No.374 of 2006\n                   SHAKIL AHMAD\n                       Versus\n               SAIDA KHATOON &amp; ORS\n                      -----------\n<\/pre>\n<p>5   4.7.2008              Heard Counsel for the parties.<\/p>\n<p>                          The petitioner, defendant in the suit,<\/p>\n<p>               is aggrieved by an order dated 10.1.2006<\/p>\n<p>               whereby and whereunder his prayer for filing of<\/p>\n<p>               a written statement came to be rejected on the<\/p>\n<p>               ground that he had no adverse interest to the<\/p>\n<p>               plaintiff and that such an effort to file written<\/p>\n<p>               statement was wholly belated.\n<\/p>\n<p>                          Counsel    for    the    petitioner    with<\/p>\n<p>               reference to the peculiar facts of this case would<\/p>\n<p>               contend that though it is true that the suit was<\/p>\n<p>               filed in the year 1990 but a compromise was<\/p>\n<p>               sought to be effected in the year 1991 and thus<\/p>\n<p>               initially, the defendant\/petitioner was not even<\/p>\n<p>               required to file a written statement but as<\/p>\n<p>               certain development and events had taken place<\/p>\n<p>               subsequently   due    to    which    not   only    the<\/p>\n<p>               proposed compromise could not be effected but<\/p>\n<p>               even defendant no.7 had to be transposed as a<\/p>\n<p>               plaintiff and there was no written statement<\/p>\n<p>               even on behalf of the defendant no.7, it was<\/p>\n<p>               found necessary by the petitioner to make such<br \/>\n<span class=\"hidden_text\">               2<\/span><\/p>\n<p>prayer for filing written statement on his behalf<\/p>\n<p>who is the defendant no.1 to the suit.<\/p>\n<p>              On the other hand, Counsel for the<\/p>\n<p>opposite party, the contesting defendant 2<\/p>\n<p>submits that the whole purpose of the petitioner<\/p>\n<p>of   filing        a    written       statement        by    the<\/p>\n<p>defendant\/petitioner            is    only      to   delay   the<\/p>\n<p>disposal      of       the     suit       inasmuch     as    the<\/p>\n<p>compromise effected between him and the<\/p>\n<p>transposed plaintiff as well as the original<\/p>\n<p>plaintiff is an admitted fact and in fact the<\/p>\n<p>plaintiff and the petitioner defendant no.1 are<\/p>\n<p>sailing in the same boat and therefore, no<\/p>\n<p>prejudice              would         be     caused     to    the<\/p>\n<p>defendant\/petitioner if he is not allowed, now to<\/p>\n<p>file written statement at such a belated stage i.e.<\/p>\n<p>after eighteen years of filing of the suit.<\/p>\n<p>              In       reply    to        the   aforementioned<\/p>\n<p>submissions, the Counsel for the petitioner<\/p>\n<p>defendant no.1 has submitted that under the<\/p>\n<p>changed scenario when the compromise could<\/p>\n<p>not be effected due to the resistance of the<\/p>\n<p>contesting defendant no.2, the defendant no.1<\/p>\n<p>should be shut out from explaining his stand by<\/p>\n<p>filing his written statement and that he is<br \/>\n<span class=\"hidden_text\">            3<\/span><\/p>\n<p>prepared to compensate the defendant no.2 for<\/p>\n<p>the delay and inconvenience caused as held by<\/p>\n<p>the Apex Court in the case of Kailash Vs.<\/p>\n<p>Nanhku reported in AIR 2005 SC 2441.<\/p>\n<p>            Having taken into consideration, the<\/p>\n<p>peculiar facts of this case and the different<\/p>\n<p>stages under which the litigation in the suit has<\/p>\n<p>undergone wherein at one stage, it was sought<\/p>\n<p>to be even compromised between the parties<\/p>\n<p>and in fact such compromise had filed, this<\/p>\n<p>Court in the interest of justice would allow the<\/p>\n<p>petitioner to file his written       statement    in<\/p>\n<p>capacity of the defendant no.1 to the suit<\/p>\n<p>specially when there are two sets of defendants<\/p>\n<p>contesting the suit and there is no written<\/p>\n<p>statement on behalf of one of such sets<\/p>\n<p>represented by the petitioner, the defendant<\/p>\n<p>no.1. In that view of the matter, this Court<\/p>\n<p>would set aside the order of the Court below and<\/p>\n<p>direct   that   the   written   statement   of   the<\/p>\n<p>defendant no.1 be taken on record if filed within<\/p>\n<p>a period of one month from the date of<\/p>\n<p>receipt\/production of a copy of this order on a<\/p>\n<p>payment of a cost of Rs. 20,000\/- (twenty<\/p>\n<p>thousands) is paid by the defendant no.1 to the<br \/>\n<span class=\"hidden_text\">                  4<\/span><\/p>\n<p>      contesting defendant no.2 to compensate the<\/p>\n<p>      loss for delay and inconvenience caused to him<\/p>\n<p>      for a period of nearly seventeen years from the<\/p>\n<p>      date of filing of his written statement.<\/p>\n<p>                  Accordingly,      this   civil   revision<\/p>\n<p>      application is disposed of.\n<\/p>\n<\/p>\n<pre>Rsh                              (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Shakil Ahmad vs Saida Khatoon &amp;Amp; Ors on 4 July, 2008 IN THE HIGH COURT OF JUDICATURE AT PATNA C.R.
