Pathy, Advocate<br \/>\n                  Mr. Pankaj Kumar, Advocate\n<\/p>\n<p>                                    &#8212;&#8212;&#8212;&#8212;\n<\/p>\n<p>03\/   23-Aug-2010                Heard learned counsel for the appellant in all<\/p>\n<p>                    the three cases and learned counsel for the respondent-<\/p>\n<p>                    company.\n<\/p>\n<p>                                 2. On behalf of the appellants it has been<\/p>\n<p>                    strenuously argued that in fact it was found by the Excise<\/p>\n<p>                    Commissioner that excise duty was payable when the<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>unbranded chewing tobacco was given to M\/s RDS and<\/p>\n<p>M\/s GMS for packing and labeling etc in the unit situated<\/p>\n<p>within the registered premises of the respondent-company.<\/p>\n<p>According to revenue or the appellants the packing and<\/p>\n<p>labeling etc though carried out within the factory premises<\/p>\n<p>of the respondent was being done by the organizations<\/p>\n<p>having separate existence and such job work used in the<\/p>\n<p>manufacture of final product was liable for payment of<\/p>\n<p>excise duty.\n<\/p>\n<p>               3. Learned Customs, Excise &amp; Service Tax,<\/p>\n<p>Appellate Tribunal, East Regional Bench, Kokata has<\/p>\n<p>dismissed the appeals preferred by the appellant for<\/p>\n<p>different financial years raising the same issues after<\/p>\n<p>coming to a conclusion that there was no contravention of<\/p>\n<p>the excise law because labour contractors were working<\/p>\n<p>within the factory premises of the respondent-company and<\/p>\n<p>were being paid on piece rate basis which amounted to<\/p>\n<p>undertaking job work in respect of filling\/packing\/labeling<\/p>\n<p>of chewing tobacco.\n<\/p>\n<p>               4. On consideration of entire materials the<\/p>\n<p>Tribunal agreed with the finding of the adjudicating<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>         Commissioner that it was a revenue neutral situation for the<\/p>\n<p>         entire period in question. We were not shown any<\/p>\n<p>         notification or law in support of claim that excise duty was<\/p>\n<p>         leviable in respect of job work being done in the premises<\/p>\n<p>         of the respondent-company.\n<\/p>\n<p>                      5. In the aforesaid facts and circumstances,<\/p>\n<p>         we find no illegality or error in the orders of the Tribunal<\/p>\n<p>         under appeal in these three appeals.
