Justice ANTONY DOMINIC\n\n Dated :20\/02\/2008\n\n O R D E R\n                                 ANTONY DOMINIC, J.\n\n                 ------------------------------------\n\n                               W.P.(C) 5904  of  2008\n\n                 -------------------------------------\n\n                             Dated: February 20, 2008\n\n\n\n                                       JUDGMENT\n<\/pre>\n<p>        The   challenge   in   this   writ   petition   is   against   Ext.P11   to   the<\/p>\n<p>extent   interest   is   denied   to   the   petitioner.     The   finding   of   the   5th<\/p>\n<p>respondent   is   that   the   delay   in   payment   has   occurred   due   to   the<\/p>\n<p>fault   of   the   3rd  respondent,   the   Deputy   Collector   (Elections),<\/p>\n<p>Malappuram.         Though   this   finding   has   been   entered,   the   Lok<\/p>\n<p>Ayukta   declined   interest   for   the   reason   that   the   officer   concerned<\/p>\n<p>was not personally impleaded in the proceedings.\n<\/p>\n<p>        2.   When interest is to be granted following the default of an<\/p>\n<p>officer,   the   officer   can   be   saddled   with   the   liability   only   if     he   is<\/p>\n<p>impleaded in his personal capacity.
