No.3181 of 2009\n           ------------------------------------------------\n          Dated this the 30th day of January, 2009\n\n                          JUDGMENT\n<\/pre>\n<p>      Heard the counsel for the petitioner.<\/p>\n<p>    2. The petitioner is the plaintiff in<\/p>\n<p>O.S.79\/06 on the file of the Sub Court, Pala.<\/p>\n<p>The suit was one for recovery of damages to<\/p>\n<p>the   tune      of         Rs.5,12,500\/-                   from  the<\/p>\n<p>respondents. When the suit came up for trial<\/p>\n<p>in the list, plaintiff did not appear and his<\/p>\n<p>counsel reported no instructions. Consequently,<\/p>\n<p>the   court    below          dismissed             the     suit.  A<\/p>\n<p>restoration petition was filed and it was<\/p>\n<p>allowed by the court below vide Ext.P4 order<\/p>\n<p>on condition of the petitioner paying cost of<\/p>\n<p>Rs.5,000\/- directly to the respondents and<\/p>\n<p>producing receipt within fifteen days.<\/p>\n<p>    3. The grievance of the petitioner is<\/p>\n<p>that the suit itself was instituted as an<\/p>\n<p>indigent person and the petitioner is unable<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.3181 of 2009            -2-<\/span><\/p>\n<p>        to     pay      cost of   Rs.5,000\/-   which is  an<\/p>\n<p>        exorbitant amount as far as he is concerned<\/p>\n<p>        and that inasmuch as such a condition is<\/p>\n<p>        attached         to  the   order    allowing  Ext.P3<\/p>\n<p>        restoration        application,  it  tantamounts  to<\/p>\n<p>        dismissal of the restoration petition.<\/p>\n<p>               4. The petitioner who has not appeared<\/p>\n<p>        when      the    suit  was   in   the  list and  no<\/p>\n<p>        instruction        also  was   given to  his  lawyer<\/p>\n<p>        either for conduct of the case or to report<\/p>\n<p>        before court as to why he is absent, the<\/p>\n<p>        attempt of the petitioner\/plaintiff cannot but<\/p>\n<p>        be taken as an attempt to get the trial of the<\/p>\n<p>        suit      adjourned.    The   petitioner  cannot be<\/p>\n<p>        allowed to have the suit restored without<\/p>\n<p>        payment of any cost to the respondents though<\/p>\n<p>        however, I am of the view that Rs.5,000\/-<\/p>\n<p>        ordered as cost is excessive.\n<\/p>\n<p>               5. In the result, I reduce the amount of<\/p>\n<p>        cost from Rs.5,000\/- to Rs.1,500\/- and grant<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.3181 of 2009        -3-<\/span><\/p>\n<p>        one week&#8217;s time to pay the cost and produce<\/p>\n<p>        receipt in the court below. On no ground will<\/p>\n<p>        any further extension or enlargement of time<\/p>\n<p>        be granted for deposit of the said amount. The<\/p>\n<p>        petitioner is directed to produce a copy of<\/p>\n<p>        this judgment in the court below forthwith<\/p>\n<p>        with notice to the counsel for the defendant<\/p>\n<p>        in the court below as this Writ Petition is<\/p>\n<p>        being       disposed of without notice   to  the<\/p>\n<p>        respondents.\n<\/p>\n<p>               6.
