On undergoing<\/p>\n<p>aortic angiography on 10.4.2006, the petitioner was found with<\/p>\n<p>anamalous origin arising from right brachio-cephalic artery.<\/p>\n<p>Looking to the serious condition, the petitioner was taken for<\/p>\n<p>further treatment to Escort Heart Institute and Research Centre,<\/p>\n<p>New Delhi.\n<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>        Necessary arterial vascular intervention was required to<\/p>\n<p>be made on 21.4.2006, but that was not done looking to severe<\/p>\n<p>collapse in petitioner&#8217;s blood pressure. Ultimately, that was made<\/p>\n<p>on 3.5.2006. For undergoing the treatment aforesaid, the<\/p>\n<p>petitioner had expenditure in a tune of Rs.4,36,112.92\/-.<\/p>\n<p>        An application then was submitted by the petitioner to<\/p>\n<p>the competent authority, as per the provisions of the Rajasthan<\/p>\n<p>Civil Services (Medical Attendance) Rules, 1970 (for short &#8216;the<\/p>\n<p>Rules of 1970&#8217; hereinafter) for reimbursement of the expenses<\/p>\n<p>incurred in the treatment aforesaid.       No reimbursement as<\/p>\n<p>claimed was made, thus, this petition for writ.<\/p>\n<p>        As per learned counsel for the petitioner,   Escort Heart<\/p>\n<p>Institute and Research Centre, New Delhi is an enlisted hospital<\/p>\n<p>with Appendix-XI attached to the Rules of 1970 and therefore,<\/p>\n<p>the entire reimbursement of medical expenses claimed for<\/p>\n<p>should have been made.\n<\/p>\n<\/p>\n<p>        A reply to the writ petition has been filed on behalf of<\/p>\n<p>the respondents with assertion that the treatment availed by the<\/p>\n<p>petitioner was available at Sawai Mansingh Hospital, Jaipur,<\/p>\n<p>therefore, no amount in excess to the amount that would have<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>been incurred in undergoing same treatment at Sawai Mansingh<\/p>\n<p>Hospital, Jaipur can be reimbursed. It is also stated that under a<\/p>\n<p>letter dated 18.10.2007, the Executive Engineer, Public Works<\/p>\n<p>Department, Sindhari Division, District Barmer instructed the<\/p>\n<p>petitioner to furnish an undertaking to bear the         expenses in<\/p>\n<p>excess to the amount that could have been incurred in going the<\/p>\n<p>treatment at Sawai Mansingh Hospital, Jaipur by himself, but no<\/p>\n<p>such undertaking was furnished and therefore, no amount for<\/p>\n<p>medical attendance as per the Rules of 1970 is released.<\/p>\n<p>           Heard learned counsel for the parties.\n<\/p>\n<p>           The petitioner while working in Barmer        district, was<\/p>\n<p>brought to Escort Goyal Heart Centre, Jodhpur on being suffered<\/p>\n<p>with acute chest pain. At the hospital aforesaid he was advised<\/p>\n<p>to undergo necessary treatment at Escort Heart Institute and<\/p>\n<p>Research Centre, New Delhi. At the institution aforesaid, he also<\/p>\n<p>undergone necessary treatment. There is also no dispute about<\/p>\n<p>the expenses incurred in the treatment concerned. The only<\/p>\n<p>objection of the respondents is that the petitioner could have<\/p>\n<p>availed this treatment at Sawai Mansingh Hospital, Jaipur. Under<\/p>\n<p>the Scheme of the Rules of 1970, a Government servant is<\/p>\n<p>entitled    for   reimbursement   of   entire   amount   of   medical<\/p>\n<p>expenses, if he has undergone treatment at an enlisted Hospital.<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>          True it is, that by certain circulars, the Government has<\/p>\n<p>given priority to the Government Hospital for undergoing such<\/p>\n<p>treatment, but that in no manner curtails right accrued to the<\/p>\n<p>Government servant under the statute.          The petitioner has<\/p>\n<p>undergone Cardio Vascular treatment at Escort Heart Institute<\/p>\n<p>and Research Centre, New Delhi, an hospital enlisted with<\/p>\n<p>Appendix-XI attached to the Rules of 1970. The respondents, as<\/p>\n<p>a matter of fact, had no authority to instruct the petitioner to<\/p>\n<p>furnish the undertaking as desired under the letter dated<\/p>\n<p>18.10.2007. Seeking of such an undertaking is contrary to the<\/p>\n<p>spirits and objects of the Rules of 1970.\n<\/p>\n<\/p>\n<p>          Beside the above, from the facts averred it would reveal<\/p>\n<p>the need for urgent treatment to the petitioner. A person<\/p>\n<p>suffering from life threat would not waste time to make choice<\/p>\n<p>between the hospital, but to avail the treatment, whichever is<\/p>\n<p>advised    to him by treating experts. In the instant matter, an<\/p>\n<p>advise was given by treating medical experts to the petitioner to<\/p>\n<p>undergo treatment at Escort Heart Institute and Research<\/p>\n<p>Centre, New Delhi, a hospital enlisted under Appendix-XI and<\/p>\n<p>that was adhered by him.        In such circumstances, the non-<\/p>\n<p>reimbursement of the amount of the expenses incurred is not<\/p>\n<p>proper.\n<\/p>\n<p><span class=\"hidden_text\">                                        5<\/span><\/p>\n<p>              Accordingly,   the   petition   for   writ   is   allowed.   The<\/p>\n<p>      respondents are directed to make payment of the entire amount<\/p>\n<p>      i.e. in a tune of Rs.4,36,112.92\/- of the expenses incurred by<\/p>\n<p>      the petitioner in undergoing treatment at Escort Heart Institute<\/p>\n<p>      and Research Centre, New Delhi.
