Special Civil Application No. 5900 of 2003\n          MR PRABHAV A MEHTA for Petitioner No. 1-3\n          .......... for Respondent No. 1-2\n\n\n     --------------------------------------------------------------\n\n\n              CORAM : MR.JUSTICE JAYANT PATEL\n\n\n              Date of Order: 02\/05\/2003\n\n\nORAL ORDER<\/pre>\n<p>     1.The present petition is      preferred   by   the<br \/>\n     petitioners for   challenging    the notification dated<br \/>\n     15-8-1985, the order dated 11-12-1985 and the order dated<br \/>\n     16-6-1986 issued by the ULC authorities.\n<\/p>\n<p>     2.Heard   Mr.Mehta,   learned   Counsel   for   the<br \/>\n     petitioners.   The contention raised on behalf of the<br \/>\n     petitioners is that though the orders were passed but the<br \/>\n     possession is taken by the paper panchnama on 21-3-1986<br \/>\n     and it has been submitted that as such actual possession<br \/>\n     is not taken and the petitioners are in possession of the<br \/>\n     land even today. Mr.Mehta relied upon the Village Form<br \/>\n     No.7 and 12 to contend that there is cultivation by the<br \/>\n     petitioners and, therefore, he submitted that the actual<br \/>\n     possession is of the petitioners and he submitted that<br \/>\n     after the Repealing Act if the possession of the land is<br \/>\n     not taken, the ULC authorities cannot retain the land and<br \/>\n     it must be given to the petitioners only. Therefore, the<br \/>\n     petitioners have also prayed for appropriate writ to<br \/>\n     direct the respondents to hand-over the possession of the<br \/>\n     land admeasuring 5481 sq. mtrs. bearing Survey No.123<br \/>\n     at Village Bhaili, District Baroda and, therefore, he<br \/>\n     submitted that the     matter   requires   consideration.<br \/>\n     Mr.Mehta further submitted that the compensation as<br \/>\n     required to be paid under Section 11 is still not paid to<br \/>\n the petitioners and, therefore, he submitted that it   can<br \/>\nbe said that the ULC proceedings are not concluded.\n<\/p>\n<p>3.Having considered the above, it is pertinent to<br \/>\nnote that the notification and the orders passed by the<br \/>\nULC authorities are as back as in the year 1984-5-6 and<br \/>\nare challenged in this petition in the year 2003. It is<br \/>\nan admitted position that the petitioners have not<br \/>\nresorted to any proceedings for challenging the action of<br \/>\nthe ULC authorities either by preferring appeal which was<br \/>\nstatutory remedy, or by petition before this Court during<br \/>\nthe period when ULC Act was in operation and, therefore,<br \/>\nin my view, the petitioners cannot be allowed          to<br \/>\nchallenge the orders of the ULC authorities after a<br \/>\nperiod of about more than 17 years.\n<\/p>\n<p>4.The aforesaid is coupled with the fact that the<br \/>\npetitioners themselves have prayed for directing the<br \/>\nrespondents to hand-over the possession which means that<br \/>\nthe petitioners are fully aware that the possession is<br \/>\ntaken over.     The contention that it is only a paper<br \/>\npanchnama and no actual possession is taken, in my view,<br \/>\nis ill-founded.     The reliance placed upon the judgement<br \/>\nin the case of &#8220;<a href=\"\/doc\/1049103\/\">Ambalal Parsottambhai Patel v. State of<br \/>\nGujarat &amp; Ors.<\/a>&#8221; reported in 2001(4) GLR, 3319 is also<br \/>\nill-founded in as much as the aforesaid decision is<br \/>\nconsidered by me in the case of &#8220;<a href=\"\/doc\/1247465\/\">Vipinchandra Vadilal<br \/>\nBavishi &amp; Anr. v. State of Gujarat &amp; Ors.<\/a>&#8221; reported in<br \/>\n2002(3) GLR, 2592, where the view taken is that the<br \/>\nprocedure under the law for taking over the possession is<br \/>\ndrawing of panchnama and in the said judgement I have<br \/>\nrelied upon the judgement of the Apex Court on such<br \/>\npoints. Once the Government has taken possession, merely<br \/>\nbecause subsequently the petitioners have unauthorisedly<br \/>\ncultivated the land would not give any right to the<br \/>\npetitioners to take benefit of the Repealing Act.\n<\/p>\n<p>5.As such even otherwise also I find that the<br \/>\npresent petition is nothing but only an ingenuine device<br \/>\nto take benefit of the Repealing Act by challenging the<br \/>\nproceedings under ULC Act which came to be concluded more<br \/>\nthan 17 years back. The present petition, in my view, is<br \/>\nnot inspiring any confidence and the proceedings are not<br \/>\ninitiated with bonafide purpose to pursue the right but<br \/>\nthey are preferred only with a view to take undue benefit<br \/>\nof the Repealing Act which is otherwise not permissible<br \/>\nunder the law.
