3   20.7.2010                   Heard counsel for the petitioner and the<\/p>\n
                      counsel appearing for the State.\n<\/p>\n
                                This is the third round of litigation at the<\/p>\n
                      instance of the petitioner for similar relief. The relief<\/p>\n
                      being for a direction to the Secretary, Bihar School<\/p>\n
                      Examination Board, Patna to publish the result of the<\/p>\n
                      petitioner of    Diploma in physical Education, since<\/p>\n
                      the petitioner appeared in the examination held in<\/p>\n
                      the year 1994.\n<\/p>\n
                                Earlier the petitioner had filed CWJC No.<\/p>\n
                      14954 of 2006 along with other similarly situated<\/p>\n
                      candidates. Several other writ applications were also<\/p>\n
                      filed for similar relief relating to publication of the<\/p>\n
                      result of Diploma in Physical education.            All writ<\/p>\n
                      applications were heard and disposed off by common<\/p>\n
                      order,   directing   the   Secretary   of   Bihar    School
\n                    2<\/span><\/p>\n
Examination Board to dispose off representation of<\/p>\n
the petitioners within thirty days. A representation<\/p>\n
filed by this petitioner and others for publishing the<\/p>\n
results were rejected vide order dated 25.7.2008.<\/p>\n
Thereafter CWJC No. 12408 of 2008 was filed for<\/p>\n
quashing of the order dated 25.7.2008 passed by<\/p>\n
the Secretary, Bihar School Examination Board,<\/p>\n
Patna and also for a direction to publish the result.<\/p>\n
This writ application was allowed vide order dated<\/p>\n
12.11.2008, directing the Board to publish the result<\/p>\n
of all candidates including this petitioner before<\/p>\n
17.11.2008.        However,       the   results     of   other<\/p>\n
petitioners were published but the result of present<\/p>\n
petitioner was not published.\n<\/p>\n
           Petitioner’s case is that orally she was<\/p>\n
informed    that       her   result   cannot   be   published<\/p>\n
because she was only 17 years eight months old on<\/p>\n
1.7.1985 i.e. on first July of the admission year but<\/p>\n
so far Regulation of Bihar School Examination Board<\/p>\n
Regulations 1964 is concerned, a candidate must be<\/p>\n
18 years of age on first July of the admission year.<\/p>\n
Since the petitioner got admitted in the college<\/p>\n
without following the minimum criteria of 18 years<\/p>\n
on first July of the admission year, her result cannot
\n                  3<\/span><\/p>\n
be published.\n<\/p>\n
           Counsel      appearing     for     the   petitioner<\/p>\n
submits that admittedly the petitioner got admission<\/p>\n
in Diploma in Physical Education in the training<\/p>\n
College i.e. “Central Sharirik Shaikshik Prashikshan<\/p>\n
Parishad, Sitamarhi”       for the Sessions 1985-1986<\/p>\n
after passing her matriculation examination in the<\/p>\n
year 1984. In the certificate of matriculation, her<\/p>\n
date of birth is clearly mentioned as 27.11.1967.<\/p>\n
There was no concealment on the part of the<\/p>\n
petitioner. She could not appear in the annual<\/p>\n
examination held in the year 1988 as she has not<\/p>\n
cleared sent up examination. Subsequent to 1988,<\/p>\n
the annual examination could be held in the year<\/p>\n
1994. Petitioner appeared in the examination and by<\/p>\n
that time she has attained 26 years of age.               The<\/p>\n
Bihar School Examination Board considering her<\/p>\n
form, in which she has given her date of birth as<\/p>\n
27.11.1967 had issued the admit card mentioning<\/p>\n
same   date      of    birth.   In    this    circumstance,,<\/p>\n
considering her date of birth,        she was allowed to<\/p>\n
appear in the examination. Her result could not have<\/p>\n
withheld    by    the     Bihar      School     Examination<\/p>\n
Board,Patna.     The      act   of    non-publication       of
\n                     4<\/span><\/p>\n
petitioner’s   result     is   completely     in   violation   of<\/p>\n
Regulation 17 of the Bihar School Examination<\/p>\n
Board, which provides that a candidate having<\/p>\n
issued admit card and allowed to appear at the<\/p>\n
examination, his\/her result cannot be withheld on<\/p>\n
the ground of alleged non-fulfillment of any requisite<\/p>\n
condition, which was for the Secretary of the Board<\/p>\n
to scrutinize before issuance of the admit card.<\/p>\n
          The case of the petitioner is fully covered<\/p>\n
under the provisions of Regulation 17 of Bihar<\/p>\n
School Examination Board Regulations, 1964.<\/p>\n
          Counter affidavit has been filed on behalf<\/p>\n
of   Secretary,     Bihar      School   Examination      Board,<\/p>\n
Patna, wherein statement has been made that the<\/p>\n
Board on several occasions wrote letters to the<\/p>\n
Principal of the Institution for furnishing documents<\/p>\n
in relation to the petitioner and one more candidate<\/p>\n
but it was not supplied, stating that the documents<\/p>\n
have been destroyed in the devastating flood of July,<\/p>\n
1993. Since the petitioner did not fulfill the requisite<\/p>\n
criteria for admission in the course, her result cannot<\/p>\n
be published.\n<\/p>\n
           I find that in the counter affidavit, there is<\/p>\n
no   denial    to   the     statement    of    the   petitioner
\n                  5<\/span><\/p>\n
regarding mentioning of her date of birth in the<\/p>\n
admit card issued by the Board, in favour of the<\/p>\n
petitioner for appearance in the examination. It<\/p>\n
shows that there was no concealment of the fact, so<\/p>\n
far the date of birth is concerned and the Board had<\/p>\n
issued admit card in favour of the            petitioner<\/p>\n
knowing her date of birth. In this circumstance, it<\/p>\n
was desirable, for the Secretary, Bihar School<\/p>\n
Examination Board to reject issuance of admit card<\/p>\n
in favour of the petitioner, at the stage of scrutiny.<\/p>\n
Since it was not done, petitioner is entitled for<\/p>\n
publication of result, in terms of Regulation 17 of the<\/p>\n
Bihar School Examination Board Regulations, 1964.<\/p>\n
The action of the respondent-Board in the matters of<\/p>\n
petitioner has been arbitrary and harassing. The<\/p>\n
petitioner has been compelled to come before this<\/p>\n
Court, at frequent intervals for same reliefs. This<\/p>\n
must be the last approach of the petitioner for the<\/p>\n
relief, she has been coming again and again. She<\/p>\n
must get the final relief.\n<\/p>\n
          The    Secretary    of   the   Bihar    School<\/p>\n
Examination Board, Patna is directed to publish the<\/p>\n
result of the petitioner by 21st of July, 2010.<\/p>\n
          Let a copy of this order be communicated
\n                            6<\/span><\/p>\n
          to the Secretary, Bihar School Examination Board,<\/p>\n
          Patna through Fax, for which counsel for the<\/p>\n
          petitioner will deposit requisite cost today.<\/p>\n
                     Mr. Arshad Alam will also communicate<\/p>\n
          this    order   to   the   Secretary,   Bihar    School<\/p>\n
          Examination Board, Patna today (20.7.2010) for<\/p>\n
          publication of petitioner’s result by 21st of July,<\/p>\n
