Since the corpus<br \/>\n\tBinaba Zala is traced out earlier, Mr.L.B.Dabhi, learned APP for the<br \/>\n\tRespondent &#8211; State of Gujarat made a request to this Court<br \/>\n\tthat this matter may be circulated today, so that the corpus can be<br \/>\n\tproduced before the court and her willingness may be ascertained.<br \/>\n\tMr. L.B.Dabhi, learned APP has also stated that he has informed Ms.<br \/>\n\tSamata V. Patel, learned Advocate for the Petitioner.  We have<br \/>\n\ttherefore permitted to circulate this matter at 2:30 PM today by<br \/>\n\tnotifying it on a separate board.\n<\/p>\n<p>RULE.\n<\/p>\n<p>\tMr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of Respondent Nos.1 and 4 whereas Mr. R.J.Goswami, learned<br \/>\n\tAdvocate appears and waives service of notice on behalf of<br \/>\n\tRespondent Nos.2, 3 and 5.\n<\/p>\n<p>By<br \/>\n\tfiling instant Petition under Article 226 of the Constitution of<br \/>\n\tIndia, the petitioner has prayed to issue a writ of Habeas Corpus<br \/>\n\tand \/ or any other appropriate writ, order or direction, directing<br \/>\n\tRespondent No.4 -PSI, Dhandhuka Police Station, Dhanduka to produce<br \/>\n\tthe corpus Binaba before this Court and to further direct to hand<br \/>\n\tover the custody of the corpus &#8211; Binaba<br \/>\n\tto the petitioner.\n<\/p>\n<p>\tAs per the<br \/>\n\taverments made in the Petition, the corpus &#8211; Binaba left her<br \/>\n\thouse by saying that she is going to meet someone in new year and<br \/>\n\tthereafter she has not returned back to her home till evening and<br \/>\n\ttherefore the petitioner has tried to call her on her Mobile phone,<br \/>\n\tbut it was found switched off and till today no message or any call<br \/>\n\tis received by the petitioner from the said mobile number.  The<br \/>\n\tpetitioner therefore went to the concerned police station to lodge<br \/>\n\tan FIR, but the police officer refused to lodge any complaint and<br \/>\n\tregistered Janvajog entry.  As per the further averments made in the<br \/>\n\tpetition, the petitioner received a phone call from the unknown<br \/>\n\tperson saying that his name is Mayurbhai Nathubhai Sonara and the<br \/>\n\tcorpus &#8211; Binaba &#8211; the daughter of the petitioner is in<br \/>\n\this custody and also threatened not to file any police complaint.<br \/>\n\tAfter detailed inquiry, the petitioner came to know that the said<br \/>\n\tperson is a trusty of Sohan Vidyamandir where the corpus Binaba is<br \/>\n\tworking.  The petitioner therefore apprehends that the corpus &#8211;<br \/>\n\tBinaba is in illegal detention of Respondent No.2 &#8211; Mayurbhai<br \/>\n\tNathubhai Sonara without her wish and will and her life is in<br \/>\n\tdanger.  The petitioner has therefore filed this petition and prayed<br \/>\n\tfor the reliefs to which the reference is made in earlier paragraph<br \/>\n\tof this judgment.\n<\/p>\n<p>This<br \/>\n\tCourt vide order dated 15.11.2010 issued Notice to the Respondents<br \/>\n\tand made it returnable on 22.11.2010 on condition that the<br \/>\n\tpetitioner shall deposit Rs.5,000\/- as cost with the registry of<br \/>\n\tthis Court, to show his bonafide.\n<\/p>\n<p>\tHowever,<br \/>\n\ton returnable date, the corpus &#8211; Binaba could not be traced<br \/>\n\tout and the matter was again adjourned to 6.12.2010.\n<\/p>\n<p>\tSince the<br \/>\n\tcorpus &#8211; Binaba is found out earlier, Mr. L.B.Dabhi, learned<br \/>\n\tAPP, requested this Court to circulate the matter today and<br \/>\n\ttherefore the matter is taken up for hearing today.\n<\/p>\n<p>\tAt the<br \/>\n\ttime of hearing of this petition, Mr. L.B.Dabhi, learned APP, upon<br \/>\n\tinstructions received from Naginbhai, Head Constable, Dhanduka<br \/>\n\tPolice Station, who is personally present before the Court, states<br \/>\n\tthat he has found out the corpus &#8211; Binaba from the custody of<br \/>\n\tRespondent No.2 and he wants to produce the corpus Binaba before<br \/>\n\tthis Court.  We have therefore permitted the Head Constable to<br \/>\n\tproduce the corpus Binaba before this Court.\n<\/p>\n<p>On<br \/>\n\tproduction of the corpus &#8211; Binaba, we have ascertained her wish and<br \/>\n\twillingness and also inquired as to whether she is in illegal<br \/>\n\tdetention of Respondent No.2 &#8211; Mayurbhai Nathubhai Sonara.<br \/>\n\tShe, in unequivocal terms stated that she is not in illegal<br \/>\n\tdetention of Respondent No.2 and she has performed marriage with<br \/>\n\tRespondent No.2 on 21.2.2010 as per Hindu Rites at Raikhad and the<br \/>\n\tsaid marriage has also been registered with the Registrar, Marriage<br \/>\n\tand she is also happy with Respondent No.2 at her matrimonial home<br \/>\n\twhere she wants to<br \/>\n\tpermanently reside with Respondent No.2.\n<\/p>\n<p>\tSo far as<br \/>\n\tthe age of the corpus &#8211; Binaba is concerned, there is no<br \/>\n\tdispute by the petitioner that she is about 24 years of age,<br \/>\n\ttherefore she is major.\n<\/p>\n<p>In<br \/>\n\tthe case of Gian Devi v\/s The Superintendent, Nari<br \/>\n\tNiketan, Delhi and Ors., (1976) 3 SCC 234,<br \/>\n\tthe Supreme Court has observed that a woman who has attained<br \/>\n\tmajority is free to stay in any place she likes, without constraint<br \/>\n\tby her parents or husband.  What is held by the Supreme Court in the<br \/>\n\tabove referred to case is that against her wishes, a major girl<br \/>\n\tcannot be sent to &#8216;Nari Niketan&#8217;.\n<\/p>\n<p>\tIn view of<br \/>\n\tthe facts and circumstances emerging from the record of the case and<br \/>\n\tmore particularly the statement made by the corpus &#8211; Binaba before<br \/>\n\tthis Court to the effect that she is a lawfully wedded wife of<br \/>\n\tRespondent No.2 &#8211; Mayurbhai Nathubhai Sonara and therefore she<br \/>\n\twas not in illegal detention of Respondent No.2 and she wants to<br \/>\n\treside permanently with Respondent No.2 at her matrimonial home, the<br \/>\n\tcorpus &#8211; Binaba is sui juris, no fetters can be placed upon<br \/>\n\ther choice of person with whom she wants to reside.\n<\/p>\n<p>\tIn view of<br \/>\n\tthe aforesaid state of affairs, it cannot be said that the corpus-<br \/>\n\tBinaba is in illegal detention of Respondent No.2 &#8211; Mayurbhai<br \/>\n\tNathubhai Sonara.  Therefore, we have permitted the corpus &#8211;<br \/>\n\tBinaba to go with Respondent No.2.\n<\/p>\n<p>Seen<br \/>\n\tin the above context, instant Habeas Corpus petition lacks<br \/>\n\tmerit and deserves to be rejected.\n<\/p>\n<p>\tAt this<br \/>\n\tstage Ms. Samata V. Patel, learned Advocate for the Petitioner, upon<br \/>\n\tinstructions received from the petitioner, does not press this<br \/>\n\tpetition and seeks leave to withdraw the same.\n<\/p>\n<p>\tThe prayer<br \/>\n\tmade by Ms. Samata V. Patel, learned Advocate for the Petitioner has<br \/>\n\tnot been opposed by Mr. L.B.Dabhi, learned APP for Respondent No. 1\n<\/p>\n<p>\t&#8211; State of Gujarat as well as Respondent No.4 &#8211; PSI,<br \/>\n\tDhandhuka Police Station, Dhandhuka and also by Mr. R.J.Goswami,<br \/>\n\tlearned Advocate for Respondent Nos. 2, 3 and 5.\n<\/p>\n<p>\tHence,<br \/>\n\tleave to withdraw the petition is granted.  The petition stands<br \/>\n\trejected as it is withdrawn.  Rule is discharged.\n<\/p>\n<p>\tAt the<br \/>\n\ttime of issuance of Notice, this Court has directed the petitioner<br \/>\n\tto deposit Rs.5,000\/- as cost with the registry of this Court, to<br \/>\n\tshow his bonafide.\n<\/p>\n<p>\tPursuant<br \/>\n\tto the aforesaid direction, the petitioner has deposited Rs.5,000\/-<br \/>\n\twith the registry of this Court.\n<\/p>\n<p>\tSince the<br \/>\n\tpetitioner &#8211;
