D. Trivedi, learned counsel for the applicants and<br \/>\nperusing the contents of this application and more particularly<br \/>\nparagraph No.5 in the application, which is supported by<br \/>\nuncontroverted affidavit of the applicants, this Court is of the<br \/>\nopinion that the delay is sufficiently explained and the delay<br \/>\ndeserves to be condoned.\n<\/p>\n<p>4.\tFor<br \/>\nthe foregoing reasons, this application is allowed. The delay of 244<br \/>\ndays caused in preferring First Appeal is condoned. There shall be no<br \/>\norder as to costs. Rule is made absolute, accordingly.\n<\/p>\n<p>[<br \/>\nJ. C.
