Justice ANTONY DOMINIC\n\n Dated :13\/10\/2010\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 31374 OF 2010 (V)\n                 =====================\n\n           Dated this the 13th day of October, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>      Petitioner complains of illegal sand mining in Irupazhanji<\/p>\n<p>puzha in Karassery Panchayat in Calicut District. According to the<\/p>\n<p>petitioner, despite the fact that the sand mining is illegal, mining<\/p>\n<p>is going on without any action being taken by the statutory<\/p>\n<p>authorities. It is stated that if said sand mining is allowed to<\/p>\n<p>continue, the lateral support of the property of the petitioner will<\/p>\n<p>be lost and her residential house will collapse.<\/p>\n<p>      2.    If as stated by the petitioner, sand mining in the river<\/p>\n<p>in question is unauthorised, obviously it is the duty of the<\/p>\n<p>respondents to prevent the same. Now that the petitioner and<\/p>\n<p>others have filed Ext.P3 complaint before the 1st respondent and<\/p>\n<p>another complaint before respondents 4 and 5, it is directed that<\/p>\n<p>the aforesaid respondents, particularly respondents 4 and 5, shall<\/p>\n<p>take appropriate action, if necessary, availing of the assistance of<\/p>\n<p>the 6th respondent to prevent such illegal sand mining.<\/p>\n<p>      3.
