No.27595 of 2010\n                      RAJA BABU SONI, SON OF JAYPRAKASH VERMA\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>2.   18.08.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 302\/34 of the Indian Penal Code.<\/p>\n<p>                             It has been submitted that there is no allegation of<\/p>\n<p>                  the petitioner having fired at the deceased.<\/p>\n<p>                             In view of such, let the petitioner above named, who<\/p>\n<p>                  is in custody since 13.5.2010 and has no criminal antecedents,<\/p>\n<p>                  be released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                  thousand) with two sureties of the like amount each to the<\/p>\n<p>                  satisfaction of Chief Judicial Magistrate, Siwan, in Siwan (Town)<\/p>\n<p>                  P.S. Case No. 84 of 2010 subject to the following conditions:<\/p>\n<p>                  (i)That one of the bailors will be a close relative of the petitioner<\/p>\n<p>                  who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                  related with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                  information to the court about any change in address of the<\/p>\n<p>                  petitioner. (ii)That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and if he is, he<\/p>\n<p>                  shall not be released on bail. (iii)That the bailor shall also state<\/p>\n<p>                  on affidavit that he will inform the court concerned if the<\/p>\n<p>                  petitioner is implicated in any other case of similar nature after<\/p>\n<p>                  his release in the present case and thereafter the court below<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse. (iv)That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
