AGP\nfor Respondent: 1, \nMR UM SHASTRI for Respondents : 2 - 4. \nNone\nfor Respondent: 5, \n=================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE S.R.BRAHMBHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/07\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tpetitioners have approached this Court under Article 226 of the<br \/>\n\tConstitution of India challenging the order dated 19\/4\/2011 passed<br \/>\n\tby District  Development Officer, District Panchayat, Godhra,<br \/>\n\tRespondent no.2 herein above, ordering penalty as mentioned in the<br \/>\n\tsaid order, holding that the land in question was not used for the<br \/>\n\tpurpose for which it was permitted to be used.  Learned advocate for<br \/>\n\tthe petitioners have invited this Court&#8217;s attention to the order<br \/>\n\tdated 14\/8\/2006 wherein petitioners were specifically permitted to<br \/>\n\tcarry out the activities of manufacturing bricks. The said order<br \/>\n\tcontains conditions, where  condition no. 7 in terms provides that<br \/>\n\tthe said permission is for five years, and would therefore inure<br \/>\n\ttill 31\/7\/2010. Thus, mentioning of 31\/7\/2010 was due to<br \/>\n\tinadvertence on the part of the concerned as five years period would<br \/>\n\tover by 31\/7\/2011 and hence petitioners were well within their right<br \/>\n\tto continue their activities of brick manufacturing.  Learned<br \/>\n\tadvocate Shri Shastri appearing for respondent nos. 2, 3 &amp; 4 on<br \/>\n\tadvance copy, and who has filed Vakalatnama, has at the first<br \/>\n\tinstance when the matter was listed before this Court, the Court was<br \/>\n\tof the view that the matter being in narrow compass let the advocate<br \/>\n\twho is appearing for the respondents be served with advance copy and<br \/>\n\tthus Shri Shastri appears for respondent nos. 2, 3 &amp; 4.  Hence<br \/>\n\tRule.  Rule is waived by learned AGP for respondent no.1 and Shri<br \/>\n\tShastri for respondent nos. 2, 3 &amp; 4 respectively.  With the<br \/>\n\tconsent of learned advocates for the parties, rule is fixed<br \/>\n\tforthwith.\n<\/p>\n<p>Learned<br \/>\n\tadvocate appearing for respondent nos. 2, 3 &amp; 4 could not<br \/>\n\tcontrovert in any manner the contention raised by the petitioners<br \/>\n\tthat the permission as such would inure till 31\/7\/2011 and he<br \/>\n\tsubmitted, therefore, the Court may pass appropriate order.\n<\/p>\n<p>The<br \/>\n\torder is otherwise also assailed on the ground of non compliance<br \/>\n\twith principle of natural justice. In view of this, the order<br \/>\n\timpugned is required to be quashed and set aside.  However, quashing<br \/>\n\tof this order would not be construed in any manner as to entitling<br \/>\n\tthe petitioners to seek further extension, if it is not admissible<br \/>\n\tunder the law. In case, if it is admissible, and in case any such<br \/>\n\textension application is made, it goes without saying that the same<br \/>\n\twill have to be decided by the competent authority on its own merits<br \/>\n\twithout being influenced by this order at all.  With this<br \/>\n\tobservation,the petition is partly allowed.  Rule made absolute to<br \/>\n\tthe above extent.
