Raman,J.\n<\/p><\/blockquote>\n
     The petitioner alleges that his brother Agish married the<\/p>\n
daughter of     Indira Joy, Kochuthottathil House, Thuthiyoor,<\/p>\n
Kakkanad. The said Indira Joy was residing in a small building.<\/p>\n
Since there was nobody         to look after her, they decided to<\/p>\n
dispose of    her    house and registration of        sale deed was<\/p>\n
scheduled on      21-5-2008.      One Ratheesh, Karuvila Puthen<\/p>\n
Veettil, Anappara, Ambalavayal, Wynad was also accompanying<\/p>\n
the said Indira Joy to Sub Registrar’s Ofice. The said Ratheesh<\/p>\n
is none other than the petitioner’s brother in law.              After<\/p>\n
registration of the document the said Indira Joy and Ratheesh<\/p>\n
came out of Sub Registrar’s office, then the 3rd respondent along<\/p>\n
with two Constables came to the spot and taken the said Indira<\/p>\n
Joy and Ratheesh into custody on 21-5-2008 at about 3 p.m.<\/p>\n
Their relatives enquired about the matter in the Thrikkakara<\/p>\n
police station on the same day.           Then one Manoj was also<\/p>\n
taken into custody.       It is alleged that Mandatory conditions<\/p>\n
WPCRL. 165\/2008                 -: 2:-<\/span><\/p>\n
were not     followed while the persons     were taken into<\/p>\n
custody. It is prayed that they may be produced before<\/p>\n
this court and they may be released.\n<\/p>\n
      2. Pursuant to the notice issued, two statements are<\/p>\n
filed by the    Sub Inspector of Police, Thrikkakara police<\/p>\n
station along with a memo by the Government Pleader. As<\/p>\n
per the statement filed, Indira Joy and Manoj were produced<\/p>\n
before the Judicial First Class Magistrate’s court Aluva on<\/p>\n
24-5-2008 and Indira Joy was          remanded to Sub Jail<\/p>\n
Moovattupuzha and Manoj was remanded to the Sub Jail<\/p>\n
Aluva. It is also stated that Ratheesh is not residing within<\/p>\n
this police station limits and he is not wanted for the crime<\/p>\n
registered in this police station.\n<\/p>\n
      3.  In view of the above circumstances, as pointed<\/p>\n
out in the statement, no further direction need be issued in<\/p>\n
the writ petition.\n<\/p>\n
      4.   Learned    counsel    further points   out   some<\/p>\n
mistakes in the statements filed before this court regarding<\/p>\n
the   persons     to whom      the information of arrest was<\/p>\n
WPCRL. 165\/2008               -: 3:-<\/span><\/p>\n
conveyed and alleged       delay in producing the accused<\/p>\n
before court. However, the main prayer in this writ petition<\/p>\n
is for a release of the alleged detenue. Since they are<\/p>\n
remanded to judicial custody pursuant to the order of the<\/p>\n
court, their custody cannot be said to be illegal. No relief<\/p>\n
could be granted in this proceedings. Hence dismissed.<\/p>\n
