JUSTICE R.M. DOSHIT)<\/p>\n<p>\tThis Appeal,<br \/>\npreferred under clause 15 of the Letters Patent, arises from the<br \/>\njudgment and order dated 3rd May, 2006 passed by the<br \/>\nlearned Single Judge in above Special Civil Application NO. 930 of<br \/>\n2000. The appellant-delinquent was, at the relevant time, employed as<br \/>\nAuxiliary Nurse Midwife under the respondent-Vadodara District<br \/>\nPanchayat [hereinafter referred to as,  the Panchayat ].<br \/>\nA disciplinary proceeding was initiated against the appellant in<br \/>\nrespect of falsification of record and for recovery of motivation<br \/>\nmoney and transport expenses in the family planning camps held in the<br \/>\nmonths of March, 1988 and December, 1988.  It was alleged that some<br \/>\nof the women allegedly motivated by the appellant were non-existing<br \/>\npersons. After holding due inquiry, by Order dated 15th<br \/>\nApril, 1995 made by the Chief District Health Officer, Vadodara, the<br \/>\nappellant was held guilty and was ordered to be compulsorily retired<br \/>\nfrom service. That order was challenged before the Gujarat Civil<br \/>\nServices Tribunal, Ahmedabad [hereinafter referred to as,  the<br \/>\nTribunal ]. The Tribunal, by its order dated 17th<br \/>\nSeptember, 1999 upset the finding of guilt recorded against the<br \/>\nappellant and set-aside the order of punishment. Feeling<br \/>\naggrieved, the Panchayat preferred above Special Civil Application No<br \/>\n930 of 2000 before this Court. The petition has been allowed by the<br \/>\nlearned Single Judge. The Order of the Tribunal is set-aside<br \/>\nand the order of punishment imposed upon the appellant has been<br \/>\nconfirmed. Therefore, the present Appeal.\n<\/p>\n<p>\tWe have heard<br \/>\nthe learned advocate extensively. No case for interference is made<br \/>\nout. The Appeal is dismissed in limine.
