No.28912 of 2011\n            Monika Bedi, D\/o Prem Kumar Bedi, R\/o 1404-B Wingh\n            Galaxy Hights, Link Road, Near Bangour Nagar Signal (above\n            ICICI Bank), Goregaon West, Mumbai.\n                                                        ....Petitioner.\n                                       Versus\n                                 The State of Bihar\n                                      -----------\n<\/pre>\n<p>2   15.09.2011            Petitioner   has   challenged   the   order   dated<\/p>\n<p>                 03.01.2011 passed by Chief Judicial Magistrate, Banka in<\/p>\n<p>                 connection with Belhar P.S. Case No.150 of 2010 whereby<\/p>\n<p>                 and where under petitioner along with others has been<\/p>\n<p>                 summoned to face trial for an offence punishable under<\/p>\n<p>                 Sections 171(H) and 188 of the I.P.C.\n<\/p>\n<p>                          It has been submitted on behalf of the petitioner<\/p>\n<p>                 that neither petitioner happens to be a candidate nor she<\/p>\n<p>                 had applied for permission. She only came in support of<\/p>\n<p>                 the independent candidate Rajkishore Prasad @ Pappu<\/p>\n<p>                 Yadav. Then submitted that petitioner was not aware with<\/p>\n<p>                 the fact nor was informed by the administration that the<\/p>\n<p>                 time allotted for propagating the candidature of Rajkishore<\/p>\n<p>                 Prasad @ Pappu Yadav was in between 12:30 to 1:00 P.M.<\/p>\n<p>                 and as that time elapsed, therefore, she was not permitted<\/p>\n<p>                 to convene and attend the people. So submitted that in<\/p>\n<p>                 absence of the aforesaid administrative lapse petitioner<\/p>\n<p>                 cannot be held accountable. It has further been submitted<\/p>\n<p>                 that none of the Sections where under petitioner has been<\/p>\n<p>                 summoned is found to be applicable.\n<\/p>\n<p><span class=\"hidden_text\">                        2<\/span><\/p>\n<p>               At the other hand the State opposed.\n<\/p>\n<p>               It is evident from own submission of the<\/p>\n<p>     petitioner as well as from the written report that petitioner<\/p>\n<p>     had landed at Project Girls High School, Belhar after the<\/p>\n<p>     time allotted to the candidate on whose behalf she<\/p>\n<p>     addressed a rally. The time slot was allotted to the<\/p>\n<p>     candidate on his request for enabling the petitioner to<\/p>\n<p>     address the rally. Admittedly, petitioner had addressed the<\/p>\n<p>     rally after the allotted time slot; therefore, she had violated<\/p>\n<p>     the order. Ignorance of law is no excuse. Therefore, it was<\/p>\n<p>     incumbent upon her to have inquired from candidate<\/p>\n<p>     whether   she   was   within   time   slot   allotted   by   the<\/p>\n<p>     administration. With regard to application of particular<\/p>\n<p>     Section, the cognizance will not command rather it will<\/p>\n<p>     ensue on the basis of the charge and so, for the present<\/p>\n<p>     petitioner should not have any grievance for having a<\/p>\n<p>     particular Section visualizing in the order by which she<\/p>\n<p>     has been summoned to face trial.\n<\/p>\n<p>               With the aforesaid finding I do not see it a fit case<\/p>\n<p>     to entertain the petition and is accordingly dismissed.<\/p>\n<p>                               (Aditya Kumar Trivedi, J.)<br \/>\nPN\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Monika Bedi vs The State Of Bihar on 15 September, 2011 IN THE HIGH COUR T OF JUDICATURE AT PATNA Cr.
