1.\tPetitioner
\nhas preferred this petition under Articles 226 and also 227 of the
\nConstitution of India with following prayers:\n<\/p>\n
Your
\n\tLordship may be pleased to issue any appropriate writ or direction
\n\teither in the nature of mandamus or in the nature of certiorari or
\n\tany other appropriate writ or direction and please to by way of such
\n\tdirection please direct the state government and\/or Collector, Patan
\n\tto grant NA permission without insisting of any premium amount as
\n\tpremium to land was already paid and land was converted from new to
\n\told tenure in accordance with law subject to fulfillment of other
\n\tapplicable laws.\n<\/p>\n
Pending
\n\tadmission and final disposal of the Petition by way of interim
\n\trelief, direct the state to issue suitable direction to Collector,
\n\tPatan to consider\/grant NA application of the petitioner subject to
\n\tfulfillment of other law subject to final outcome of petition,
\n\twithout insisting of payment of premium, as premium was already paid
\n\tand conversion from new to old tenure was already;\n<\/p>\n
To
\n\tgrant any other appropriate and just relief\/s;\n<\/p>\n
2.\tThis
\nCourt on 04.10.2011 passed following order:\n<\/p>\n
\tHeard learned
\n\tadvocate for the petitioner.\n<\/p>\n
\tLearned advocate for
\n\tthe petitioner has invited this Court’s attention to the
\n\tcommunication dated 23.10.2008 emanating from the office of the
\n\tCollector and signed by the Collector addressed to the State through
\n\tRevenue Department indicating therein unequivocally that the stand
\n\tof the State referred to in paragraph no.4 thereof is not
\n\tappropriate, in view of the fact that the premium on the land had
\n\talready been paid and the purpose was only for extension of time for
\n\tcomplying with the condition of non agricultural permission.  This
\n\tcommunication had remained dormant.  The notice, therefore, came to
\n\tbe issued by learned advocate on behalf of the petitioner on
\n\t26.07.2011 to which in a mechanical way the Section Officer of the
\n\tRevenue Department has reacted and sent a reply that the notice and
\n\tproceedings are sent to Collector for doing needful.\n<\/p>\n
\tThis, in my view, is
\n\tnot the approach commensurate with the duty cast upon the State when
\n\tthe concerned District Collector has unequivocally opined in his
\n\tcommunication dated 23.10.2008 and when the notice was sent by
\n\tlearned advocate addressed to the Secretary of the Revenue
\n\tDepartment, then naturally Collector is not the authority to decide
\n\tor sent any reply to the petitioner and in my view, therefore, the
\n\tappropriate authority i.e. State who should have replied to the
\n\tcommunication in form of notice sent by learned advocate for the
\n\tpetitioner.\n<\/p>\n
\tThe notice,
\n\ttherefore, is required to be issued for final disposal, returnable
\n\ton 14.10.2011.  It is expected of the State to file reply, if any,
\n\tclarifying as to on what ground the communication of the Collector
\n\tdated 23.10.2008 is not acted upon.  Direct service is permitted.”\n<\/p>\n
2.1\tThus,
\nit was expected from the State to file reply clarifying as to on what
\nground communication dated 23.10.2008 is not acted upon or
\nunfortunately, no reply is filed on behalf of the State. The reply,
\nwhich is filed is filed by one Jitendrakumar Joshi, Mamlatdar,
\nSiddhpur, who naturally could not have explained the enigmatic silent
\non the part of the State, qua the contentions and reasoning reflected
\nin the communication dated 23.10.2008 as
\nwell as the premium of Rs.82,550\/- has been paid on 13.01.1984.
\nThe order of this Court dated 04.10.2011, whereon this Court
\ncategorically directed the State to file reply and give
\njustification, if any for not accepting the District Collector’s
\nletter dated 23.10.2008.\n<\/p>\n
3.\tIn
\nview of this, I am of the considered view that admission of the
\nmatter would not serve the end of justice in any manner. The matter
\nwhich is now in a very narrow compass is required to put to an end by
\ngiving directions. While disposing of this petition, following
\ndirections are issued;\n<\/p>\n
\t“The
\nSecretary, Revenue Department – respondent No.1 shall address
\nhimself the issue in question in light of the observations and
\nreasonings reflected in the communication dated 23.10.2008 referred
\nto in the order of this Court dated 04.10.2011 and communicated his
\nreasons for issuance of letter dated 13.08.2008. In case, if there
\nexist no justification for levying the premium again, in light of the
\nobservations and reasonings of District Collector reflected in the
\nletter dated 23.10.2008. The appropriate decision with regard to
\ngranting N.A. be taken. The entire exercise of examining the issue at
\nthe end of Revenue Secretary be undertake and complete within a
\nperiod of 30 days from the date of receipt of the order.  In case, if
\nthere is an adverse order passed by the authority, it would be open
\nfor the petitioner to challenge the same before the appropriate
\nauthority including filing of writ petition.”\n<\/p>\n
4.\tWith
\nthese directions, petition is disposed of. Notice is discharged.
\nThere shall be no order, as to costs. Direct Service is permitted.\n<\/p>\n
