2.      In\u00a0this\u00a0case,\u00a0the\u00a0Appellant\u00a0had,\u00a0in\u00a0his\u00a0application\u00a0dated\u00a012\u00a0October\u00a02008,\u00a0<\/p>\n
requested \u00a0 the \u00a0 CPIO \u00a0 for \u00a0 a \u00a0 number \u00a0 of \u00a0 information \u00a0 regarding \u00a0 the \u00a0 wrongful\u00a0<\/p>\n
withdrawal\u00a0of\u00a0money\u00a0from\u00a0his\u00a0Saving\u00a0account.\u00a0In\u00a0his\u00a0reply\u00a0dated\u00a029\u00a0November\u00a0<\/p>\n
2008,\u00a0the\u00a0CPIO\u00a0offered\u00a0some\u00a0clarification\u00a0against\u00a0some\u00a0of\u00a0the\u00a0queries\u00a0while\u00a0<\/p>\n
also\u00a0observing\u00a0that\u00a0some\u00a0other\u00a0queries\u00a0did\u00a0not\u00a0amount\u00a0to\u00a0information\u00a0at\u00a0all.\u00a0Not\u00a0<\/p>\n
satisfied\u00a0with\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0CPIO,\u00a0the\u00a0Appellant\u00a0preferred\u00a0an\u00a0appeal\u00a0on\u00a01\u00a0<\/p>\n
December\u00a02008.\u00a0The\u00a0Appellate\u00a0Authority\u00a0disposed\u00a0of\u00a0the\u00a0appeal\u00a0in\u00a0his\u00a0order\u00a0<\/p>\n

\n dated\u00a07\u00a0January\u00a02009\u00a0in\u00a0which\u00a0he\u00a0endorsed\u00a0the\u00a0reply\u00a0of\u00a0the\u00a0CPIO.\u00a0It\u00a0is\u00a0this\u00a0<\/p>\n
order\u00a0which\u00a0the\u00a0Appellant\u00a0has\u00a0challenged\u00a0in\u00a0his\u00a0second\u00a0appeal.<\/p>\n
3.      We \u00a0 heard \u00a0 this \u00a0 case \u00a0 through \u00a0 videoconferencing. \u00a0 The \u00a0 Appellant \u00a0 was\u00a0<\/p>\n
present\u00a0in\u00a0the\u00a0Mau\u00a0studio\u00a0of\u00a0the\u00a0NIC\u00a0whereas\u00a0the\u00a0Respondents\u00a0were\u00a0present\u00a0in\u00a0<\/p>\n
the\u00a0Mumbai\u00a0studio.\u00a0We\u00a0heard\u00a0their\u00a0submissions.\u00a0The\u00a0facts\u00a0of\u00a0the\u00a0case\u00a0relate\u00a0to\u00a0<\/p>\n
the\u00a0alleged\u00a0fraudulent\u00a0withdrawal\u00a0of\u00a0money\u00a0from\u00a0the\u00a0account\u00a0of\u00a0the\u00a0Appellant.\u00a0It\u00a0<\/p>\n
appears\u00a0the\u00a0Bank\u00a0have\u00a0already\u00a0reported\u00a0the\u00a0matter\u00a0to\u00a0the\u00a0police\u00a0and\u00a0it\u00a0is\u00a0being\u00a0<\/p>\n
investigated. \u00a0 The \u00a0 Respondents \u00a0 submitted \u00a0 during \u00a0 the \u00a0 hearing \u00a0 that \u00a0 no\u00a0<\/p>\n
responsibility\u00a0has\u00a0however\u00a0been\u00a0fixed\u00a0within\u00a0the\u00a0Bank\u00a0so\u00a0far\u00a0on\u00a0any\u00a0individual\u00a0<\/p>\n
officer\u00a0of\u00a0employee\u00a0for\u00a0this\u00a0act\u00a0of\u00a0fraud,\u00a0and\u00a0therefore,\u00a0they\u00a0are\u00a0not\u00a0in\u00a0a\u00a0position\u00a0<\/p>\n
to \u00a0 indicate \u00a0 the \u00a0 name \u00a0 of \u00a0 any \u00a0 particular \u00a0 officer \u00a0 or \u00a0 employee \u00a0 who \u00a0 might \u00a0 be\u00a0<\/p>\n
responsible\u00a0for\u00a0this.\n<\/p>\n<\/p>\n
4.      The\u00a0Appellant\u00a0was\u00a0specially\u00a0exercised\u00a0over\u00a0the\u00a0fact\u00a0that\u00a0in\u00a0spite\u00a0of\u00a0the\u00a0<\/p>\n
Bank\u00a0admitting\u00a0that\u00a0a\u00a0fraud\u00a0had\u00a0been\u00a0committed\u00a0on\u00a0his\u00a0account,\u00a0it\u00a0did\u00a0not\u00a0make\u00a0<\/p>\n
good\u00a0his\u00a0loss.\u00a0Besides,\u00a0he\u00a0also\u00a0complained\u00a0that\u00a0the\u00a0Bank\u00a0had\u00a0tried\u00a0to\u00a0implicate\u00a0<\/p>\n
him\u00a0in\u00a0some\u00a0case\u00a0and\u00a0that\u00a0his\u00a0life\u00a0was\u00a0under\u00a0threat.\u00a0The\u00a0Respondents\u00a0on\u00a0the\u00a0<\/p>\n
other\u00a0hand\u00a0submitted\u00a0that\u00a0such\u00a0allegations\u00a0were\u00a0baseless\u00a0and\u00a0had\u00a0no\u00a0merit\u00a0and\u00a0<\/p>\n
the\u00a0Bank\u00a0had\u00a0done\u00a0nothing\u00a0of\u00a0the\u00a0kind.\u00a0The\u00a0dispute\u00a0between\u00a0the\u00a0customer\u00a0and\u00a0<\/p>\n
the\u00a0 Bank\u00a0 is\u00a0 something\u00a0 which\u00a0 cannot\u00a0 be \u00a0 resolved\u00a0 by\u00a0 us\u00a0 under\u00a0 the\u00a0 Right\u00a0 to\u00a0<\/p>\n
Information\u00a0 (RTI) \u00a0 Act. \u00a0 However,\u00a0 if \u00a0 the \u00a0 Bank\u00a0 has\u00a0 admitted \u00a0 that \u00a0 a \u00a0 fraud \u00a0 had\u00a0<\/p>\n
occurred\u00a0and\u00a0money\u00a0was\u00a0wrongly\u00a0withdrawn,\u00a0it\u00a0might\u00a0consider\u00a0compensating\u00a0<\/p>\n
the \u00a0 customer\u00a0 without\u00a0 waiting \u00a0 for \u00a0 the \u00a0 final \u00a0 results \u00a0 of \u00a0 the \u00a0 police \u00a0 investigation\u00a0<\/p>\n
which, \u00a0 by \u00a0 its \u00a0 very \u00a0 nature, \u00a0 could \u00a0 be \u00a0 indefinitely \u00a0 long \u00a0 involving \u00a0 possible\u00a0<\/p>\n
prosecution\u00a0in\u00a0courts\u00a0of\u00a0law.\n<\/p>\n

 5.      As\u00a0far\u00a0as\u00a0providing\u00a0the\u00a0information\u00a0is\u00a0concerned,\u00a0we\u00a0do\u00a0not\u00a0find\u00a0if\u00a0there\u00a0is\u00a0<\/p>\n
anything\u00a0more\u00a0the\u00a0CPIO\u00a0can\u00a0provide\u00a0since\u00a0most\u00a0of\u00a0the\u00a0queries\u00a0of\u00a0the\u00a0Appellant\u00a0<\/p>\n
are \u00a0 in \u00a0 the \u00a0 nature \u00a0 of \u00a0 comments\u00a0 on \u00a0 the \u00a0 functioning \u00a0 of \u00a0 the \u00a0 Bank\u00a0 rather \u00a0 than\u00a0<\/p>\n
seeking \u00a0 any \u00a0 information \u00a0 within \u00a0 the \u00a0 meaning \u00a0 of \u00a0 Section \u00a0 2(f) \u00a0 of \u00a0 the \u00a0 Right \u00a0 to\u00a0<\/p>\n
Information \u00a0 (RTI) \u00a0 Act. \u00a0 The \u00a0 only \u00a0 information \u00a0 which \u00a0 could \u00a0 be \u00a0 provided \u00a0 is\u00a0<\/p>\n
regarding\u00a0the\u00a0complaints\u00a0received\u00a0about\u00a0this\u00a0Branch\u00a0during\u00a0the\u00a0last\u00a010\u00a0years.\u00a0<\/p>\n
The \u00a0 Respondents \u00a0 submitted \u00a0 that \u00a0 collecting \u00a0 the \u00a0 information \u00a0 regarding \u00a0 the\u00a0<\/p>\n
complaints\u00a0 for\u00a0 a\u00a0 period\u00a0 of\u00a010\u00a0 years\u00a0would\u00a0be\u00a0 a\u00a0 very\u00a0 voluminous\u00a0and\u00a0time\u00ad<\/p>\n
consuming \u00a0 task \u00a0 which \u00a0 would \u00a0 disproportionately \u00a0 divert \u00a0 the \u00a0 resources \u00a0 of \u00a0 the\u00a0<\/p>\n
Bank. \u00a0 Therefore, \u00a0 keeping \u00a0 this \u00a0 submission \u00a0 in \u00a0 mind, \u00a0 we \u00a0 direct \u00a0 the \u00a0 CPIO \u00a0 to\u00a0<\/p>\n
provide\u00a0to\u00a0the\u00a0Appellant\u00a0within\u00a010\u00a0working\u00a0days\u00a0from\u00a0receipt\u00a0of\u00a0this\u00a0order,\u00a0the\u00a0<\/p>\n
photocopy\u00a0of\u00a0relevant\u00a0pages\u00a0of\u00a0the\u00a0complaint\u00a0register\u00a0of\u00a0the\u00a0Branch\u00a0for\u00a0a\u00a0period\u00a0<\/p>\n
