Rai, learned counsel for the petitioner in<br \/>\nsupport of this petition and Sri B.P. Singh Dhakray assisted<br \/>\nby Sri H.P. Dube, learned counsel appearing for the Power<br \/>\nCorporation.\n<\/p>\n<p>As short affidavits are also exchanged annexing with copy of<br \/>\nrelevant documents\/ orders, we are having basic facts, with<br \/>\nthe consent,writ petition is being finally disposed of.\n<\/p>\n<p>The challenge in this petition is the order dated 8.7.2010<br \/>\nissued by the Sub Divisional Officer (Annexure- 10 to the<br \/>\nwrit petition) by which petitioner has been informed that his<br \/>\nelectricity connection has been disconnected and as the<br \/>\ngate of the premises was closed, at the time of inspection<br \/>\nreading could not be taken. In the concluding portion of the<br \/>\norder it is mentioned that the electricity connection has been<br \/>\ndisconnected on account of non-payment of huge amount<br \/>\ni.e. amount of Rs.33,66,478\/- .\n<\/p>\n<p>Learned counsel for the petitioner submits that the aforesaid<br \/>\nexercise of disconnection by the respondent officials is<br \/>\ntotally, arbitrary, illegal and is in violation of the principles of<br \/>\nnatural justice.\n<\/p>\n<p> Submission of the learned counsel for the petitioner is that<br \/>\nfor the purposes of disconnection, there is a procedure so<br \/>\nprovided in the Electricity Act, 2003. His further submission<br \/>\nis that on 12.8.2006 ,checking team visited the petitioner&#8217;s<br \/>\npremises and prepared an illegal and false inspection<br \/>\nreport ,contrary to the prescribed procedure and without<br \/>\nascertaining and narrating the true facts, abruptly<br \/>\ndisconnected electric supply of the petitioner.\n<\/p>\n<p>Sri Dhakray opposed the submissions of the learned counsel<br \/>\nfor the petitioner and raised various preliminary objections.\n<\/p>\n<p>Sri Dhakray submits that being aggrieved by the Theft<br \/>\nAssessment order dated 26.8.2006 for a sum of Rs.<br \/>\n29,83,807\/- petitioner filed writ petition being Civil Misc. Writ<br \/>\nPetition No. 49123 of 2006 before this Court and this Court<br \/>\nvide order dated 6.9.2006 disposed of the writ petition finally<br \/>\nwith a direction that &#8216;in case the petitioner deposits a sum of<br \/>\nRs. 5 lakh with the respondent no. 2 and files an appeal<br \/>\nagainst the order dated 26.8.2006 ( Annexure &#8211; 7to the writ<br \/>\npetition) within a month, the same shall be decided with in<br \/>\none month thereafter. Till the decision of the aforesaid<br \/>\nappeal, no coercive steps shall be taken against the<br \/>\npetitioner and the electricity connection of the petitioner shall<br \/>\nbe restored within a week from the date of aforesaid<br \/>\ndeposit&#8217;.\n<\/p>\n<p>Electricity Department, aggrieved by the order dated<br \/>\n6.9.2006 approached the Hon&#8217;ble Supreme Court by means<br \/>\nof filing Special Leave Petition (C) No. 17816 of 2006 in<br \/>\nwhich Hon&#8217;ble Apex Court stayed the operation of the order<br \/>\ndated 6.9.2006 passed in Writ Petition No. 49123 of 2006 on<br \/>\n10.11.2006.\n<\/p>\n<p>Petitioner again approached to this Hon&#8217;ble Court by means<br \/>\nof filing Civil Misc. Writ Petition No. 227 of 2007 despite<br \/>\n earlier stay order dated 10.11.2006 passed by Hon.Apex<br \/>\nCourt in S.L.P.(C) No. 17810 of 2006 and this Court again in<br \/>\nWrit Petition No. 227 of 2007 passed final order dated<br \/>\n8.1.2008 and disposed of the Writ Petition with a direction<br \/>\nthat &#8216;in the circumstances if the petitioner has deposited<br \/>\none third of the assessment bill dated 26.8.2006, the<br \/>\nappellate authority , respondent no.1 is directed to<br \/>\ndispose of the appeal of the petitioner expeditiously ,if<br \/>\npossible within a period of two months from the date a<br \/>\ncertified copy of this order is filed before him by any of<br \/>\nthe parties. Until the disposal of the appeal, no recovery<br \/>\nin pursuance of final assessment bill dated 26.8.2006<br \/>\nshall be made against the petitioner. It is made clear that<br \/>\nin case, there are other arrears on account of electricity<br \/>\ndues, the same can be recovered by respondents in<br \/>\naccordance with law&#8217;.\n<\/p>\n<p>Further submission of the learned counsel for the power<br \/>\ncorporation is that since the petitioner has not approached<br \/>\nthis court with clean hands and obtained order from this<br \/>\nCourt by concealing material facts and has also not<br \/>\ncomplied with the order passed by Hon&#8217;ble Apex Court in<br \/>\nS.L.P. (C) No. 17810 of 2006, respondents filed Contempt<br \/>\nPetition No. 73 of 2010 before Hon&#8217;ble Apex Court and the<br \/>\nHon&#8217;ble Apex Court issued contempt notices to the petitioner<br \/>\non 5.7.2010. It has further been submitted that the contempt<br \/>\nproceedings have been drawn against the petitioner for<br \/>\nviolating the order of Hon&#8217;ble Apex Court 10.11.2006 passed<br \/>\nin Special Leave Petition.\n<\/p>\n<p>From the facts noted above, it is clear that the first order of<br \/>\nthis Court is dated 06.09.2006 passed in Civil Misc. Writ<br \/>\nPetition No. 49123 of 2006 in which it was directed that the<br \/>\npetitioner shall deposit a sum of Rs. 5,00,000\/- with power<br \/>\ncorporation and may file an appeal against the order dated<br \/>\n26.08.2006 within a month and that the appeal shall be<br \/>\ndecided within one month thereafter and the further direction<br \/>\nthat till the decision of the aforesaid appeal no coercive<br \/>\n steps shall be taken against the petitioner and that the<br \/>\nelectricity connection shall be restored within a week from<br \/>\nthe date of deposit of Rs. 5,00,000\/-. was stayed by the<br \/>\nApex Court in Special Leave Petition (C) No. 17816 of 2006<br \/>\nvide order dated 10.11.2006. The record reveals that the<br \/>\npetitioner then moved an application dated 16.11.2006<br \/>\nbefore the Apex Court for further direction and for<br \/>\nclarification of the interim order dated 10.11.2006 and<br \/>\nprayed as under:-\n<\/p>\n<p>(A) Clarify and modify the order dated 10.11.2006 passed by this<br \/>\nHon&#8217;ble Court to the effect that respondents\/applicants may not<br \/>\ndisconnect the electricity connection pursuant to the said stay order<br \/>\ngranted by this Hon&#8217;ble Court;\n<\/p>\n<p>(B) during the pendency of SLP no recovery, pursuant to the said order<br \/>\ngranted by this Hon&#8217;ble Court may be made effective as the<br \/>\nrespondents\/applicants have already deposited Rs. 5,00,000\/- equal to<br \/>\n1\/3rd which can be recovered from the respondents\/applicants under<br \/>\nSection 126 of the Act, for the purpose of filing appeal under Section<br \/>\n127 of the said Act before the Commissioner;\n<\/p>\n<p>(C) direction may be given to commissioner Agra Division, Agra to<br \/>\ndispose of appeal dated 16.10.2006 as early as possible.\n<\/p>\n<p>It is admitted that in spite of the above aforesaid application<br \/>\ndated 16.11.2006 no modification\/clarification in the order<br \/>\nhas so far been made by Hon&#8217;ble The Apex Court. It appears<br \/>\nthat without bringing the said application dated 16.11.2006<br \/>\n( for modification of Apex Court&#8217;s order dated 10.11.2006) to<br \/>\nthe notice of the Managing Director of the power corporation<br \/>\nthe petitioner made a representation that he is ready and<br \/>\nwilling to deposit 1\/3rd of the amount due and that the<br \/>\nelectricity connection may be restored. The petitioner then<br \/>\nsucceeded in getting the reconnection on 28.02.2007. This<br \/>\norder for reconnection was apparently in the teeth of the<br \/>\norder of Hon&#8217;ble the Apex Court passed on 10.11.2006. The<br \/>\ncounter affidavit filed on behalf of power corporation reveals<br \/>\nthat after the order of Hon&#8217;ble the Apex Court issuing<br \/>\ncontempt notice on 05.07.2010, the Executive Engineer<br \/>\n passed an order for the disconnection of the electricity and it<br \/>\nwas under the directions of the Executive Engineer that the<br \/>\nSub Divisional Officer disconnected electricity and wrote the<br \/>\nimpugned letter dated 08.07.2010 to the Executive Engineer<br \/>\nthat the electricity has been disconnected.\n<\/p>\n<p>From the facts and circumstances noted above it is clear<br \/>\nthat all the subsequent developments can be said to have<br \/>\ntaken place after the order of Hon&#8217;ble The Apex Court in<br \/>\nSpecial Leave Petition dated 10.11.2006.\n<\/p>\n<p>That being so, we are not satisfied by the submissions made<br \/>\non behalf of petitioner that all the questions which are<br \/>\ninvolved in the present case being question of fact can be a<br \/>\nmatter of a scrutiny straightway by this Court specially when<br \/>\ninitial cause of action and intervention\/stay by this court is<br \/>\nengaging attention of Hon&#8217;ble the Supreme Court.\n<\/p>\n<p>Submission of the learned counsel for the petitioner in<br \/>\nrespect of illegal disconnection of the electricity can always<br \/>\nbe a matter of argument before the appellate authority itself<br \/>\nwhere the appeal of the petitioner alongwith stay application<br \/>\nis pending and it is for the appellate authority to pass<br \/>\nappropriate order in accordance with law. The averments<br \/>\nabout pendency of appeal and stay application is clearly<br \/>\nstated in para -24 of the writ petition itself.\n<\/p>\n<p>The petitioner may lay his grievances before the appellate<br \/>\nauthority with regard to the disconnection of his electricity in<br \/>\nthe pending appeal or may file appeal against the fresh<br \/>\ndisconnection order if the law so permits.\n<\/p>\n<p>Various decisions on which reliance has been placed by the<br \/>\nlearned counsel for the petitioner are as under:-\n<\/p>\n<p>(i) M\/s Stan Commodities Pvt. Kanpur and another, 2006(2) AWC 1735.\n<\/p>\n<p>(iii) Municipal Corporation of Delhi Vs. Ajanta Iron and Steel Company<br \/>\n(Pvt.) Ltd.1990(2) SCC 659.\n<\/p>\n<p>(iv) Swastic industries Vs. Maharashtra State Electricity Board (1997) 9<br \/>\nS.C.C. 465<\/p>\n<p>(v) Primier Ice Factory Vs.The Commercial Manager Kanpur Electricity<br \/>\nSupply Admn. and another,AIR1988 Allahabad, 8.\n<\/p>\n<p>(vi) Narendra Singh Bhasinand Com.Vs.S.N. R. Sudhakar and others, (2004) 7 SCC\n<\/p>\n<p>219.<\/p>\n<p>(xi) Arunima Baruch Vs. Union of India and others ,(2007) 6 SCC ,120.\n<\/p>\n<p>These decisions have no application to the facts of the<br \/>\npresent case.\n<\/p>\n<p>It is a case where petitioner has not come to this Court with<br \/>\nclean hands and inspite of stay granted by Apex Court on<br \/>\n10.11.2006 to the order of this Court dated 26.8.2006 and<br \/>\nthereafter moving clarification application dated 16.11.2006,<br \/>\nhaving not succeeded in getting any result, succeeded in<br \/>\nfiling IInd Writ Petition and got some order from the<br \/>\ncompetent authority and thus on all these facts, petitioner dis<br \/>\nentitled himself from any consideration on merits of the<br \/>\nmatter.\n<\/p>\n<p>On all these facts and details noted above, we are not<br \/>\ninclined to grant any relief in this writ petition as the<br \/>\n petitioner has an alternative efficacious remedy available to<br \/>\nhim and at the same to pursue his cause for which he has<br \/>\nalready moved before Apex Court.\n<\/p>\n<p>Writ petition is accordingly dismissed.\n<\/p>\n<p>Order Date :- 20.7.2010<br \/>\nn.u.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court M\/S Gupta Ice Factory vs Dvvnl And Others on 20 July, 2010 Court No. &#8211; 36 Case :- WRIT &#8211; C No. &#8211; 41149 of 2010 Petitioner :- M\/S Gupta Ice Factory Respondent :- Dvvnl And Others Petitioner Counsel :- B.C.
