This  pre&#8217;fe_r1&#8217;ed seeking quashing of the<br \/>\norder dated 11.1.07.1191861151111i&#8217;;~A&#8217;.ir~id.V11 in MFA No.702 of 1977<br \/>\nand MFA ;jNO.e574io&#8217;f end the award dated 11.07.1986 in<\/p>\n<p>1\\\/iFA1iNO_,i;702\ufb01iiiiOef  and MFA No.574 of 1978 passed by this<\/p>\n<p> C0u1;1~&amp;1i$&#8211;_pei*&#8217;  and D and for other consequential<\/p>\n<p>  i   <\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>3. The petitioner is a Corporation established under the<\/p>\n<p>provisions of the Road Transport Corporation <\/p>\n<p>Lands bearing Sy.Nos.15\/2 measuring 4 acres <\/p>\n<p>guntas, Sy.No.15\/3 measuring 3  &#8221; and&#8217; <\/p>\n<p>belonging to respondent No.2 and <\/p>\n<p>acres and 9 guntas belonging to respondent&#8221; allgsituated<br \/>\nat Jangamarakoppa Villageigof  by<br \/>\nthe State for the benefit of  purpose of<br \/>\nestablishing a   staff quarters.\n<\/p>\n<p> belliissued under Section 4( 1)<br \/>\non  by Section 6 noti\ufb01cation.\n<\/p>\n<p>Possession&#8217; ofgthlei  taken on 27.02.1960. The Land<br \/>\n  an award on 25.03.1963 awarding<\/p>\n<p>comp&#8217;en&#8217;s&#8217;atio&#8217;1&#8217;i7of\/~ per acre in respect of Sy.Nos.15\/4<\/p>\n<p> Rs.iI;50{):\u00ab&gt;&#8217;lper acre in respect of the other survey<\/p>\n<p> Re&#8217;spondents&#8211;2 and 3 and other claimants filed an<\/p>\n<p> under Section 18(1) of the Land Acquisition Act<\/p>\n<p> reference to the Court of the Civil Judge for<\/p>\n<p>i,<\/p>\n<p>granted under Section 23(l)(a) as well as the enhancenie-nt of<\/p>\n<p>solatiurn. Even when the said application was taker; <\/p>\n<p>consideration the petitioner was not madeV__ga&#8221;s_ <\/p>\n<p>Petitioner was not heard. However, _Ath;o&#8217;s_e &#8216;7Aa.n_1er1d_nieAnt&#8217;<\/p>\n<p>applications were allowed and the_&#8221;benefi_tdof <\/p>\n<p>given to these claimants. Thereafter, the clairnahtsiinitiated<br \/>\nexecution proceedings in  oiiflH1\u00e986. On<br \/>\ncoming to know of  filed an<br \/>\napplication   allowed by the<br \/>\nexecuting     by the said order,<br \/>\nclaimants pfeigredicoi\u00e9iifie&#8217;;-r\u00ab:.si262 of 1987 and CRP No.5263<br \/>\nof 1987&#8242; h-e&#8217;I&#8217;ore  revision petitions were allowed.<br \/>\n jieipplieationlslliiwere dismissed by order dated<\/p>\n<p>22.(l7&#8243;._1&#8217;9z?;$.&#8221;&#8221;4ill&#8221;;.,ii_is&#8217;ii.i&#8217;,r1\u00e9ar1y after fourteen years from that date<\/p>\n<p> present  &#8216;petition is filed challenging the award passed<\/p>\n<p> H.ighi&#8217;VCourt on the ground that the petitioner was not<\/p>\n<p> party to the proceedings and therefore, the<\/p>\n<p>ppetitiolner has a right to challenge the said award. The<\/p>\n<p>%\/<\/p>\n<p>Petition No.235 of 1986. In the said proceed.ingsh,:&#8221;p:&#8217;-the<\/p>\n<p>bene\ufb01ciary made an attempt to irnplead itself  <\/p>\n<p>successful before the executing court?&#8217; &#8216;&#8221;Wh&#8217;en.;thei.revision<\/p>\n<p>petitions were allowed by this Courti&#8217;s__etti_ng <\/p>\n<p>order, the beneficiary stood exposed&#8217;\u00bbto the._eXec:utioniiiof the i<\/p>\n<p>said decree. It was awareuof   award.\n<\/p>\n<p>Under those  cast on the<br \/>\nbeneficiary to approaitziiythyilsp Court&#8217;:&#8217;see&#8217;l%in.%;appropriate reliefs<br \/>\nwithout any    fourteen long years<br \/>\nthe petitioner&#8221;__v  t_}1_tl~liiiiilrr1atter. No worthwhile<br \/>\nexplanation  these last fourteen years, the<br \/>\nertecution\u00e9 case  riotiyet  The beneficiary has not paid<br \/>\n payable in one lurnpsum. It has<\/p>\n<p>been&#8221;   :a&#8221;&#8221;typical judgment debtor in installments<\/p>\n<p>and that&#8221;&#8216;by&#8221;~-iiitsc\u00e9lf will not confer any right to challenge the<\/p>\n<p>._order &#8220;foL1_rtee&#8217;n years after the said order.
