Justice S.S.SATHEESACHANDRAN\n\n Dated :05\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No. 32118 OF 2007\n           --------------------------\n      Dated this the 5th day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The   Writ  petition   is  filed   by  the<\/p>\n<p>plaintiff in a suit for partition against an order<\/p>\n<p>passed  on  their  application  to  determine   the<\/p>\n<p>availability of the properties for partition in<\/p>\n<p>view of the objections raised by some of the<\/p>\n<p>defendants that suit property is not available for<\/p>\n<p>partition, by appointing an advocate commission.<\/p>\n<p>Such  an  application  was  moved  even  before   a<\/p>\n<p>preliminary  decree   was   passed  in   the   suit<\/p>\n<p>determining the rights of the parties over the suit<\/p>\n<p>property scheduled in the plaint.      The learned<\/p>\n<p>Munsiff  after   considering  the   merit  of   the<\/p>\n<p>application   dismissed   it   by   Ext.P5   order.<\/p>\n<p>Propriety  and   correctness  of   that  order   is<\/p>\n<p>W.P.(C).No. 32118 OF 2009<\/p>\n<p>impeached     in    the  writ  petition  invoking   the<\/p>\n<p>supervisory jurisdiction vested with this court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>          2.     I heard the learned counsel for the<\/p>\n<p>petitioner and also the 10th respondent.        Learned<\/p>\n<p>counsel for the petitioner submitted that, in view<\/p>\n<p>of the contentions raised by some of the defendants<\/p>\n<p>in the suit that the property sought for partition<\/p>\n<p>is covered by a mortgage holding the application<\/p>\n<p>for commission was filed to determine and exclude<\/p>\n<p>that mortgage holding so as to proceed with the<\/p>\n<p>suit in respect of the       rest of the property.   So<\/p>\n<p>much    so,    the   application  for  commission   for<\/p>\n<p>determination of the property after excluding the<\/p>\n<p>mortgage     holding    is essential  for  granting   a<\/p>\n<p>preliminary decree in the suit is the submission of<\/p>\n<p>the counsel.      I am not impressed by the submission<\/p>\n<p>of the counsel.      Even on the submission made by the<\/p>\n<p>W.P.(C).No. 32118 OF 2009<\/p>\n<p>counsel, it is evident, the whole suit property as<\/p>\n<p>scheduled may not be available for partition.         It<\/p>\n<p>is for the plaintiff to specify the property in<\/p>\n<p>respect of which shares of the parties are to be<\/p>\n<p>determined before passing of a preliminary decree.<\/p>\n<p>The court is not expected to and further it should<\/p>\n<p>not proceed with an enquiry as to the identity of<\/p>\n<p>the property in the suit before adjudicating the<\/p>\n<p>right of the parties for partition and passing of a<\/p>\n<p>preliminary     decree.      That  is a  matter  to   be<\/p>\n<p>determined     at    a   later  stage.    There  is   no<\/p>\n<p>impropriety or illegality in Ext.P5 order passed by<\/p>\n<p>the court below.
