GOVERNMENT PLEADER for Respondent(s) : 2 -\n3. \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.C.UPADHYAYA\n\t\t\n\t\n\n \n\nDate\n: 25\/10\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpetitioner-lady detenu filed the present petition under Article 226<br \/>\n\tof the Constitution of India, challenging her detention pursuant to<br \/>\n\tthe detention order dated 06th July, 2010, which was<br \/>\n\texecuted on the same day, passed by the respondent Police<br \/>\n\tCommissioner, Ahmedabad City, by exercising the powers conferred<br \/>\n\tunder sub-section (2) of Section 3 of the Gujarat Prevention of Anti<br \/>\n\tSocial Activities Act, 1985 ( PASA Act , for short). The<br \/>\n\tpetitioner is  branded as  bootlegger .\n<\/p>\n<p>Heard<br \/>\n\tMr.C.B. Raval, learned Advocate for the petitioner and Ms.C.M. Shah,<br \/>\n\tlearned Assistant Government Pleader for the respondents.\n<\/p>\n<p>The<br \/>\n\tpetitioner came to be detained as  bootlegger  on her<br \/>\n\tinvolvement in four offences arising under the Bombay Prohibition<br \/>\n\tAct.\n<\/p>\n<p>It<br \/>\n\thas been submitted by the learned counsel for the petitioner that it<br \/>\n\tis a settled legal position that on registration of four offences,<br \/>\n\tno order of detention could have been passed, as petitioner<br \/>\n\tdetenu cannot be branded as  bootlegger . It has been further<br \/>\n\tsubmitted that the activities of the petitioner cannot be said to be<br \/>\n\tinjurious to the public health or public order. It has been further<br \/>\n\tsubmitted by the learned counsel for the petitioner that there is<br \/>\n\tgross delay in passing the order of detention.\n<\/p>\n<p>Per<br \/>\n\tcontra, Ms.C.M. Shah, learned Assistant Government Pleader<br \/>\n\trepresenting the respondents supported the detention order dated<br \/>\n\t06th July, 2010 passed by respondent Commissioner of<br \/>\n\tPolice, Ahmedabad City and submitted that before passing the<br \/>\n\tdetention order, the detention authority took into consideration all<br \/>\n\tthe relevant papers and after subjective satisfaction, the detention<br \/>\n\torder is passed and thus the detention order is legal and proper and<br \/>\n\tno interference in the said order is warranted and consequently the<br \/>\n\tpetition deserves dismissal.\n<\/p>\n<p>I<br \/>\n\thave gone through the grounds of detention and considered the<br \/>\n\tsubmissions advanced on behalf of both the sides.\n<\/p>\n<p>The<br \/>\n\tCourt is of the opinion that there is much substance in the<br \/>\n\targuments advanced by learned counsel for the petitioner. It is seen<br \/>\n\tfrom the grounds that a general statement has been made by the<br \/>\n\tdetaining authority that consuming liquor is injurious to health. In<br \/>\n\tfact, a perusal of the order passed by the detaining authority shows<br \/>\n\tthat the grounds which are mentioned in the order are in reference<br \/>\n\tto the situation of  law and order  and not  public order .<br \/>\n\tTherefore, on this ground, the subjective satisfaction of the<br \/>\n\tdetaining authority is vitiated on account of non-application of<br \/>\n\tmind and the impugned order, therefore, deserves to be quashed and<br \/>\n\tset aside.\n<\/p>\n<p>Except<br \/>\n\tthe general statement, there is no material on record which shows<br \/>\n\tthat the petitioner   detenu is carrying on illegal activities of<br \/>\n\tselling liquor or is engaged in such activity, which is harmful to<br \/>\n\tthe health of the public. In the case of ASHOKBHAI JIVRAJ @<br \/>\n\tJIVABHAI SOLANKI v\/s. POLICE COMMISSIONER, Surat, reported in 2001<br \/>\n\t(1) GLH 393, having considered the decision of the Hon&#8217;ble Apex<br \/>\n\tCourt in the case of Ram manohar Lohia v\/s. State of Bihar,<br \/>\n\treported in AIR 1966 SC 740, this Court held that the cases<br \/>\n\twherein the detention orders are passed on the basis of the<br \/>\n\tstatements of such witnesses fall under the maintenance of  law<br \/>\n\tand order  and not  public Order .\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention, the detaining authority must come to a definite<br \/>\n\tfindings that there is threat to the &#8216;public order&#8217; and it is very<br \/>\n\tclear that the present case would not fall within the category of<br \/>\n\tthreat to a public order. In that view of the matter, when the order<br \/>\n\tof detention has been passed by the detaining authority without<br \/>\n\thaving adequate grounds for passing the said order, cannot be<br \/>\n\tsustained and, therefore, it deserves to be quashed and set aside.\n<\/p>\n<p>In<br \/>\n\tthe result, this petition is allowed. The<br \/>\n\timpugned order of detention dated 06th<br \/>\n\tJuly, 2010 passed by the respondent-Commissioner of Police,<br \/>\n\tAhmedabad City, is<br \/>\n\thereby quashed and set aside. The detenu is ordered to be set at<br \/>\n\tliberty forthwith, if not required in any other case. Rule is made<br \/>\n\tabsolute accordingly.
