                  learned    counsel      for   the   appellant,   Sri<\/p>\n
                  Dhurendra Kumar, who appears on behalf of sole<\/p>\n
                  respondent\/claimant on M.A. 697 of 2009 as well<\/p>\n
                  as Interlocutory Application No. 2638 of 2010<\/p>\n
                  filed for impleading National Insurance Company<\/p>\n
                  as proposed respondent and I.A. No. 7583 of<\/p>\n
                  2009, which was filed for condoning the delay.<\/p>\n
                            Interlocutory Application i.e. I.A. No.<\/p>\n
                  7583 of 2009 was filed for condoning the delay<\/p>\n
                  of seven days in filing the appeal.<\/p>\n
                            In view of grounds set forth in the<\/p>\n
                  limitation petition, delay in filing the appeal<\/p>\n
                  is condoned and Interlocutory Application No.<\/p>\n
                  7583 of 2009 stands allowed.\n<\/p>\n
                            On Interlocutory Application No. 2638<\/p>\n
                  of 2010, Sri Ashok Priyadarshi, learned counsel<\/p>\n
                  for   National       Insurance      Company\/proposed
\n                       2<\/span><\/p>\n
respondent, has argued that since the appeal<\/p>\n
was   filed      at       belated    stage,       the    prayer       for<\/p>\n
impleading        National           Insurance          Company        as<\/p>\n
respondent is liable to be rejected.<\/p>\n
           I have heard Sri Hemendra Prasad Singh,<\/p>\n
learned counsel for the appellant on merit of<\/p>\n
the case.\n<\/p>\n
           The    present           appeal       has    been        filed<\/p>\n
against an order which was passed under Section<\/p>\n
140   of   the    Motor       Vehicle        Act,      whereby,       the<\/p>\n
learned Motor Vehicle Accident Claim Tribunal,<\/p>\n
Vaishali at Hajipur (hereinafter referred to as<\/p>\n
‘Tribunal’)       had       allowed       the    petition       of   the<\/p>\n
claimant for payment of interim compensation of<\/p>\n
Rs. 50,000\/-\n<\/p>\n
           The    appellant          is     the       owner    of    the\n\noffending vehicle.\n\n           Learned          counsel        for    the         appellant\n\nsubmits,        that        the      learned          Tribunal       has\n\nincorrectly           decided       that        the     vehicle       in\n\n<\/pre>\n
question, at the time of accident, was being<\/p>\n
driven     by     the       son     of     the    owner        of    the<\/p>\n
vehicle\/appellant.\n<\/p>\n
           It         was      submitted              that       during<\/p>\n
investigation it has come that the vehicle in<\/p>\n
question was being driven by the driver who was
\n                  3<\/span><\/p>\n
having proper licence.\n<\/p>\n
        It was further submitted that before<\/p>\n
passing the interim order the learned Tribunal<\/p>\n
was required to conduct an enquiry which has<\/p>\n
not been done, and accordingly, the order in<\/p>\n
question, is liable to be set aside.<\/p>\n
        Learned            counsel            for           the<\/p>\n
respondent\/claimant submits that F.I.R. itself<\/p>\n
indicates    that    at   the   time   of     accident       the<\/p>\n
vehicle in question was being driven by the son<\/p>\n
of the owner\/appellant, who was not authorised<\/p>\n
to drive the commercial vehicle. At the time of<\/p>\n
hearing the petition filed under Section 140 of<\/p>\n
the Motor Vehicle Act learned Tribunal was not<\/p>\n
required to ask the claimant to establish with<\/p>\n
all evidence that accident had occurred due to<\/p>\n
gross negligence and fault of the owner, but<\/p>\n
only on prima facie satisfaction the Tribunal<\/p>\n
was required to pass order.\n<\/p>\n
        It     was    further    submitted          that    the<\/p>\n
claimant has also filed Claim Petition under<\/p>\n
Section 166 of the Motor Vehicle Act vide Claim<\/p>\n
Case No. 130 of 2010 which is still pending.<\/p>\n
Accordingly,    it   was   argued      that    the    interim<\/p>\n
compensation amount can be adjusted at the time<\/p>\n
of   final   adjudication       of     the    claim        case.
\n                     4<\/span><\/p>\n
Accordingly,        it        was     submitted         that      the<\/p>\n
appellant\/owner          would        be     at    liberty          to<\/p>\n
participate in the main claim petition and may<\/p>\n
take any stand in the said claim petition.<\/p>\n
           In the present case, on 2.12.2007, son<\/p>\n
of the claimant died in an accident by                             the<\/p>\n
commercial vehicle of the appellant. After the<\/p>\n
accident,    an     F.I.R.      was     lodged,        and   in    the<\/p>\n
F.I.R.     the    informant           made    statement,          that<\/p>\n
vehicle in question at the time of accident was<\/p>\n
being driven by the son of the owner of the<\/p>\n
vehicle,    whereas,          since    it    was   a    commercial<\/p>\n
vehicle    it    was     required       to    be   driven      by   a<\/p>\n
driver having licence for driving the vehicle.<\/p>\n
Accordingly, a petition under Section 140 of<\/p>\n
the Motor Vehicle Act was initially filed for<\/p>\n
interim compensation and the learned Tribunal<\/p>\n
after     hearing       the    parties       and   prima       facie<\/p>\n
satisfied that owner himself was at fault has<\/p>\n
passed      the impugned order and directed the<\/p>\n
owner of the vehicle\/appellant to pay interim<\/p>\n
compensation of Rs. 50,000\/-. Subsequently, as<\/p>\n
submitted by learned counsel for respondent, a<\/p>\n
Claim Petition under Section 166 of the Motor<\/p>\n
Vehicle Act has been filed vide Claim Case No.<\/p>\n
130 of 2010 and the same is still pending.
\n                             5<\/span><\/p>\n
                     The    court      is   of     the      opinion    that\n\n         appellant    can       lead   evidence        to    dispute    the\n\n<\/pre>\n
         claim of the sole respondent in the claim case<\/p>\n
         filed under Section 166 of Motor Vehicle Act,<\/p>\n
         and at this stage, it is not appropriate to<\/p>\n
         interfere      with the impugned order which has<\/p>\n
         been passed for immediately compensating the<\/p>\n
         family of the deceased.\n<\/p>\n
                  After going through the impugned order<\/p>\n
         the court is of the opinion that there is no<\/p>\n
         error,   and      accordingly,          the     order   impugned<\/p>\n
         requires no interference.\n<\/p>\n
                  The appeal stands rejected.\n<\/p>\n<\/p>\n
