BASANT, J.\n\n             ````````````````````````````````````````````````````\n                       B.A. No. 227 OF 2008\n             ````````````````````````````````````````````````````\n            Dated this the 16th day of January, 2008\n\n                               O R D E R\n<\/pre>\n<p>           Application for anticipatory bail.               Petitioners face<\/p>\n<p>indictment in a prosecution for offences punishable, inter alia,<\/p>\n<p>under Section 324 IPC.             All offences are bailable.            The<\/p>\n<p>petitioners were enlarged on bail at the crime stage. But later,<\/p>\n<p>after the final report was filed, the petitioners could not<\/p>\n<p>appear.     Coercive processes are issued against the<\/p>\n<p>petitioners.  The petitioners find such processes chasing<\/p>\n<p>them.\n<\/p>\n<p>      2.   The learned counsel for the petitioners submits that<\/p>\n<p>the petitioners are absolutely innocent. Their absence earlier<\/p>\n<p>was not wilful or deliberate.          The petitioners are willing to<\/p>\n<p>surrender before the learned Magistrate and seek regular bail.<\/p>\n<p>But they apprehend that their application for bail may not be<\/p>\n<p>considered    by    the     learned       Magistrate        on    merits, in<\/p>\n<p>accordance with law and expeditiously. They, therefore, pray<\/p>\n<p>BA.227\/08<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>that directions under Section 482 Cr.P.C. may be issued to<\/p>\n<p>the learned Magistrate to release the petitioners on bail when<\/p>\n<p>they appear and apply for bail.\n<\/p>\n<p>      3.   After the decision in Bharat Chaudhary and<\/p>\n<p>another Vs. State of Bihar [AIR 2003 SC 4662], it is now trite<\/p>\n<p>that powers under section 438 Cr.P.C. can be invoked in<\/p>\n<p>favour of a person who apprehends arrest in execution of a<\/p>\n<p>non-bailable warrant issued by a court in a pending<\/p>\n<p>proceedings.     But even for that, sufficient and satisfactory<\/p>\n<p>reasons must be shown to exist. I am not persuaded, in the<\/p>\n<p>facts and circumstances of this case, that any such reasons<\/p>\n<p>exist.\n<\/p>\n<p>      4.   It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which they could not earlier appear<\/p>\n<p>before the learned Magistrate. I find absolutely no reason to<\/p>\n<p>assume that the learned Magistrate would not consider the<\/p>\n<p>application for bail to be filed by the petitioners on merits, in<\/p>\n<p>BA.227\/08<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>accordance with law and expeditiously. Every court must do<\/p>\n<p>the same.    No special or specific directions appear to be<\/p>\n<p>necessary. Sufficient general directions have been issued in<\/p>\n<p>Alice George Vs. Deputy Superintendent of Police [2003<\/p>\n<p>(1) KLT 339].\n<\/p>\n<p>     5.
