Justice M.SASIDHARAN NAMBIAR\n\n Dated :06\/01\/2011\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             Crl.M.C.No.5085 of 2010\n            --------------------------\n\n                      ORDER\n<\/pre>\n<p>    Petitioners  are   the   accused   and   first<\/p>\n<p>respondent, the  defacto  complainant  in  C.C.No.<\/p>\n<p>410\/2010  on the  file  of  Judicial  First  Class<\/p>\n<p>Magistrate&#8217;s Court-III, Thrissur, taken cognizance<\/p>\n<p>for the offences under Sections 341, 323, 324 and<\/p>\n<p>448 read with Section 34 of Indian Penal Code on<\/p>\n<p>Annexure-A2 final report. This petition is filed<\/p>\n<p>under Section 482 of Code of Criminal Procedure to<\/p>\n<p>quash  the  proceedings  contending   that  entire<\/p>\n<p>disputes with the first respondent, the defacto<\/p>\n<p>complainant, who  is  the  injured,  were  settled<\/p>\n<p>amicably and consequent to the settlement, it is<\/p>\n<p>not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>    2. First respondent appeared through a counsel<\/p>\n<p>and along with the petitioners filed Crl.M.Appl.<\/p>\n<p>No.8296\/2010 for compounding the offences stating<\/p>\n<p><span class=\"hidden_text\">CRMC 5085\/10             2<\/span><\/p>\n<p>that entire disputes with the petitioners were<\/p>\n<p>settled amicably and therefore, he does not wish to<\/p>\n<p>proceed with the case further and hence, the case<\/p>\n<p>is to be quashed.\n<\/p>\n<p>    3.      Learned counsel  appearing   for    the<\/p>\n<p>petitioners, first respondent and learned Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>    4. An offence under Section 324 of Indian Penal<\/p>\n<p>Code is not compoundable and hence, permission to<\/p>\n<p>compound the offence, as sought for, cannot be<\/p>\n<p>granted.\n<\/p>\n<p>    5. As held by the Apex Court in <a href=\"\/doc\/1442974\/\">Madan Mohan<\/p>\n<p>Abbot v. State of Punjab<\/a> (2008 (3) KLT 19), when<\/p>\n<p>the offences alleged against the petitioners are<\/p>\n<p>purely personal in nature and first respondent has<\/p>\n<p>settled     all  the disputes  amicably  with   the<\/p>\n<p>petitioners and first respondent has no subsisting<\/p>\n<p>grievance against the petitioners, it is not in the<\/p>\n<p>interest of justice to continue the prosecution.<\/p>\n<p>Except the offence under Section 324 of Indian<\/p>\n<p><span class=\"hidden_text\">CRMC 5085\/10              3<\/span><\/p>\n<p>Penal     Code,   all   the   other   offences    are<\/p>\n<p>compoundable.\n<\/p>\n<p>     6. Prosecution case is that in furtherance of<\/p>\n<p>the  common    intention, all  the  petitioners,   on<\/p>\n<p>6.6.2010 at about 11.30 p.m., trespassed into the<\/p>\n<p>veranda of the residential house of the first<\/p>\n<p>respondent    and  wrongfully   restrained  him  and<\/p>\n<p>inflicted injuries on him by beating with an iron<\/p>\n<p>pipe and thereby committed the offences. Offences<\/p>\n<p>alleged     are  purely  personal  in   nature.   The<\/p>\n<p>compounding petition filed by the first respondent<\/p>\n<p>with the petitioners establishes that they have<\/p>\n<p>settled all the disputes. In such circumstances, it<\/p>\n<p>is not in the interest of justice to continue the<\/p>\n<p>prosecution.\n<\/p>\n<p>     Petition is allowed.
