Marappan before this Court and set him at liberty from Central\nPrison, Palayamkottai.\n\n!For Petitioner ... Mr.S.Ravi\n^For Respondents... Mr.N.Senthur Pandian,\n\t            Addl.Public Prosecutor\n\n:ORDER\n<\/pre>\n<p>(Order of the Court was made by<br \/>\nP.MURGESEN, J.)<br \/>\n\tThe petitioner is the wife of the detenu, who was detained under Section<br \/>\n3(1) of the Tamil Nadu Prevention of Dangerous Activities of Bootleggers, Drug-<br \/>\noffenders, Forest-offenders, Goondas, Immoral Traffic offenders, Sand Offenders,<br \/>\nSlum-grabbers and Video Pirates Act, 1982 (Tamil Nadu Act 14 of 1982), by order<br \/>\nof the second respondent in M.H.S. Confdl.No.68\/2009 dated 02.06.2009, by<br \/>\nbranding him as a &#8216;GOONDA&#8217;.\n<\/p>\n<p>\t2. There are five adverse cases and one ground case as against the detenu.<br \/>\nThe details of the adverse cases are as under:-\n<\/p>\n<p>Sl.\tPolice Station\t\t\tSection of Law<br \/>\nNo.\tand Crime No.\n<\/p>\n<p>1.\tThiruvengadam Police\t\t392 IPC<br \/>\n\tStation<br \/>\n\tCrime No.11 of 2009<\/p>\n<p>2.\tChinakovilankulam Police\t392 IPC<br \/>\n\tStation<br \/>\n\tCrime No.18 of 2009<\/p>\n<p>3.\tMalli Police Station\t\t379 IPC<br \/>\n\tCrime No.48 of 2009<\/p>\n<p>4.\tSathur Town Police Station\t392 IPC<br \/>\n\tCrime No.256 of 2009<\/p>\n<p>5.\tKarivalamvanthanallur\t\t392 IPC<br \/>\n\tPolice Station<br \/>\n\tCrime No.54 of 2009<\/p>\n<p>The ground case was registered under Sections 387 and 506(ii) IPC on the file of<br \/>\nthe Sankarankovil Taluk Police Station in Crime No.74 of 2009. In the ground<br \/>\ncase, the detenu was arrested on 07.05.2009 and produced before the Judicial<br \/>\nMagistrate, Sankarankovil and remanded to judicial custody till 05.06.2009. The<br \/>\ndetention order was clamped on the detenu on 02.06.2009.\n<\/p>\n<p>\t3. Learned counsel for the petitioner has submitted that the order of<br \/>\ndetention passed by the second respondent is vitiated on the ground that the<br \/>\npre-detention representation of the detenu was not considered by the<br \/>\nauthorities.  For this, he relied on a decision of this Court in the case of<br \/>\n<a href=\"\/doc\/13314\/\">Pushparani, A. v. The Commissioner of Police,<\/a> reported in 2003 (1) CTC 616 and<br \/>\nargued that when the pre-detention representation was not considered, the<br \/>\ndetention order is liable to be set aside.\n<\/p>\n<p>\t4. Heard the learned counsel appearing for the petitioner and the learned<br \/>\nAdditional Public Prosecutor appearing for the respondents.\n<\/p>\n<p>\t5. In paragraph-11 of the counter affidavit filed by the second<br \/>\nrespondent, the receipt of the pre-detention representation was admitted. On a<br \/>\nthorough scanning of the Detention Order, it is clear that the pre-detention<br \/>\nrepresentation of the detenu was not considered at the time of passing of<br \/>\ngrounds of detention, even though it is claimed that the said pre-detention<br \/>\nrepresentation was sent to the Superintendent of Police, Tirunelveli District.<br \/>\nHaving tested the present case in the light of the decision of this Court relied<br \/>\non by the learned counsel for the petitioner in 2003 (1) CTC 616, we are of the<br \/>\nconsidered view that the order of detention passed by the second respondent is<br \/>\nvitiated, on the ground that the Detaining Authority had failed to consider the<br \/>\npre-detention representation of the detenu.\n<\/p>\n<p>\t6. In view of the foregoing reasons, the Habeas Corpus Petition is allowed<br \/>\nand the order of detention in Order No.M.H.S.Confdl.No.68 of 2009 dated 2.6.2009<br \/>\npassed by the second respondent is set aside.
