SHAH\n\t\t\n\t\n\n \n\nDate\n: 28\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npresent appeal arises out of the impugned judgment and decree passed<br \/>\nby the learned City  Civil Court, Ahmedabad in Civil Suit No.<br \/>\n2117\/1980 decreeing the suit partly  in favour of the original<br \/>\nplaintiff for a sum of Rs. 6000\/- as the principal amount with<br \/>\ninterest.  In view of death of Shri Arvindkumar Shah, learned<br \/>\nadvocate appearing on behalf of the appellants, Registry was directed<br \/>\nto issue notice upon the appellants and it is reported that notice<br \/>\nupon the appellants are unserved due to the shop being closed before<br \/>\ntwenty years.  Under the circumstances, it is not possible for the<br \/>\nRegistry to serve the appellants.  Even notice upon respondent no. 2<br \/>\nis also still unserved.  Hence, the present First Appeal is dismissed<br \/>\nfor non-prosecution.
