Ltd. through Deepak Singh\n                                             Versus\n                                 The Union of India &amp; Ors\n                                ----------------------------------\n<\/pre>\n<p>03\/   14.11.2011                      Heard learned counsel for the petitioner, learned<\/p>\n<p>                       counsel for the East Central Railway and its authorities (respondent<\/p>\n<p>                       nos.1 to 5) as well as learned counsel for IRCON International and its<\/p>\n<p>                       authority (respondent no.8).\n<\/p>\n<p>                                      This writ petition has been filed by the petitioner for the<\/p>\n<p>                       following reliefs:-\n<\/p>\n<blockquote><p>                                       (i)    For issuance of writ in the nature of Certiorari<br \/>\n                                              for quashing the entire arbitration proceedings<br \/>\n                                              in connection with C.A. No.115\/Misc\/DNR\/03-<br \/>\n                                              04 dated 18.08.2004 having been vitiated on<br \/>\n                                              account of its being constituted, initiated and<br \/>\n                                              conducted de-horse the provisions of the<br \/>\n                                              Arbitration &amp; Conciliation Act,1996 totally<br \/>\n                                              lacking in independence and impartiality and<br \/>\n                                              causing undue and inordinate delay in conduct<br \/>\n                                              of proceedings which has resulted in denial of<br \/>\n                                              fair play in action, lack of transparency and<br \/>\n                                              arbitrariness in conduct of the proceedings,<br \/>\n                                              violation of the principles of Natural Justice,<br \/>\n                                              denial of equal treatment of the parties and<br \/>\n                                              apprehension of reasonable bias by the<br \/>\n                                              petitioner;\n<\/p><\/blockquote>\n<blockquote><p>                                       (ii)   For issuance of an order\/writ\/direction in the<br \/>\n                                              nature of Mandamus directing appointment of<br \/>\n                                              an independent arbitrator for facilitating a fair,<br \/>\n                                              impartial and early resolution of the dispute<br \/>\n                                              inasmuch as the mandate of the arbitrator has<br \/>\n                                              been terminated on account of the Chief<br \/>\n                                              Arbitrator having retired on 31.08.2011 and thus<br \/>\n                                              demitted office.<\/p><\/blockquote>\n<p>                                      Issue notices to respondent nos.6, 7 and 9 under<\/p>\n<p>                       ordinary process as well as under registered cover with A\/D for which<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>         requisites etc. must be filed by the petitioner within one week, failing<\/p>\n<p>         which this writ petition as against them shall stand dismissed without<\/p>\n<p>         further reference to a Bench.\n<\/p>\n<p>                         I.A. No.7559 of 2011 has been filed on behalf of the<\/p>\n<p>         petitioner for amendment of the writ petition by way of adding another<\/p>\n<p>         relief. Considering the claims of the petitioner in this writ petition, the<\/p>\n<p>         said interlocutory application is allowed. Let the following relief be<\/p>\n<p>         added to the reliefs claimed in the writ petition:-<\/p>\n<blockquote><p>                         &#8220;(1)(v)      For      issuance    of     an     appropriate<br \/>\n                                     writ\/order\/direction in the nature of certiorari<br \/>\n                                     quashing the sham award dated 29.08.2011<br \/>\n                                     as communicated to the petitioner on<br \/>\n                                     04.11.2011 which has been manufactured by<br \/>\n                                     the Railway authorities in connivance with<br \/>\n                                     the Arbitrators after filing of the instant writ<br \/>\n                                     petition.&#8221;<\/p><\/blockquote>\n<p>                         Although     learned    counsel    for   the    respondents<\/p>\n<p>         vehemently contests the claim of the petitioner, but considering the<\/p>\n<p>         facts and circumstances of the case, the respondents are restrained<\/p>\n<p>         from taking any consequential action in furtherance of any award<\/p>\n<p>         which has been passed in pursuant to the impugned arbitration<\/p>\n<p>         proceeding, till further orders of this court in that regard.<\/p>\n<pre>Harish                               (S.N.Hussain, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders M\/S Buildworth Pvt.
