It is governed by the.   ~  <\/p>\n<p>Employment (Standing Orders)  tie&#8217;<\/p>\n<p>undisputed fact that the en:q;r1oye&#8221;r.V_ got the <\/p>\n<p>standing orders at AI}1&#8217;16}{1,1I&#8217;\u20ac5-P.;:Vi&#8217;t:fi&#8217;Vf&#8221;):I&#8217;}1.  \ufb02habour<br \/>\nCommissioner, who is  on 3.97.1989.<br \/>\nClause 20 of eeftifged   &#8220;tt1e Company<br \/>\nrelates te   reads thus:\n<\/p>\n<p>&#8230;&#8230; \/V _  employee shail<\/p>\n<p> &#8220;1iab1eV&#8217;i.to transferred at any time<\/p>\n<p> ffom&#8217;Vf&#8217;-._&#8221;the._  &#8216; &#8216;uI1it\/faetorw office.<\/p>\n<p>* VVestabiish1&#8217;I:e:itt_&#8217;of &#8220;the companv located<\/p>\n<p>etm\u00e9where 7 _  India or from one<\/p>\n<p>&#8216; -V _ dej}a1ftInent&#8221;to another within the same<\/p>\n<p>  unit]\ufb01actoifgr\/of\ufb01ce\/establishment or<\/p>\n<p> from one job of sixnilar nature and<\/p>\n<p>. &#8221;.., &#8221;e:ap\u00e91e_ity to an another gob of same<\/p>\n<p>Z   and capacity from one job to<\/p>\n<p>eziioifller similar job or from one shi\ufb02 to<\/p>\n<p> &#8216;~m:-{other shift, provided such a trarzsfer<\/p>\n<p>.  does not affect his norma} wages. Any<\/p>\n<p>V -&#8216; refusal to accept a transfer as above<\/p>\n<p>wili be treated as miseozzduct as per<br \/>\nRule 31.2.1949.&#8221;\n<\/p>\n<p>6. The standing orders Certi\ufb01ed by the<\/p>\n<p> &#8220;eeI&#8221;tifyi11g o\ufb02ieer on 3.7.1989 was subject matter of<\/p>\n<p>\\w<\/p>\n<p>appeal \ufb02ied by the trade union. The appeilate amhoriiiy<\/p>\n<p>rejected the appeal as {$316 barreci Vid\ufb01 order dated<\/p>\n<p>. 6\/4\/1996. Thereafter an application was filed <\/p>\n<p>modi\ufb01cation of certain clauses in the, certi\ufb01e_(_1-  .<\/p>\n<p>erders of the em}:-layer before the   &#8221; &#8221; &#8216;V<\/p>\n<p>same is registered in SOA\/CR-11&#8217; <\/p>\n<p>affordilig opportunity to \ufb01r$t_,:vL&#8221;i*c\u00a7po\ufb01dL\u00a2rxt_V'&#8221;lto<\/p>\n<p>object t0 the proposed modi\ufb01ca\ufb01\ufb01x\u00e9. d\u00a3_certaijI;v.c1a{1ses of<\/p>\n<p>the certi\ufb01ed Standing {jrr1e1\u00a7s,.v.3_\u00a7;\u00a7d\u00e9\u00a7fV&#8217;p\u00abiz1Z\ufb02t\u00e9:&lt;i 30.10.1999<\/p>\n<p>was passed by  G\ufb02icer by modifying Certain<\/p>\n<p>clausas. Ii1\u00bb.\u00a7G   20 \u00a7)\u20ac&quot;3I&quot;t3iI1 to transfer, the<\/p>\n<p> V.  ahpve are orderad to be \u00e9eleted fram<\/p>\n<p> of the Standing orders as the same are<\/p>\n<p>1:1(i&#039;\u00a3. Therefore, it is held by the certifying effzcer<\/p>\n<p>&#039;   the emgiloyer cannct make any such provision to its<\/p>\n<p> . &#039;4 Standing Orders which is  ded uncier the Act.<\/p>\n<p><span class=\"hidden_text\">12<\/span><\/p>\n<p>the impugned order passed by him. It is <\/p>\n<p>contended by the learned counsel t;hat_;=  <\/p>\n<p>assig\ufb01ng reasons in the impugned..m_&#8217;derg H   &#8221; &#8221;<\/p>\n<p>Single Judge a\ufb01irmed the order &#8216;;  7-I <\/p>\n<p>authority.\n<\/p>\n<p>10. Tho same is not<\/p>\n<p>  xthe model Standing orders \ufb01amad by the<\/p>\n<p>&#8220;\u00abStaf&lt;:$&quot;~{}oven1m\u20acnt in exercise of its power under Section<\/p>\n<p>   sub&#8211;Se&lt;:ti0n (2) clause (13) of the Act.
