Kodekar,  learned APP appears and waives service of notice of<br \/>\nRule on behalf of  the respondent &#8211; State of Gujarat.\n<\/p>\n<p>3\tHaving<br \/>\nregard to the facts of the case,  the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p><span class=\"hidden_text\">4\t<\/span><\/p>\n<p>The applicant &#8211;  convict prisoner, who vide judgment and order dated<br \/>\n16.1.2010,  rendered in Sessions Case No. 14 of 2007, by the learned<br \/>\nAdditional Sessions Judge,  Junagadh, has been convicted for the<br \/>\noffence punishable under Sections 302  etc. of the Indian Penal Code<br \/>\nand sentenced to  imprisonment for life,  has filed this Application,<br \/>\nthrough jail authority, praying  to enlarge him  on temporary bail,<br \/>\nfor a period of  30 days,  to enable him to make necessary<br \/>\narrangements to repay the loan taken by  his wife Shitalben from<br \/>\nState Bank of India against the agricultural crops.\n<\/p>\n<p>5\tWe<br \/>\nhave considered the submission made by Mr. R.C. Kodekar, learned APP<br \/>\nfor the respondent &#8211; State of Gujarat.  We have also perused<br \/>\nthe averments made in the application and the supporting document<br \/>\nthat form part  of the application.  We have also gone through the<br \/>\njail remarks sheet  forwarded by the jail authority  along with the<br \/>\napplication.\n<\/p>\n<p>6\tUpon<br \/>\nperusal  of the jail remarks sheet, we find that the applicant has<br \/>\nundergone   total period of  imprisonment of  4 years, 1 month and 15<br \/>\ndays and during the said period  he has neither  enjoyed any<br \/>\ntemporary bail nor any furlough leave.   There is no jail punishment<br \/>\nand his  jail  conduct is good.  Besides this, upon perusal of the<br \/>\nnotice dated 21.12.2010  issued by the State Bank of India, it is<br \/>\nseen that his wife has taken  the  loan of Rs. 88,532\/-  against the<br \/>\nagricultural crops and, therefore, he was asked to repay the said<br \/>\nloan amount  along with interest. In view of the aforesaid, if the<br \/>\napplicant is released on temporary bail for a period of 15 days from<br \/>\nthe date of his actual release, the same would meet the ends of<br \/>\njustice.\n<\/p>\n<p>7\tFor<br \/>\nthe foregoing reasons,  the Application succeeds in part.<br \/>\nAccordingly,  it is partly allowed. The applicant  &#8211; convict prisoner\n<\/p>\n<p>&#8211; MULUBHAI<br \/>\nMARKHIBHAI<br \/>\nis ordered to be released on  temporary bail  for a period of 15 days<br \/>\n from the date of  his   actual  release on executing a personal bond<br \/>\nof Rs. 5,000\/- before the Jail Authority on usual terms and<br \/>\nconditions.  The applicant shall  surrender to the jail authority<br \/>\n on completion of  15 days  from the date of his release  without<br \/>\nfail.
