Uchcha     Nyayalaya     (Khand     Nyaypeeth     ko    Appeal)\nAdhiniyam, 2005 arises from the order of the learned Single Judge\npassed in W.P. No.1732\/2011, dated 25-01-2011 dismissing the\nwrit petition of the appellant against his order of transfer.\n       It appears that the appellant was earlier transferred from\nInsemination Centre, Sihore to Veternianry Dispensary, Kuhdia,\nDistrict-Harda, vide order dated 4-5-2010 being aggrieved by\nwhich he made a representation on 7-5-2010 to the authority\nconcerned.       Consequently, the respondents considering the<\/pre>\n<p>representation of the appellant modified the same vide order dated<br \/>\n11-6-2010, a copy whereof is marked as Annexure-P\/4 ,<br \/>\ntransferring him to Veterinary Dispensary, Nimoda in District-<br \/>\nSehore itself. Thereafter, the appellant again made a representation<br \/>\nagainst the aforesaid modified order of transfer considering which<br \/>\nthe respondents, by the impugned order dated 4-9-2010, have<br \/>\nwithdrawn the order dated 11-6-2010 whereby he had been<br \/>\ntransferred within the Sehore district, as a result of which the initial<br \/>\norder dated 7-5-2010 is revived. Being aggrieved, the petitioner<br \/>\nhas filed the aforesaid writ petition against the order dated<br \/>\n4-9-2010.\n<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>      Admittedly, the impugned order has been passed on the<br \/>\npetitioner&#8217;s representation and, therefore, he has only himself to<br \/>\nblame. The submissions of the petitioner against the impugned<br \/>\norder only relate to violation of the transfer policy which alone<br \/>\ncannot be a ground for interference with the order of transfer. It is<br \/>\nwell settled in law that transfer is an incidence of service. Which<br \/>\nemployee should be posted where, is a matter for the appropriate<br \/>\nauthority to decide until and unless the transfer is vitiated by<br \/>\nmalafide or is made in violation of any statutory provisions, the<br \/>\nCourt cannot interfere with the order of transfer. [See: <a href=\"\/doc\/220487\/\">Union of<br \/>\nIndia and Others vs. S.L. Abbas,<\/a> (1993)4 SCC 357]. Similarly in<br \/>\n<a href=\"\/doc\/1398944\/\">Public Services Tribunal Bar Association vs. State of U.P. and<\/a><br \/>\nanother, (2003) 4 SCC 104, once again dealing with the scope of<br \/>\njudicial review in the matter of transfer, Supreme Court reiterated<br \/>\nthat transfer is an incidence of service and normally should not be<br \/>\ninterfered with by the Court. If any administrative guidelines<br \/>\nregarding transfer of an employee are violated, at best the same<br \/>\nconfers the right on the employee to approach the higher authorities<br \/>\nfor redressal of their grievance. Transfer made contrary to policy<br \/>\ncan also not be interfered with.\n<\/p>\n<p>      In the case in hand the appellant has not questioned the order<br \/>\non the ground of violation of any statutory provision or on the<br \/>\nground of malafide. It is made clear that in case the petitioner<br \/>\nseeks restoration of the modified order of transfer dated 11-6-2010,<br \/>\nhe may approach the authority by filing a representation. It needs<br \/>\nno emphasis to state that the same shall be considered and decided<br \/>\nby the concerned authority expeditiously, in accordance with law.\n<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>            In view of the above, we do not find any reason to differ with<br \/>\n      the view taken by the learned Single Judge.
