     Issue raised in these writ petitions are common and<\/p>\n
therefore these writ petitions were heard together and are<\/p>\n
disposed of by this judgment.\n<\/p>\n
     2.    W.P.(C)No.22941 of 2010 is taken as the<\/p>\n
leading case.\n<\/p>\n
     3.    Petitioners have undergone Diploma in General<\/p>\n
Nursing and Midwifery. At that time, they had executed<\/p>\n
bonds, a copy of which is Ext.P1. Clause 11 of the Bond<\/p>\n
relied on by the petitioners reads as under :-<\/p>\n
     “The bounden shall after passing the final examination<\/p>\n
     referred to in the clause 4 supra, be bound to serve the<\/p>\n
     Government in conformity with the service rules therein<\/p>\n
     force for a minimum period of 5 (five) years after training<\/p>\n
     if required by the Government within one year from the<\/p>\n
     date of passing the final examination.”\n<\/p><\/blockquote>\n

     4.    According to the petitioners, on completion of the<\/p>\n
training, by Ext.P2 order dated 3.4.2007 issued by the<\/p>\n
District Medical Officer, they were appointed on contract<\/p>\n
basis under the National Rural Health Mission Scheme.<\/p>\n
Although the initial period of appointment was one year,<\/p>\n
they were allowed to continue. It is not in dispute that the<\/p>\n
petitioners are still continuing in service even as on date.<\/p>\n
     5.    The grievance of the petitioners is that now by<\/p>\n
Ext.P4 order of the DMO, another set of persons with<\/p>\n
Diploma in General Nursing and Midwifery are sought to be<\/p>\n
appointed under Rule 9(a)(1) of KS & SSR. The contention<\/p>\n
raised by the counsel for the petitioners is that under<\/p>\n
Clause 11 of Ext.P1 bond, they are entitled to be offered<\/p>\n
appointment under the Director of Health Services. It is<\/p>\n
stated that appointment by Exts.P2 and P3 is under the<\/p>\n
NRHM and therefore, overlooking their claims another<\/p>\n
batch could not have been appointed.\n<\/p>\n
     6.    The learned Government Pleader has obtained<\/p>\n
W.P.(C) Nos.22941, 22967 & 23485 of 2010<\/p>\n
                                -: 3 :-<\/span><\/p>\n
instructions in the matter.            According to the learned<\/p>\n
Government Pleader petitioners have no right to claim<\/p>\n
appointment. It is contended that Clause 11 of Ext.P1 bond<\/p>\n
is only a provision enabling the government to call upon<\/p>\n
those who have undergone training to work for the period<\/p>\n
mentioned therein, but does not create any right in favour<\/p>\n
of any one of the bounden to claim appointment on the<\/p>\n
strength of Clause 11. It is stated that irrespective of the<\/p>\n
above, petitioners were given employment under Exts.P2<\/p>\n
and P3 and that as they are about to complete the term of<\/p>\n
their employment, another batch is sought to be inducted<\/p>\n
on the same terms and conditions.\n<\/p>\n
     7.    I have considered the submissions made.<\/p>\n
     8.    In my view Clause 11 of the bond relied on by the<\/p>\n
petitioners only enables the government to call upon the<\/p>\n
bounden to work for the period mentioned therein if the<\/p>\n
government so chooses and that too within one year from<\/p>\n
the date of passing the final examination. Therefore, this<\/p>\n

does not oblige the government to offer appointment to any<\/p>\n
one of the bounden and for that reason I am not persuaded<\/p>\n
to think that the petitioners have any right under Clause 11<\/p>\n
of the bond to claim employment.\n<\/p>\n
     9.    That apart, it is undisputed that either under DHS<\/p>\n
or under NRHM, petitioners have worked for almost three<\/p>\n
years and the attempt of the respondents is to offer<\/p>\n
provisional appointment to another batch of similar such<\/p>\n
claimants. Since the petitioners have no right whatsoever<\/p>\n
to insist that they should be appointed either under NRHM<\/p>\n
or DHS, it is always open to the respondents to appoint any<\/p>\n
one of the qualified candidates whom they deem fit and the<\/p>\n
petitioners cannot require this Court to prevent the District<\/p>\n
Medical Officer from making such appointments.<\/p>\n
     10. It is now contended that the petitioners have<\/p>\n
represented     for    their   engagement.      If  any   such<\/p>\n
representations have made, it is directed that it will be open<\/p>\n
to the District Medical Officer concerned to consider the<\/p>\n

representations and pass appropriate orders in the matter.<\/p>\n
           Writ petition therefore merits only dismissal and I<\/p>\n

     Issues raised in these writ petitions are similar. For<\/p>\n
the aforesaid reasons, these writ petitions are also<\/p>\n
