However, the<br \/>\nincident allegedly occurred on 13.01.2009 and pursuant to Section<br \/>\n41(1)(D) of the Code of Criminal Procedure, 1973, one chain came to<br \/>\nbe recovered from the petitioner by the police on 01.01.2010 and<br \/>\nwrongly implicated the petitioner in this case. It is further<br \/>\nsubmitted that the entire investigation is over and charge-sheet is<br \/>\nfiled and during the investigation, no Test Identification Parade was<br \/>\nconducted putting the petitioner in such parade. It is further<br \/>\nsubmitted that even during the course of investigation, the chain<br \/>\nrecovered by the police from the petitioner pursuant to Section<br \/>\n41(1)(D) of the Code of Criminal Procedure, 1973 was not shown to<br \/>\nfirst informant Pushpaben by the police. It is further submitted<br \/>\nthat the offence alleged against the petitioner is exclusively<br \/>\ntriable by the Court of learned JMFC. Therefore, it is submitted that<br \/>\nthe application may be allowed.\n<\/p>\n<p>5.\tPer<br \/>\ncontra, Mr LB Dabhi, learned APP representing the State vehemently<br \/>\nopposed this application and submitted that the serious offence is<br \/>\nalleged against the petitioner and from the petitioner, the chain was<br \/>\nrecovered and therefore, the involvement of the petitioner in the<br \/>\nincident is prima facie established. Therefore, it is submitted that<br \/>\nthe application may be rejected.\n<\/p>\n<p>6.\tHaving<br \/>\nconsidered the submissions advanced on behalf of both the sides and<br \/>\nconsidering the fact that in the FIR, the petitioner is not named as<br \/>\nan accused, however, after about 1 year from the date of the<br \/>\nincident, a chain came to be recovered from the petitioner by the<br \/>\npolice and further the fact that during the police investigation, no<br \/>\nattempt was made by the police to show the chain to the complainant<br \/>\nand further the fact that no Test Identification Parade was conducted<br \/>\nso also the fact that the offence alleged against the petitioner is<br \/>\ntriable by the Court of learned JMFC, this Court is of the opinion<br \/>\nthat the application deserves to be allowed and the petitioner should<br \/>\nbe released on bail.\n<\/p>\n<p>7.\tConsidering<br \/>\nthe submissions made on behalf of the parties and having regard to<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the petitioner is ordered to be released on bail in connection<br \/>\nwith Crime Register No. I 21 of 2009 registered at Madhavpura<br \/>\nPolice Station for the offence alleged against him in this<br \/>\napplication on his executing bond of Rs.5,000\/- (Rupees five thousand<br \/>\nonly) with one solvent surety of the like amount to the satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall,<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner.\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order and should co-operate the investigating officers;\n<\/p>\n<p>(d)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(e)\tnot<br \/>\nleave the local limits of State of Gujarat without the prior<br \/>\npermission of the concerned Trial Court;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nthe residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nTrial Court will be free to issue warrant or take appropriate action<br \/>\nin the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the Trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
