Mukherjee, Sr.Advocate<br \/>\n                  For the Zila Parishad: Mr. Nekesh Kumar Advocate<br \/>\n                  For the State:         Mr. Lala S.N.Rai, AC to GP-6.\n<\/p>\n<p>                               &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>2   26.4.2011                   Heard learned Senior counsel for the petitioner and<\/p>\n<p>                learned counsel for the State.\n<\/p>\n<p>                                Annexure-11 which is the order passed by District<\/p>\n<p>                Teachers Employment Appellate Authority, West Champaran is<\/p>\n<p>                under challenge in the present writ application. By virtue of which<\/p>\n<p>                the appointment of the petitioner on the post of teacher in the Zila<\/p>\n<p>                Parishad School has been rejected on the ground that the petitioner<\/p>\n<p>                does not have the requisite degree of matriculation which is<\/p>\n<p>                recognized by the State of Bihar.\n<\/p>\n<p>                                Petitioner is supposed to have acquired Adhikari<\/p>\n<p>                degree which is said to be equivalent to matric from Gurukul<\/p>\n<p>                Kangari, Vishwavidyalaya, Haridwar. The reasoning is sought to<\/p>\n<p>                be assailed by learned Senior counsel because according to him<\/p>\n<p>                she is claiming for appointment to a higher school and not in<\/p>\n<p>                primary school. The relevant notification contained in annexure-7<\/p>\n<p>                dated 27.8.2008 indicates that Vidyalanka and Vedalankar (B.A.)<br \/>\n<span class=\"hidden_text\">                          -2-<\/span><\/p>\n<p>and Vidyawachspati (M.A.) are two degrees which are not<\/p>\n<p>recognizable for such appointment. Since the petitioner is not<\/p>\n<p>claiming appointment on the basis of any of these two degrees<\/p>\n<p>obtained by her from Gurukul Kangari, therefore she cannot be<\/p>\n<p>denied the benefit of appointment.\n<\/p>\n<p>                Petitioner has herself brought on record annexure-<\/p>\n<p>7\/A. This is also a notification in which the list of non-recognized<\/p>\n<p>institutions has been notified by the Department of Human<\/p>\n<p>Resources Development. This notification is dated 25.8.2008. In<\/p>\n<p>this notification the name of the institution i.e. Gurukul Kangari<\/p>\n<p>figures and it talks about two degrees which are Adhikari (Matric)<\/p>\n<p>and Vidyavinit (Intermediate).\n<\/p>\n<p>                Submission of learned Senior counsel is that this<\/p>\n<p>notification would apply to primary teachers and would not apply<\/p>\n<p>to higher secondary teachers.\n<\/p>\n<p>                The fallacy of such a submission is evident from<\/p>\n<p>the record itself that if a person is not eligible to be appointed on<\/p>\n<p>the post of primary teacher based on matriculation certificate<\/p>\n<p>obtained from Gurukul Kangari Vishwavidalaya, wherefrom the<\/p>\n<p>petitioner has acquired matriculation certificate and if she has<\/p>\n<p>obtained higher degree from other institution then that by itself<\/p>\n<p>does not take away the basic infirmity in the decision with regard<\/p>\n<p>to her degree because the petitioner obviously has drawn<\/p>\n<p>advantage of higher degree without the authorities knowing as to<\/p>\n<p>the true status of matriculation certificate.<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>                      The State of Bihar notified two notifications and<\/p>\n<p>      has made it clear that none of the degrees which may be equivalent<\/p>\n<p>      to Matriculation, Intermediate, Graduation or M.A. are acceptable<\/p>\n<p>      degrees if obtained from the so called institution what is known as<\/p>\n<p>      Gurukul Kangari for appointment on the post of teacher in the<\/p>\n<p>      State of Bihar at primary level or secondary level.
