Jain, J. <\/p>\n<p>1. This revision petition is directed<br \/>\nagainst an order of the learned Additional District<br \/>\nJudge, Delhi dated 26-07-2001 by which the prayer of<br \/>\nthe petitioner-defendant to amend its written<br \/>\nstatement has been partly declined.\n<\/p>\n<p> 2. The petitioner is facing a suit for<br \/>\nrecovery or Rs. 4,99,000\/- filed by the<br \/>\nrespondent-plaintiff and filed its written statement.<br \/>\nThereafter the respondent has filed its replication.<br \/>\nThe petitioner made an application praying for<br \/>\namendment of the written statement and wanted to<br \/>\nraise preliminary objection with regard to the<br \/>\nterritorial jurisdiction of the Courts at Delhi to<br \/>\nentertain and try the suit in question besides<br \/>\nseeking other amendments. Vide the impugned order<br \/>\nthe learned trial court has partly allowed the<br \/>\napplication of the petitioner and permitted him to<br \/>\namend the written statement so as to incorporation<br \/>\npreliminary objections 1 and 3 in regard to the suit<br \/>\nhaving not been filed by a duly authorised person and<br \/>\nthe plaintiff having no right to claim interest from<br \/>\nthe defendant. Trial Court has also allowed the<br \/>\npetitioner to incorporate para 5(a) as a further plea<br \/>\nin the written statement. The trial court,<br \/>\nhowever, declined to allow the petitioner to raise<br \/>\npreliminary objection with regard to the territorial<br \/>\njurisdiction mainly on the premise that such an<br \/>\nobjection was not raised by the petitioner at the<br \/>\nearliest stage or in the written statement and<br \/>\nthereby it has acquiesced in the jurisdiction of the<br \/>\nCourt and could not be permitted to turn around and<br \/>\ntake an inconsistent plea. Aggrieved by the said<br \/>\norder, the petitioner has come up in this revision<br \/>\npetition.\n<\/p>\n<p>3. I have heard the learned counsel for<br \/>\nthe parties and the matter is being finally disposed<br \/>\nof at the admission stage itself. Learned counsel<br \/>\nfor the petitioner has emphatically urged that the<br \/>\ntrial court was not justified in declining the<br \/>\npermission to raise the objection with regard to<br \/>\njurisdiction because such a plea is basically a legal<br \/>\nplea and the suit is still at its preliminary<br \/>\nstage i.e. issue have yet to be framed. He<br \/>\nemphasized that the approach of the Court has to be<br \/>\nliberal while considering an application for<br \/>\namendment of pleadings as has been held in various<br \/>\ndecisions of the Hon&#8217;ble Supreme Court and the High<br \/>\nCourts. As against this the contention of the<br \/>\nlearned counsel for the respondent is that the<br \/>\npetitioner being in know of the entire facts has not<br \/>\nmade a whisper about the lack of jurisdiction of the<br \/>\ntrial court in its written statement and has quitely<br \/>\nsubmitted to the jurisdiction of the Delhi Court<br \/>\nthough contesting the suit on various grounds, cannot<br \/>\nbe allowed to raise any objection about the<br \/>\nterritorial jurisdiction of the Court.\n<\/p>\n<p>4. I have given my thoughtful<br \/>\nconsideration to the submissions put forward on<br \/>\nbehalf of the parties. There is no denial of the<br \/>\nlegal position that the power to allow amendment is<br \/>\nwide and can be exercised at any stage of the<br \/>\nproceedings in the interest of justice based on the<br \/>\nguide-lines laid down by the Hon&#8217;ble Supreme Court<br \/>\nand various High Courts and that the Court has to<br \/>\nadopt a liberal approach while dealing with such<br \/>\napplications but at the same time it is also well<br \/>\nsettled that a party cannot be allowed to withdraw<br \/>\nthe admissions of facts made by it in its pleadings<br \/>\nby making amendment to the pleadings. In the case in<br \/>\nhand it would be noticed the plaintiff in para 10 of<br \/>\nthe plaint had categorically averred as under:-\n<\/p>\n<p>  &#8220;10. That this Hon&#8217;ble Court has<br \/>\njurisdiction to try the present<br \/>\nsuit as the cause of action<br \/>\narose at Delhi, the defendant<br \/>\nNo. 1 was appointed as a dealer<br \/>\nin Delhi, material was supplied<br \/>\nat ex Delhi prices, the part<br \/>\npayments had been made by the<br \/>\nDefendants to the Plaintiffs at<br \/>\nDelhi. As such this Hon&#8217;ble<br \/>\nCourt has jurisdiction to try<br \/>\nthe suit.&#8221;\n<\/p>\n<p>5. The petitioner-defendant in its written<br \/>\nstatement has not even vaguely denied the contents of<br \/>\nthe said paragraph of the plaint. The written<br \/>\nstatement deals paragraphs up to serial No. 7 of the<br \/>\nplaint and does not deal with any further paragraphs.<br \/>\nThis would clearly show that the petitioner-defendant<br \/>\nhad in unequivocal terms admitted the facts averred<br \/>\nin paragraph 10 of the plaint which categorically<br \/>\nstate that the cause of action for the suit has<br \/>\narisen at Delhi and the Delhi Courts have<br \/>\njurisdiction to try this suit. On the face of this<br \/>\nposition permitting the petitioner to raise an<br \/>\nobjection about the territorial jurisdiction would<br \/>\nclearly amount to withdrawal of admission of facts<br \/>\nmade by the petitioner-defendant in its written<br \/>\nstatement, such a course is not legally permissible.\n<\/p>\n<p>6. It was next urged by the learned<br \/>\ncounsel for the petitioner that in view of provisions<br \/>\ncontained under Sub-section (1) of Section 21 CPC the<br \/>\nprayer for amendment cannot be said to be a belated<br \/>\none because the issues are yet to be framed in the<br \/>\ncase. It is true that the suit is still at a<br \/>\npreliminary stage and issues are yet to be framed in<br \/>\nthe case but that by itself is not sufficient to<br \/>\npermit the petitioner to amend the written statement<br \/>\nso as to incorporate the said plea with regard to the<br \/>\njurisdiction.\n<\/p>\n<p>7. Learned counsel for the petitioner has<br \/>\nthen urged that the plea that the trial court has<br \/>\nthough allowed the petitioner to incorporate the<br \/>\npleas raised in paragraph 5(a) of the written<br \/>\nstatement, the petitioner is, therefore, entitled to<br \/>\nraise the objection with regard to jurisdiction. I,<br \/>\nhowever, see no merit in this contention also.\n<\/p>\n<p>8. Having considered the matter this Court<br \/>\nis of the considered opinion that the learned trial<br \/>\ncourt was justified in declining permission to the<br \/>\npetitioner to raise the objection\/plea with regard to<br \/>\nthe lack of territorial jurisdiction once such a plea<br \/>\nwas not raised at the earliest stage and the<br \/>\npetitioner-defendant having not disputed the same on<br \/>\nany ground in the written statement and having<br \/>\nsubmitted to the jurisdiction of Delhi Court.
