No.23979 of 2010\n                  CHANDAN KUMAR SINGH, SON OF LATE SURESH SINGH\n                                            Versus\n                                     STATE OF BIHAR\n                                          -----------\n<\/pre>\n<p>06   27.01.2011             Heard learned counsel for the petitioner as well as<\/p>\n<p>                   learned Public Prosecutor for the State assisted by learned counsel<\/p>\n<p>                   for the informant.\n<\/p>\n<p>                               It would appear from perusal of the record that vide<\/p>\n<p>                   order no. 03 dated 05.10.2010 an explanation was called for from<\/p>\n<p>                   the Superintendent of Police, Begusarai to this effect as to what<\/p>\n<p>                   steps he has taken with regard to one of the persons named in the<\/p>\n<p>                   First Information Report. In compliance of the aforesaid order,<\/p>\n<p>                   Superintendent of Police, Begusarai vide his letter no. 198\/L-Cell<\/p>\n<p>                   dated 08.11.2010 has reported that the investigation of the case was<\/p>\n<p>                   taken over by Crime Investigation Department on 10.11.2007 as<\/p>\n<p>                   C.I.D. controlled case by orders of D.I.G\/C.I.D, Patna vide memo<\/p>\n<p>                   no. 175\/C dated 10.11.2007 passed under provision of Section<\/p>\n<p>                   410(B) (ii) of Bihar Police Manual. Furthermore, the Superintendent<\/p>\n<p>                   of Police, Begusarai has reported that as per supervision note of<\/p>\n<p>                   Dy.S.P, C.I.D, Bihar, Patna, recommendation was made to submit<\/p>\n<p>                   charge sheet against six persons, namely, Chandan Kumar Singh,<\/p>\n<p>                   Nandan Kumar Singh, Mukesh Singh, Anil Mehto, Ramchandra<\/p>\n<p>                   Thakur and Amarnath Choudhary and the aforesaid direction was<\/p>\n<p>                   complied with at the district level. So far as the case of First<\/p>\n<p>                   Information Report named accused is concerned, it appears that the<\/p>\n<p>                   investigation in respect of aforesaid accused, namely, Surajbhan<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>          Singh is still pending. It is surprisingly enough that the First<\/p>\n<p>          Information Report was lodged on 08.11.2007 and the C.I.D. took<\/p>\n<p>          the charge of investigation on 10.11.2007 but up till now the C.I.D.<\/p>\n<p>          could not come to any conclusion in respect of First Information<\/p>\n<p>          Report named accused, namely, Surajbhan Singh.<\/p>\n<p>                      Let a report be called for from D.I.G\/C.I.D, Patna in<\/p>\n<p>          respect of present status of the case of First Information Report<\/p>\n<p>          named accused Surajbhan Singh, who has been shown as named<\/p>\n<p>          accused in Town Begusarai P.S. Case No. 360 of 2007.
