p>\n<p>to sustain the assessment under Section (4).<\/p>\n<p>     6.     In the above circumstances, there is no other<\/p>\n<p>alternative, but to set aside Ext.P7. Accordingly, Ext.P7 is set<\/p>\n<p>aside and the 3rd respondent is directed to finalise the<\/p>\n<p>assessment as specifically ordered by the appellate authority<\/p>\n<p>vide Ext.P6 passing a &#8216;speaking order&#8217; with reference to the<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.25114\/2010            4<\/span><\/p>\n<p>relevant provisions of law. The 3rd respondent is also at liberty<\/p>\n<p>to call for the relevant records from the concerned authorities,<\/p>\n<p>including the local authority, if so necessitated. It is for the<\/p>\n<p>petitioner to furnish all the requisite materials to substantiate<\/p>\n<p>his contentions before the 3rd respondent.
