Justice M.SASIDHARAN NAMBIAR\n\n Dated :02\/12\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             W.P.(C)No.11833 of 2010 Q\n            --------------------------\n\n                     JUDGMENT\n<\/pre>\n<p>    Petitioner, the mother of deceased Sivanandan,<\/p>\n<p>filed  this   petition   under   Article   226   of<\/p>\n<p>Constitution of   India  for  a  writ  of  mandamus<\/p>\n<p>directing transfer of investigation of Crime No.<\/p>\n<p>119\/2007 of Fort Police Station to a competent<\/p>\n<p>officer  of  CBCID  for  a  proper,  effective  and<\/p>\n<p>expeditious investigation, contending that due to<\/p>\n<p>want of proper investigation, the real culprit<\/p>\n<p>cannot be found out and the investigation is not<\/p>\n<p>satisfactory.\n<\/p>\n<p>    2. Circle Inspector of Police, Fort Police<\/p>\n<p>Station, filed a statement showing the progress of<\/p>\n<p>the   investigation.   As   per   the    statement,<\/p>\n<p>Sivanandan,  who  was  engaged   in  the  sale   of<\/p>\n<p>handicrafts at Krishna Lodge near New Delhi Railway<\/p>\n<p>Station fell unconscious at about 9 p.m. and was<\/p>\n<p>taken  to  Sanjeevani   Hospital,  New  Delhi.   On<\/p>\n<p><span class=\"hidden_text\">WPC 11833\/10              2<\/span><\/p>\n<p>examination, he was found dead. The matter was<\/p>\n<p>reported to Nabikarim Police Station and it was<\/p>\n<p>registered as D.D.No.114 dated 24.2.2007. After<\/p>\n<p>conducting an inquest, body was sent to Moulana<\/p>\n<p>Azad Medical College, New Delhi for autopsy.   After<\/p>\n<p>the autopsy, body was sent to Thiruvananthapuram<\/p>\n<p>for cremation. When it reached Thiruvananthapuram,<\/p>\n<p>relatives of the deceased raised doubt regarding<\/p>\n<p>the cause of death and the matter was reported to<\/p>\n<p>Fort    Police   Station  on  26.2.2007  and   after<\/p>\n<p>recording the statement of Chandran Asari, brother<\/p>\n<p>of the deceased, Crime No.119\/2007 of Fort Police<\/p>\n<p>Station was registered under Section 174 of Code of<\/p>\n<p>Criminal Procedure. An inquest was conducted and<\/p>\n<p>body was sent for re-postmortem examination to<\/p>\n<p>Medical     College  Hospital.  During   postmortem,<\/p>\n<p>viscera     was collected at  Moulana  Azad  Medical<\/p>\n<p>College,     New  Delhi   and  sent   for   chemical<\/p>\n<p>examination. While re-postmortem was conducted at<\/p>\n<p>Thiruvananthapuram also, viscera was collected and<\/p>\n<p><span class=\"hidden_text\">WPC 11833\/10              3<\/span><\/p>\n<p>sent for chemical examination. It is stated that<\/p>\n<p>postmortem certificate from Moulana Azad Medical<\/p>\n<p>College was also obtained and the case is properly<\/p>\n<p>being    investigated  and the  result  of   viscera<\/p>\n<p>examination is awaited.\n<\/p>\n<p>     3. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Government Pleader were heard.<\/p>\n<p>     4. Learned counsel appearing for the petitioner<\/p>\n<p>submitted that as the death was at New Delhi, State<\/p>\n<p>Police cannot properly investigate the case and in<\/p>\n<p>any case, even though the case was registered in<\/p>\n<p>2007,    till  now,  even the  report  of  chemical<\/p>\n<p>analysis, on examination of the viscera collected<\/p>\n<p>at   New    Delhi,   was  not  obtained.   In  such<\/p>\n<p>circumstances, investigation is to be transferred<\/p>\n<p>to CBCID.\n<\/p>\n<p>     5. Learned Government Pleader submitted that<\/p>\n<p>subsequently, report of the chemical examination of<\/p>\n<p>the   viscera  collected  at the  time  of  autopsy<\/p>\n<p>conducted at Thiruvananthapuram was received and a<\/p>\n<p><span class=\"hidden_text\">WPC 11833\/10              4<\/span><\/p>\n<p>final    report  could be   submitted. It   is  also<\/p>\n<p>submitted that chemical examination report of the<\/p>\n<p>viscera collected at the time of first autopsy at<\/p>\n<p>New   Delhi   is   not  so  far   received  by   the<\/p>\n<p>investigating officer. Considering the entire facts<\/p>\n<p>and circumstances of the case, I find that in the<\/p>\n<p>interest    of  justice,  investigation  is  to   be<\/p>\n<p>transferred    to  CBCID  as  sought  for,  for   an<\/p>\n<p>effective and impartial investigation.<\/p>\n<p>     Petition   is  allowed.
