The trial court held  that\nno   reasonable opportunity was given to the  respondent.\nThe High Court up held the    decision of the trial court.\nOn  appeal to this Court it was contended by  the  appellant\nthat a synopsis of the evidence was adequate to acquaint the\nrespondent to cross-examine the witnesses at the inquiry.\nDismissing the appeal,\nHELD  :\t It  is unjust and unfair  to  deny  the  Government\nservant\t copier. of statements of witnesses examined  during\ninvestigation and produced at the inquiry in support of\t the\ncharges\t leveled against him.  A synopsis does\tnot  satisfy\nthe   requirements  of\tgiving\tthe  Government\t servant   a\nreasonable  opportunity of showing cause against the  action\nproposed to be taken. [371 D-E]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL APPELLATE JURISDICTION : Civil Appeal No. 4 of 1970.<br \/>\nAppeal\tfrom the Judgment &amp; Decree dated the 14th  November,<br \/>\n1968 of the Punjab &amp; Haryana High Court in R.F.A. Nos. 154 &amp;<br \/>\n186 of 1964.\n<\/p>\n<p>0. P. Sharma, for the appellant.\n<\/p>\n<p>Hardayal Hardey and P. P. Juneja, for the respondent.<br \/>\nThe Judgment of the Court was delivered by<br \/>\nRAY,  C.J. This appeal by certificate turns on the  question<br \/>\nas  to\twhether the State gave the respondent  a  reasonable<br \/>\nopportunity   as   contemplated\t by  Article  311   of\t the<br \/>\nConstitution.\n<\/p>\n<p>The  respondent\t was a Sub Divisional  Officer.\t  The  State<br \/>\nordered a departmental enquiry against the respondent.<br \/>\nThe  respondent\t filed\ta suit for a  declaration  that\t the<br \/>\ndismissal of the respondent was illegal.  One of he  grounds<br \/>\nchallenging  the  order\t of dismissal  was  that  copies  of<br \/>\nstatements   recorded  by  the\tpolice\tin  the\t course\t  of<br \/>\ninvestigation  of the witnesses proposed to be\texamined  at<br \/>\nthe  departmental enquiry were not supplied by the State  to<br \/>\nthe respondent in spite of the request in that behalf.<br \/>\nThe  trial Court found that copies of the statements of\t the<br \/>\nwitnesses as recorded by the Vigilance Department during the<br \/>\npreliminary enquiry were not supplied to the respondent\t but<br \/>\nonly  the synopsis was given.  The trial  Court,  therefore,<br \/>\nheld  that  no\treasonable  opportunity\t was  given  to\t the<br \/>\nrespondent.\n<\/p>\n<p><span class=\"hidden_text\">371<\/span><\/p>\n<p>     The High Court upheld the decision.\n<\/p>\n<p>The State contended that the respondent was not entitled  to<br \/>\nget  copies  of statements. The reasoning of the  State\t was<br \/>\nthat  the  respondent  was given the  opportunity  to  cross<br \/>\nexamine\t the witnesses and during the cross-examination\t the<br \/>\nrespondent  would  have the opportunity of  confronting\t the<br \/>\nwitnesses  with\t the statements. It is\tcontended  that\t the<br \/>\nsynopsis  was adequate to acquaint the respondent  with\t the<br \/>\ngist of the evidence.\n<\/p>\n<p>The  meaning  of a reasonable opportunity of  showing  cause<br \/>\nagainst\t the  action  proposed\tto  be\ttaken  is  that\t the<br \/>\nGovernment  servant is afforded a reasonable opportunity  to<br \/>\ndefend himself against charges on which inquiry is held. The<br \/>\nGovernment  servant should be given an opportunity  to\tdeny<br \/>\nhis guilt and establish his innocence. He can do so when  he<br \/>\nis  told what the charges against him are. &#8216;He can do so  by<br \/>\ncross  examining  the witnesses produced  against  him.\t The<br \/>\nobject\tof  supplying  statements  is  that  the  Government<br \/>\nservant will be able to refer to the previous statements  of<br \/>\nthe witnesses proposed to be examined against the Government<br \/>\nservant.  Unless the statements are given to the  Government<br \/>\nservant he will not be able to have an effective and  useful<br \/>\ncross-examination.\n<\/p>\n<p>It  is\tunjust\tand unfair to deny  the\t Government  servant<br \/>\ncopies\t of   statements  of   witnesses   examined   during<br \/>\ninvestigation and produced at the inquiry in support of\t the<br \/>\ncharges levelled against the Government servant. A  synopsis<br \/>\ndoes  not satisfy the requirements of giving the  Government<br \/>\nservant\t a reasonable opportunity of showing  cause  against<br \/>\nthe action proposed to be taken.\n<\/p>\n<p>For  these reasons the appeal is dismissed.
