  This appeal is directed against the judgment and<\/p>\n

[hereinafter referred to as ‘Tribunal’ for breVit_y’},l:’fo_lI’1′–VVthe<\/p>\n
ground that, the compensation of <\/p>\n
by the Tribunal with interest. at.:8%_pe1j:  T <\/p>\n
date of petition till the date <\/p>\n
claim of the appellant for \/ ‘–,–,Vis%_:in’aVd’equate.  V<\/p>\n
2. The brief facts of –\u00ab <\/p>\n
That, on 12A._1O.19’9V5,:l’_at noon when the
\nappellant    vehicle bearing
\n Gubbi to Tumkur
\nnear  ‘bridge, it dashed against the
\nroadside baiiyari  rash and negligent driving by<\/p>\n
  the impact, the appellant sustained<\/p>\n
\u00bbgrieVot.is\u00ab.injVuries. It is the case of the appellant that on<\/p>\n
account’ the injuries sustained in the accident he has<\/p>\n
 spent. J\ufb02considerable amount towards conveyance,<\/p>\n
it  not”;-rishing food, attendant charges and medical expenses.<\/p>\n
Therefore, he filed a clai petition claiming compensation<\/p>\n
MW\/\/,…a<\/p>\n
of Rs.10,00,000\/\u00bb against the respondents. The said claim
\npetition had come up before the Tribunal on 27.09.2005.<\/p>\n
The Tribunal, after hearing the learned counsel’~.on:l’b_oth<\/p>\n
sides and after considering the oral <\/p>\n
evidence available on record, __has_ aliowedel-‘I,thegelaimu ‘ i. <\/p>\n
petition of the appellant    <\/p>\n

annum from the date of petition”p_’till”-.the date. of: payment.
\nThe appellant has presentedthis on the ground<\/p>\n
that the said.’   the Tribunal is<\/p>\n
inadeqjliate  it  enhancement by modifying the<\/p>\n
judgment   V   Tribunal.\n<\/p>\n

  4.  careful perusal of the judgment and award of<\/p>\n
 what emerges is that the Tribunal has erred<\/p>\n
 .._\u00abin._V’as”*arding only Rs.40,000\/– towards pain and agony<\/p>\n
  which is inadequate f  reason that the appellant was<\/p>\n

inpatient in the hospital and the doctor has found the<\/p>\n
following disabilities:\n<\/p>\n

And    due to loss of vision of<\/p>\n
right eye.r “failed to consider the nature<\/p>\n
and duration .ot;treatme_r;t4, pain and agony suffered by the<\/p>\n
    dxi1’r’ing_____tk1e treatment period. Therefore we<\/p>\n
 ideemy  Rs.50,000\/m towards pain and agony
\nit\/\u00ab~ awarded by the Tribunal.\n<\/p>\n
 5.   “.T1’ibuI1\u00a2’:11 has rightly awarded just and<\/p>\n
Xreiasonable compensation of Rs. 35,619\/- towards medical<\/p>\n
W <\/p>\n
expenses which is based on the medical bilis produced<\/p>\n
and therefore it does not call for interference.<\/p>\n
6. T he Tribunal has erred in awardingll\u00e9’ <\/p>\n
10,000\/– towards conveyance, nou\ufb01shing.  <\/p>\n
attendant charges which is inadelquate  theareasond ‘<\/p>\n

the appellant has undergone treatrrient for”-5  <\/p>\n
months in the hospital. He  have spent considerable
\namount towards conV’ey’a–r1ce.,  food etc. Taking
\ninto consideration this.._aspe’o_t :\u00bbof”.”the’:-Tirriatter we award<\/p>\n
Rs.2o,000\/-_Vr\u00a7ri\u00a2{a~ :h\u00e9a said”h\u00a25,a.V’id” ‘ <\/p>\n
7. The justi\ufb01ed in not awarding any<\/p>\n
compensatioi1._,toWards vioss of income during laid up<\/p>\n
  Carefullvplerusal of EX. P 9 salary certificate<\/p>\n
 –disc1\u00a7ps\u00a2sj\u00abig;’~\u00a7$sjs.salary of the appellant at Rs. 3068\/- p.m.<\/p>\n
of same Rs.40\/– is to be deducted towards<\/p>\n
 Jprofessional tax. Then the net salary Comes to Rs.3028\/-<\/p>\n
  -‘it is not in dispute that the appellant was inpatient<\/p>\n
it  “in: the hospital for more than 3 months. He might have<\/p>\n
taken at–least one more month rest. Taking this factor
\ninto consideration we deem it fit to award —<\/p>\n
towards loss of income during laid up period; <\/p>\n
8. The Tribunal has aWar”(i’edl’   T. <\/p>\n
compensation towards loss of \ufb01iture ear-ni’ng\u00ab. ‘b–a,it..Vynot<\/p>\n
awarded any compensation~\u00bb..o:’y:toWards’~.  df’1.v:4ainenitiesV,
\ndisability, discomfort, and  is not in
\ndispute that on accoiilntly   sustained the
\nappellant underxyent mhpi\u00e9itient for a period of<\/p>\n
3 monthsf  disability at 30% to<\/p>\n
right eye: would affect his future career.<\/p>\n
Taking this ‘i’n’to:_”..’iconsideration we deem it fit to<\/p>\n
 awaitedVRs60,600.\/,:___trawards loss of amenities, discomfort<\/p>\n
 ‘and..fut11re”unhappiness including loss of future earning.<\/p>\n
9.A   regard to the facts and circumstances as<\/p>\n
  ‘a’iaove, the appeal \ufb01led by the appellant is allowed<\/p>\n
  inpart and the judgment and award dated 27.09.2005<\/p>\n
  -passed in MVC No.694\/199$ on the file of the Pri. Civil Judge<\/p>\n
