Justice P.R.RAMACHANDRA MENON\n\n Dated :20\/05\/2010\n\n O R D E R\n            P.R.RAMACHANDRA MENON, J\n               --------------------------------------------\n                WP(C) NO. 2475 OF 2010\n               --------------------------------------------\n        Dated this the 20th day of May, 2010\n\n                           JUDGMENT\n<\/pre>\n<p>The petitioner has approached this Court with the following prayers:\n<\/p>\n<p>        (a)    To issue a writ of mandamus or any other<br \/>\n appropriate writ, order or direction, directing the respondents to<br \/>\n return back Rs.37,500\/- (Rupees Thirty seven thousand and five<br \/>\n hundred only) collected from the petitioner, with interest at 18%<br \/>\n per annum from 26.07.1978 to till the date of payment and also<br \/>\n the amount ordered to be refunded as per the order dated<br \/>\n 16.01.1986 in T.A. No.176\/77 and 177\/77 by the Sales Tax<br \/>\n Appellate Tribunal, Additional Bench, Kozhikode with 18%<br \/>\n interest from 16.01.1986 to till the date of payment forthwith or<br \/>\n within a time limit fixed by this Hon&#8217;ble Court.\n<\/p>\n<p>        (b)    To issue appropriate writ, order or direction,<br \/>\n declaring that the petitioner is entitled to get back Rs.37,500\/-<br \/>\n (Rupees Thirty seven thousand and five hundred only) collected<br \/>\n from the petitioner, with interest at 18% per annum from<br \/>\n 26.07.1978 to till the date of payment and also the amount<br \/>\n ordered to be refunded as per the order dated 16.01.1986 in T.A.<br \/>\n No.176\/77 and 177\/77 by the Sales Tax Appellate Tribunal,<br \/>\n Additional Bench, Kozhikode with 18% interest from 16.01.1986<br \/>\n to till the date of payment from the respondents forthwith or<br \/>\n within a time limit fixed by this Hon&#8217;ble Court.\n<\/p>\n<p>        (C)    To issue a writ of mandamus or any other<br \/>\n appropriate writ, order or direction, directing the respondents to<br \/>\n comply with the Ext.P2 and P8 judgments by this Hon&#8217;ble Court<br \/>\n in the letter and spirit and to direct the respondents to pay back<br \/>\n Rs.37,500\/- (Rupees Thirty seven thousand and five hundred<br \/>\n only) collected from the petitioner, with interest at 18% per<br \/>\n annum from 26.07.1978 to till the date of payment and also the<br \/>\n amount ordered to be refunded as per the order dated<br \/>\n 16.01.1986 in T.A. No.176\/77 and 177\/77 by the Sales Tax<br \/>\n Appellate Tribunal, Additional Bench, Kozhikode with 18%<br \/>\n interest from 16.01.1986 to till the date of payment.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>WP(C) No. 2475\/2010<\/p>\n<p>              (d)    To pass such other orders or directions this Hon&#8217;ble<br \/>\n       Court may be deem fit and proper to grant, in the circumstances<br \/>\n       of the case.\n<\/p>\n<p>              (e)    To award the costs of the petitioner from the<br \/>\n       respondents.\n<\/p>\n<p>     2.     Heard both the sides. It is seen that the basic prayer is with<\/p>\n<p>regard to the claim for refund. It is also pointed out that Ext.P11\/P11 (a) are<\/p>\n<p>pending before the 3rd and 4th respondents.\n<\/p>\n<p>     3.
