O11.yl\u20ac\u00a7c(:oun\"t:-._of'-the__said~.._ 4_j\n\ninjuries sustained the clayimant. llfi.led  \npetition claiming a total   On\nservice of notice bet'ore;:--..the  respondent.<\/pre>\n
Insurance Company of objections and
\ncontended  responsible for the
\na(:cide11.\u00a31VVtll    contributed to the accident
\nto an elxtelnt ‘(it’ll  accord1’11\u00a7\u00a7l)\/ lontended that<\/p>\n
I’\u20acSpQI.1lCl\ufb013.l1l. No.2 is not liable to pay compensation. The first<\/p>\n
respondeA11t.4ow11er of the vehicle in question had remained<\/p>\n
eX?p.a1″te.\u00abl”_’-._Th;e”‘.Tribunal on considering the evidence on<\/p>\n
V . recorcl  pleadings by its judgment a.nd award dated<\/p>\n
  has held that accident in question had occurred<\/p>\n
—  on account of driver of the oflending vehicle and claimant<\/p>\n
was not responsible for the same and awarded a
\ncornpensation of Rs.35.OOO\/M under the following heads:<\/p>\n
1. Pain and sufferings Rs.\n<\/p>\n
2. Medical Expenses  ”   b <\/p>\n

theappellant S.Srishaila._ learned counsel for the<\/p>\n
 resplendent-.I-Noticte to R1 has been dispensed with by this<\/p>\n
 by:lo\u00bbr_d’e,r’Jdateci 28-1-2010 as he had been placed ex<\/p>\n
-V part\u00e9e belforelllthe Court below.<\/p>\n
‘  the following points arise for my consideration:<\/p>\n
is  Having heard the learned counsel for the parties.<\/p>\n
a\u00bb<\/p>\n
{i) Whether the compensatiori awarded by the
\nTribunal is just: and reasonable or whether it
\nrequires modification\/enhanceme1c1t?x’=_:i’f._  to<\/p>\n
what extent’?\n<\/p>\n
{ii} To What. order’?\n<\/p>\n
6. Having heard the learned:~coiJn’Sel,fo-rltheyparties”–<\/p>\n
and having perused the judgrr__ient,”
\nobserved that as per l$x.P.8  the claimant
\nhad been admitted to  for a period of
\ntwo days whichvhuas  in the discharge<\/p>\n
stimmary _EI>{.’l3.;9..__V’Fro:n’the.wound certificate it is seen that
\npetitioneruhas sLivstai;ried”~–o’ne grievous injury and no doctor<\/p>\n
hasl;\u00a7een.eXan’iin_e’d’ tovsay that on account of such injury the<\/p>\n
t:ia.irhar_it:has\u00ab–._sL1’l’i’ercd any permanent disability. it is only<\/p>\n
the’Sayof”_t;he~ciaimant that on account of the said injury his<\/p>\n
. movements’ are restricted which has resulted in reduction of<\/p>\n
 vi.hisvcsearri”1ng capacity. Considering the nature of injury as<\/p>\n
-‘ ir1 EXIPK8 and also the medical bills produced<\/p>\n
“co11.ect,i”vely at \u00a7x.P.lO. I am of the view that. the<\/p>\n

compensation awarded under the head pain and suffering is
\nrequired to be enhanced marginally by awarding
\nRs.l0,000\/– in addition to what has been  the<\/p>\n
Tribunal. Accordingly it is so awarded.<\/p>\n
7. Admittedly the c:laiman’t”‘was& for <\/p>\n
about two days in Kaveri Nursing :i*_l_ori1_e.  has:i:.s–~of”the
\ndischarge summary certificate=,\u20acx..P.9.  awarded
\nmedical expenses at –‘  is onthe lower side<\/p>\n
since the injury sustainedhfi\ufb01g g1fVi”eirj(3.a,;s in nature and<\/p>\n
conside1*iir’1g.,yythe ri’a;t’11rc.\u00bb0f ii1jur*y”‘a11d also the medical bills
\nproduced at  also requires to be enhanced<\/p>\n
by grantlnlg”–\u00abaddditio_nalssurn of Rs.2,500\/- and accordingly an<\/p>\n
  suArn’vef~’Rs.2,5OO\/\u00bb under the head medical<\/p>\n
Lexplense-s_”is”awarded. Since the claimant, was an inpatient<\/p>\n
for  days and was attended to by his family<\/p>\n
‘V.,mcrnbers’:. under the head food and nourishment. diet<\/p>\n
 and attendant charges a sum of Rs.2,E300\/~ is<\/p>\n
   awarded since no amount was awarded by Tribunal. Thus<\/p>\n
42\/<\/p>\n
the additional amount of Rs.15.O0O\/W is awarded under<\/p>\n
these three headings above referred to. The eiboi\/ef”arr1ouI1t<\/p>\n
awarded was in addition to what has been <\/p>\n
Tribunal. The said enhanced con1pens\u00abati’on_vVsh’-all also carryj <\/p>\n
interest at 6% pa from the datendiof  .,ti1~l_  ‘A<\/p>\n
payment.\n<\/p>\n
8. In Vi\u20acW of th–r\ufb01abo’f(e 1\ufb01_h.e’fo’il.io’wing order is passed:\n<\/p>\n
