JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/02\/2011  \n \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;Your<br \/>\nLordships be pleased to issue appropriate writ,<br \/>\norder or direction and be further pleased to:\n<\/p>\n<p>(A)\tAdmit<br \/>\nthis petition.\n<\/p>\n<p>(B)\tDirect<br \/>\nRespondents herein to sanction first higher grade of pay while<br \/>\nkeeping in view the date of his joining service 22.9.1988 and grant<br \/>\nher 1st Higher Grade of Pay w.e.f. 22.9.1997 with all<br \/>\nother consequential benefits.\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing ad final disposal of this petition, Your Lordships<br \/>\nbe pleased to direct respondents to decide pending representation of<br \/>\nthe petitioner dated 7.1.2010 and 22.4.2010 and pass appropriate<br \/>\norders on her claim in interest of justice.\n<\/p>\n<p>(D)\tGrant<br \/>\nsuch other and further reliefs deemed just and proper in the facts<br \/>\nand circumstances of this case.&#8221;\n<\/p>\n<p>2.<br \/>\nMr.Hasit H. Joshi, learned counsel for the petitioner has submitted<br \/>\nthat the petitioner is not getting higher pay scale, which has been<br \/>\ngranted to her juniors and in spite of representations having been<br \/>\nmade to respondent No.3, no response has been given to the petitioner<br \/>\nso far.\n<\/p>\n<p>3.\tAt<br \/>\nthis stage, Mr.Hasit H. Joshi, learned counsel for the petitioner<br \/>\nstates that the interest of justice would be met, if the petitioner<br \/>\nis permitted to make a fresh representation to Joint Director of<br \/>\nEduction (East), Office of the Commissioner of Mid-Day Meal Scheme<br \/>\nand Schools (respondent No.2), who may be directed to consider and<br \/>\ndecide the same in a time-bound manner.\n<\/p>\n<p>4.\tUpon<br \/>\nthe above statement being made by the learned counsel for the<br \/>\npetitioner, the following order is passed :\n<\/p>\n<p>\tThe<br \/>\npetitioner is permitted to make a fresh representation to respondent<br \/>\nNo.2 within a period of three weeks from today.\n<\/p>\n<p>\tIf<br \/>\nthe representation is made within the stipulated period of time,<br \/>\nrespondent No.2 shall consider and decide the same, in accordance<br \/>\nwith law, and preferably within a period of three months from the<br \/>\ndate of receipt of the representation.\n<\/p>\n<p>\tIt<br \/>\nis clarified that while passing this order, the Court has not entered<br \/>\ninto the merits of the case.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms.\n<\/p>\n<p>\tNotice<br \/>\nis discharged.
