Justice R.BASANT\n\n Dated :20\/06\/2007\n\n O R D E R\n                                    R.BASANT, J\n\n                          ------------------------------------\n\n                              B.A.No.3722 of 2007\n\n                         -------------------------------------\n\n                     Dated this the 20th day of June, 2007\n\n\n                                       ORDER\n<\/pre>\n<p>       Petitioner   is   accused   No.3   in   a   prosecution,   inter   alia,   under<\/p>\n<p>Section   452   Cr.P.C.     That   is   the   only   non   bailable   offence   alleged.<\/p>\n<p>Investigation   is   complete.     Final   report   has   already   been   filed.     The<\/p>\n<p>petitioner   is   employed   abroad.     He   did   not   receive   any   notice   or<\/p>\n<p>summons   to   appear   before   the   learned   Magistrate.     In   these<\/p>\n<p>circumstances,   he   had   not   appeared   before   the   learned   Magistrate.<\/p>\n<p>But   the   learned   Magistrate   has   issued   coercive   processes   to   compel<\/p>\n<p>the presence of the petitioner.   The petitioner is willing to surrender<\/p>\n<p>before the learned Magistrate, but he apprehends that his application<\/p>\n<p>for bail may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance   with   law   and   expeditiously.     He   further   prays   that<\/p>\n<p>appropriate   directions   under   Section   438   Cr.P.C     and\/or   482   Cr.P.C<\/p>\n<p>issued in favour of the petitioner.\n<\/p>\n<\/p>\n<p>       2.     After   the   decision   in  Bharat   Chaudhary   v.   State   of<\/p>\n<p>Bihar [A.I.R 2003 S.C 4662], it is trite that powers under Section 438<\/p>\n<p>Cr.P.C can be issued in favour of a person who apprehends arrest in<\/p>\n<p>execution   of   a   non   bailable   warrant   issued   by   a   court   in   a   pending<\/p>\n<p>proceedings.     But   even   for   that,   sufficient   and   satisfactory   reasons<\/p>\n<p>must   be   shown   to   exist.     I   am   not   persuaded   in   the   facts   and<\/p>\n<p>circumstances of this case that any such reasons exist.<\/p>\n<p><span class=\"hidden_text\">B.A.No.3722 of 2007                       2<\/span><\/p>\n<p>         3.    It   is   for   the   petitioner   to   appear   before   the   learned<\/p>\n<p>Magistrate and   explain to the learned Magistrate the circumstances<\/p>\n<p>under   which   he   could   not   earlier   appear   before   the   learned<\/p>\n<p>Magistrate.   I have no reason to assume that the learned Magistrate<\/p>\n<p>would not consider such application on merits, in accordance with law<\/p>\n<p>and   expeditiously.     Every   court   must   do   the   same.     No   special   or<\/p>\n<p>specific   direction   appears   to   be   necessary.     Sufficient   general<\/p>\n<p>directions have already been issued in  <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy<\/p>\n<p>Superintendent of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<\/p>\n<p>         4.    This application is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioner appears before the<\/p>\n<p>learned   Magistrate   and   applies   for   bail   after   giving   sufficient   prior<\/p>\n<p>notice to the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p>must proceed to pass appropriate orders on merits and expeditiously &#8211;<\/p>\n<p>on the date of surrender itself, unless there are compelling reasons.<\/p>\n<p>         5.
