Akram, S\/O- Sri Haque Ullah,\nRespondent :- C\/M Hobert Trilok Nath Inter College, Tanda, &amp; Others\nPetitioner Counsel :- K.K.Singh\nRespondent Counsel :- C.S.C.,N B Singh,Raj Priya Srivastava,Sanjay\nKumar Srivastava\n\nHon'ble Rajiv Sharma,J.\n<\/pre>\n<p>Heard learned Counsel for the petitioner and learned Standing Counsel.\n<\/p>\n<p>Petitioner while working on the post of Parichar was placed under<br \/>\nsuspension vide order dated 9.9.2009. Feeling aggrieved, he preferred<br \/>\nthe instant writ petition alleging therein the mala fide against opposite<br \/>\nparties No. 4 and 5 and arrayed them as such. Charge-sheet was also<br \/>\nserved upon him and the inquiry officer was also appointed on the same<br \/>\ndate i.e. 9.9.2009.\n<\/p>\n<p>During the pendency of the instant writ petition, the inquiry officer<br \/>\nconducted the enquiry and has submitted report and as such, by means<br \/>\nof amendment, the petitioner has also assailed the report so submitted<br \/>\nby the inquiry officer. The order of suspension was also approved by<br \/>\nthe District Inspector of School vide letter dated 7.11.2009.\n<\/p>\n<p>On perusal of the inquiry report, it reflects that inspite of several<br \/>\nopportunity being afforded to the petitioner, he has neither turned up<br \/>\nbefore the Inquiry Officer nor filed any report to the charges so levelled<br \/>\nand as such, inquiry officer has submitted the report ex parte to the<br \/>\ncompetent authority for appropriate orders.\n<\/p>\n<p>Learned Counsel for the petitioner was required to state as to whether<br \/>\nany cognizance has been taken on the said inquiry report or not but he<br \/>\nfails to answer the said query.\n<\/p>\n<p>At this stage, learned Counsel for the petitioner submits that interest of<br \/>\njustice would suffice, if the competent authority is directed to pass<br \/>\nappropriate order in accordance with law, expeditiously, to which<br \/>\nlearned Standing Counsel has no objection.\n<\/p>\n<p> Considering the peculiar facts and circumstances of the case as also<br \/>\nwithout entering into the merits of the case, the writ petition is disposed<br \/>\nof finally with a direction to the competent authority to pass appropriate<br \/>\norder, in accordance with, expeditiously, say, within a period of three<br \/>\nmonths from the date of receipt of a certified copy of this order. It is also<br \/>\nprovided that if the petitioner was entitled to pay suspension allowance<br \/>\nin accordance with law and the same has not been paid till date, the<br \/>\nauthority concerned is directed to pay the suspension allowance to the<br \/>\npetitioner in accordance with law, expeditiously.\n<\/p>\n<p>Order Date :- 10.8.2010<br \/>\nAjit\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Syed Mohd.
