     The petitioner is presently working as H.S.A. (English)<\/p>\n
in the Government Higher Secondary School, Mookkanoor.<\/p>\n
She is the class teacher of Standard VIII A of the school.<\/p>\n
According to the petitioner, because of union rivalries and<\/p>\n
political influence, petitioner has been subjected to a<\/p>\n
transfer   unjustly,     alleging       that      the     petitioner  has<\/p>\n
misbehaved with a student of her class, who is undergoing<\/p>\n
treatment    for lead poisoning, who requires very careful<\/p>\n
handling in view of the same. Petitioner submits that the<\/p>\n
petitioner has not done anything to hurt the feelings of the<\/p>\n
said student and she has only advised the student when the<\/p>\n
student transgressed the limit of discipline.                   Petitioner<\/p>\n
therefore seeks the following reliefs:\n<\/p>\n

     i      issue a writ of certiorari quashing Ext.P7 proceedings
\n            issued by the 1st respondent.\n<\/p>\n
\n     ii.    issue a writ of mandamus directing the 1st respondent not
\n            to transfer the petitioner from Govt. H.S.S., Mookkanoor
\n            to Govt. H.S.S. Vazhakkulam on the basis of Ext.P7.<\/p>\n
      2.    I had granted an interim stay of transfer which is<\/p>\n
continuing. An application for vacating the interim stay has<\/p>\n
been filed by the respondents 1, 2 & 4, stating that it is not<\/p>\n
in the interest of the school to continue the petitioner in<\/p>\n
that school and it was therefore taking a lenient view that<\/p>\n
the petitioner has been transferred to another school not far<\/p>\n
off. Various documents have also been produced in support<\/p>\n
of the respondents’ contention that the petitioner was<\/p>\n
harassing the student who has sought to come on record in<\/p>\n
this writ petition by filing an application for impleading. I<\/p>\n
am not able to come to a definite conclusion as to the<\/p>\n
alleged harassment by the petitioner on the additional<\/p>\n
respondent.        None of the documents produced by the<\/p>\n
respondents        speaks      about     any   specific     incident  of<\/p>\n
harassment, but only a statement that the petitioner is<\/p>\n

harassing the student. Notwithstanding the same I am of<\/p>\n
opinion that it is in the best interest of all concerned<\/p>\n
including the petitioner, to see that the petitioner is<\/p>\n
transferred from that school. However that transfer need<\/p>\n
not be this year itself because for this academic year the<\/p>\n
school has already closed. The petitioner now submits that<\/p>\n
she is prepared to join another nearby school, in the<\/p>\n
peculiar circumstances of the case, without admitting that<\/p>\n
she is in any way guilty of any of the allegations against her.<\/p>\n
I am of the opinion that in the above circumstances the writ<\/p>\n
petition itself can be disposed of with appropriate directions<\/p>\n
regarding transfer of the petitioner in the general transfer<\/p>\n
for the next academic year. Therefore this writ petition is<\/p>\n
disposed of with a direction to the respondents to continue<\/p>\n
the petitioner in the present school till the next general<\/p>\n
transfer. During the next general transfer, the petitioner<\/p>\n
shall be accommodated in the nearest school, where a<\/p>\n
vacancy is available as per the transfer guidelines. If no<\/p>\n
vacancies are available in any of the nearby schools the<\/p>\n

petitioner may be transferred to the school to which the<\/p>\n
petitioner has been transferred as per the order impugned<\/p>\n
in this case. But I make it abundantly clear that the same<\/p>\n
shall not be a reason to transfer the petitioner to that school<\/p>\n
only if any vacancy is available in any of the nearer schools.<\/p>\n
Respondents 1, 2 & 4 shall see that the petitioner is<\/p>\n
accommodated in a vacancy in the nearest school if one<\/p>\n
vacancy is available as per the transfer guidelines. I also<\/p>\n
make it clear that I have not considered the allegations and<\/p>\n
counter allegations of the parties on merits and have passed<\/p>\n
this order in the best interests of all concerned to have a<\/p>\n
peaceful atmosphere for the students to study which is the<\/p>\n
ultimate object of running the school.\n<\/p>\n
      The writ petition is disposed of as above.\n<\/p>\n<\/p>\n
