The Labour Court also directed to fix the new pay<br \/>\nscale of Rs.3050-4590\/- with increments and grant benefits<br \/>\naccordingly.\n<\/p>\n<p>2.\t\tThe<br \/>\nshort facts of the case are that the respondent workman at the<br \/>\nrelevant time was working as rojamdar operator. It is the case of the<br \/>\nrespondent workman that though he had put in almost 17 years of<br \/>\nservice and had passed the written examination for the post of<br \/>\nWireman, the petitioner did not consider him skilled workman and he<br \/>\nwas not granted the benefits of the skilled workman.\n<\/p>\n<p>2.1.\t\tBeing<br \/>\naggrieved by the same, the respondent-workman raised an industrial<br \/>\ndispute which was ultimately referred to Labour Court for<br \/>\nadjudication being Reference [LCD] No. 4 of 2003. Before the Labour<br \/>\nCourt, both the parties adduced evidence and after appreciating the<br \/>\nmaterial produced before it, the Labour Court allowed the Reference<br \/>\nwith the aforesaid directions. Hence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the petitioner. It appears from the record that<br \/>\nthe respondent workman working with the petitioner since 1986. It has<br \/>\ncome out from the cross examination of the witness who had deposed on<br \/>\nbehalf of the petitioner that the respondent workman ad joined the<br \/>\nservices of the petitioner on14.05.1986 and that he had rendered<br \/>\ncontinuous services of about 24 years.\n<\/p>\n<p>3.1.\n<\/p>\n<p>It also appears from the record that the respondent workman had also<br \/>\npassed the requisite examination for the purpose of getting the pay<br \/>\nequivalent to skilled workman. In the impugned award the Labour Court<br \/>\nhad discussed the entire evidence in detail  and I find that while<br \/>\narriving at the conclusion  the Labour Court has not committed any<br \/>\nillegality which warrants any interference from this Court under<br \/>\nArticle 226 of the Constitution of India.
