Tekrimal, G.A.1\n\n\n4   20.12.2010<\/pre>\n<p>                 Heard the parties.\n<\/p>\n<p>                               Learned counsel for the petitioner has placed<\/p>\n<p>                     reliance on Annexure 4 and has submitted that the main<\/p>\n<p>                     grievance of the villagers has been articulated by the Mukhia<\/p>\n<p>                     in Annexure 4, according to which one Narayan Sah, son of<\/p>\n<p>                     late Muneshwar Sah has encroached upon public land which is<\/p>\n<p>                     obstructing construction of a road leading to cremation<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>ground.\n<\/p>\n<p>           On behalf of the State, reliance has been placed<\/p>\n<p>upon statement made in Paragraph 5 of the counter affidavit,<\/p>\n<p>according to which although Khasra No.4080 (old) and 8049<\/p>\n<p>(new) which is the concerned land, has been declared as<\/p>\n<p>&#8220;Anabad Bihar Sarkar&#8221; but against such entery, Narayan Sah<\/p>\n<p>has filed survey case No.618\/2006 before the Survey<\/p>\n<p>Settlement Officer, Darbhanga which is pending and,<\/p>\n<p>therefore, the authorities do not feel justified in treating the<\/p>\n<p>possession of Narayan Sah as that of an encroacher and in<\/p>\n<p>taking steps for his removal.\n<\/p>\n<p>           It would not be proper for this Court to venture into<\/p>\n<p>relevant issues of facts in writ petition filed as PIL.
