                                    “CR”\n<\/p>\n
1.The petitioner, then a member of a panchayat<\/p>\n
 committee,  submitted   his  resignation  to   the<\/p>\n
 Secretary of that panchayat on 28.4.2009. After<\/p>\n
 that, in the evening of that day, he made Ext.P2<\/p>\n
 to  the   Secretary  of   the  Panchayat,  to   be<\/p>\n
 forwarded to the State Election Commission for<\/p>\n
 decision in terms of Section 155(3) of the Kerala<\/p>\n
 Panchayat Raj Act, 1994, for short, the “Act”, as<\/p>\n
 a dispute. He thereby essentially took the stand<\/p>\n
 that he resiles from the tendered resignation on<\/p>\n
 the ground that the resignation was submitted by<\/p>\n
 him in a disturbed state of mind. By the impugned<\/p>\n
 communication,  the  Commission   has  refused  to<\/p>\n
 entertain the petitioner’s request on the ground<\/p>\n
 that the resignation had taken effect and a<\/p>\n
 dispute   regarding  the  resignation   admittedly<\/p>\n
 made, though allegedly in a disturbed state of<\/p>\n

 mind,     cannot  be  entertained.   This   is  under<\/p>\n
 challenge.\n<\/p>\n<\/p>\n
2.Heard the learned counsel for the petitioner and<\/p>\n
 the learned standing counsel for the Commission.<\/p>\n
3.Sub-section 3 of Section 155       provides that if<\/p>\n
 any dispute regarding any resignation arises, it<\/p>\n
 shall be referred to the State Election Commission<\/p>\n
 for decision and its decision thereon shall be<\/p>\n
 final.      Rule 5  of  the    Kerala  Panchayat Raj<\/p>\n
 (Resignation     of  President,    Vice-President or<\/p>\n
 Members) Rules, 2000, hereinafter, the “Rules”,<\/p>\n
 provides the mode of settlement of such disputes.<\/p>\n
 Rule 5(1) states that any person having a dispute<\/p>\n
 regarding the resignation of the President or<\/p>\n
 Vice-President or the Member may, within fifteen<\/p>\n
 days from the date on which the resignation is<\/p>\n
 deemed to have taken effect, prefer a petition<\/p>\n
 before the State Election Commission for its<\/p>\n
 decision     and the  decision    of  the  Commission<\/p>\n
 thereon shall be final. Rule 3 prescribes the mode<\/p>\n

 and form for making and tendering resignation.<\/p>\n
 Apart from sub-rule 5 of Rule 3, which provides<\/p>\n
 that the resignation shall take effect from the<\/p>\n
 date on which the resignation letter is received<\/p>\n
 by the Secretary, sub-section 1 of Section 155 of<\/p>\n
 the     Act   categorically   provides  that   the<\/p>\n
 resignation shall take effect from the date on<\/p>\n
 which it is received by the Secretary and the<\/p>\n
 Secretary shall immediately report the fact to the<\/p>\n
 President    and the   State   Election Commission.<\/p>\n
 Therefore, the effect of resignation commences<\/p>\n
 from the delivery of the resignation letter to the<\/p>\n
 Secretary. All that the Secretary has to do is to<\/p>\n
 acknowledge receipt of the resignation. That it<\/p>\n
 has been so done in the case in hand, is not in<\/p>\n
 dispute. Even if the word ‘date’ in sub-section 1<\/p>\n
 of Section 155 could be looked at from different<\/p>\n
 angles, it cannot be treated as from the end of<\/p>\n
 the day on which the resignation is tendered.<\/p>\n
 This is because the effect of resignation is not<\/p>\n
 legislatively made to depend on its acceptance by<\/p>\n
 any person or authority or to be controlled by any<\/p>\n

 subsequent   event. Hence,   a  resignation  by  a<\/p>\n
 President    or Vice-President or  Members   of  a<\/p>\n
 panchayat in terms of sub-section 1 of Section 155<\/p>\n
 of the Act takes effect from the receipt of the<\/p>\n
 resignation by the Secretary of the panchayat<\/p>\n
 either in person in terms of that sub-section or<\/p>\n
 by the mode, through post, as provided in sub-<\/p>\n
 section 2 of Section 155.\n<\/p>\n<\/p>\n
4.For the aforesaid reasons, the impugned decision<\/p>\n
 of the Commission stands.\n<\/p>\n<\/p>\n
5.Having concluded as above and no dispute being<\/p>\n
 raised on the afore-noted facts, the impugned<\/p>\n
 decision cannot be faulted merely on the ground of<\/p>\n
 absence of pre-decisional hearing. That plea is<\/p>\n
 also rejected.\n<\/p>\n
 In the result, this writ petition is dismissed.<\/p>\n
