Your Lordships will be pleased to admit the \tpresent petition.\n<\/p>\n<p>b.\tYour<br \/>\nLordships will be pleased to issue a writ \tof mandamus or writ in the<br \/>\nnature of mandamus or \tany other appropriate writ order or direction<br \/>\n\tfor quashing and setting aside the Order dated \t20.10.2005 passed by<br \/>\nCivil Judge (S.D) at \tVadodara in Special Civil Suit No. 269 of 1990.\n<\/p>\n<p>Pending<br \/>\n\tthe admission, hearing and final disposal of \tthe petition, by way<br \/>\n\tof interim relief, your lordships will be pleased to issue a writ of<br \/>\n\tmandamus or writ in the nature of mandamus or \tany other appropriate<br \/>\n\twrit order or direction, staying and implementing the order dated<br \/>\n\t20.10.2005 passed by the Civil Judge (S.D) in \tSpecial Civil Suit<br \/>\n\tNo.269 of 1990.\n<\/p>\n<p>Your<br \/>\n\tLordships will be pleased to issue a writ of mandamus or writ in the<br \/>\n\tnature of mandamus or any other appropriate writ order or direction<br \/>\n\tdirecting the stay of further proceedings of Special Civil Suit No.<br \/>\n\t269 of 1990 pending before the Hon&#8217;ble Civil Judge (S.D) at<br \/>\n\tVadodara.\n<\/p>\n<p>e.\tAny<br \/>\nother and further reliefs that may be deemed \tjust and expedient in<br \/>\nview of the facts and \tcircumstances of the case be granted.&#8221;\n<\/p>\n<p>2.\tThe<br \/>\nfacts arising out of this petition are as under :\n<\/p>\n<p>3.\tThat<br \/>\nthe respondents herein filed  Special Civil Suit No. 269 of 1990<br \/>\nagainst the present petitioners for recovery of Rs.38,03,248\/- on<br \/>\naccount of breach of contract arising from agreement No. B-2\/9 of<br \/>\n1976-1977. The petitioners appeared before the Trial Court and filed<br \/>\ntheir written statement and by an application (Exh. 25) prayed for<br \/>\nstay of the said suit under section 10 of the Code of Civil<br \/>\nProcedure, on the ground that the judgment and decree passed in<br \/>\nSpecial Civil Suit No.  135 of 1981 was the subject matter of First<br \/>\nAppeals No. 1866 of 1985 preferred by the State of Gujarat and First<br \/>\nAppeal No. 1867 of 1985 preferred by the petitioners. It was<br \/>\ncontended that the said two appeals have been admitted by this Court<br \/>\nand are pending for final adjudication, hence  the proceedings of<br \/>\nSpecial Civil Suit No. 269 of 1990 deserve to be stayed.\n<\/p>\n<p>4.\tThe<br \/>\nTrial Court vide order dated 20.10.2000 dismissed the said<br \/>\napplication mainly on the ground that the facts and claims of the<br \/>\nsuit and the earlier suit were quite different from each other  and<br \/>\neven parties were not identical.\n<\/p>\n<p>5.\tBeing<br \/>\naggrieved by the same, the petitioners-original defendants preferred<br \/>\nthis petition which was admitted by this Hon&#8217;ble Court by order dated<br \/>\n7.3.2007 in paragraph no.5 of the said order, this Court observed as<br \/>\nunder :\n<\/p>\n<p>&#8220;5.\tMeanwhile<br \/>\nthe learned trial Judge is requested to hear Civil Suit No. 269 of<br \/>\n1990. However, the learned trial Judge may not pass the final decree<br \/>\ntill this Court passes any order. As soon as the arguments are<br \/>\ncompleted, the learned Judge may report to this Court.&#8221;\n<\/p>\n<p>6.\tIn<br \/>\nview of the fact, that we have dismissed both the appeals i.e. First<br \/>\nAppeals No. 1866 of 1985 and 1867 of 1985 by a separate judgment<br \/>\ntoday. Nothing further requires to be done in the present matter. The<br \/>\npetition is therefore disposed of and the Trial Court is directed to<br \/>\nproceed with Special Civil Suit No. 269 of 1990 in accordance with<br \/>\nlaw and decide the same on its own merits.\n<\/p>\n<p>7.\tIn<br \/>\nthe result, Rule is discharged.
